Underlying all these is the principle of 'conscionability'. It is said to moderate the harshness of the Common Law. These were the foundational principles of equity Everything in equity is underpinned by conscionability. “The idea is that a sort of sclerosis of the common law had set in, as a result of which it failed to adapt to new developments in society and economy, and the Chancery provided remedies for these problems”
Equity is founded on these principles but, like the law, it depends on precedent. It is necessary to understand its development to appreciate how equity works. So, like the law it is based on precedent and it is NOT discretionary

Thank you Gareth, this video is a great introduction to the law of equity. You even mentioned Bleak House. Dickens did have his issues with the courts. The bbc made an excellent version in 2005, which is well worth a watch. I enjoyed the coroners court they held in the local pub. I will be watching all your videos, thanks once again.

Thank you so much for sharing. You talked about the principle of conscionability in slide 3. I have looked in most books and various legal engines but cant find the same but the principle of unconscionability. Where can i find something about the principle you talked about?

do you know the name or form to use, for either a private citizen or a public citizen to declare a demand to cease operations/ time out until a proper disclosure in full/ audit in full and review by class representatives of the ethics being upheld in current courts and authorities still remaining from time antiquity, as many previous issues that were previously popular most suredly could be outdated and any furtherance to continue to do business as is is at the detriment to the entire class... .?

I thought equity was a process of discrimination. “Equal opportunity of outcome” does not exist naturally so discrimination is used to equalize the outcome. You have to discriminate against one to give to another. Racial equity or financial equity like shown in collectivization where people get equal pay no matter what they produced lead to the deaths of millions.

Like positive discrimination maybe. Which in of itself is a contradiction in terms, as what maybe positive for some maybe inimical to others.

@@dyfnwalmoelmud8362 you mean like how they will pass up an Asian or white person just to higher a black person? 🤔 positive for that black person but discriminating against others is not positive discrimination. IT’s discrimination.

@@dyfnwalmoelmud8362 that’s what we see in California today. The highest homeless rate twice the next state down. Predominantly white male. Imagine a working white male homeless in SF paying reparations to a wealthy black person? That’s discrimination people are blatantly ignoring all because of posturing. Pretending to be virtuous with an insidious ideology.

@@scott-hr3hd I think you may have made a mistake and reversed the races when speaking about discrimination in America my friend. White people are the ones who have practiced racial discrimination in all forms throughout the history of this country. You should do some basic research to understand this.

Kingsley Napley LLP, Bdb the pits LLP and healthcare regulators like hcpc need to know about equity. They've had nearly 400 years to find out about equity and ethics. Can you teach them from the basics? If so, you Would be saving lives of Whistleblowers in healthcare and social care... 🙏☮️☯️✝️
