The old man has a right to give back the deposit. That’s why he has a good recommendation and he’s been in business for 45 years. A business is a name, and a good rep is a good business. The plaintiff should be content with she has. The defendant could demand his $2000 back because the sale fell through, and charge her storage for the piano she doesn’t have a place to keep. She might end up being in desperation and end up selling the piano for dirt . Sometimes in these situations, things get put up in auction. See how much you’d get .
@dontcare6962 жыл бұрын
Well he couldn’t charge storage because it’s on consignment
@mikesteele053 жыл бұрын
Listen, I know the plaintiff was shocked to learn that the piano didn’t actually sell, but once she learned it, she wanted to treat this case like she was standing at the customer service counter at Kohl’s and would get some sort of apology and freebie. Either take back your piano or keep waiting to see if it sells. Personally, I’d take my piano back. The defendant doesn’t seem like he’s fit to be running a consignment business right now if he can’t find paperwork, can’t remember conversations, and can’t remember to pick up a phone and say, “By the way, the piano sale fell through.”
@kathywinn68693 жыл бұрын
You made some good points. She might want to consider the cost of storing a grand piano in a climate controlled environment and count her lucky stars for the situation she finds herself in. As for the shop keeper, he might do well to hire someone to handle the business end of things. He clearly has some deficits related to those responsibilities. My guess is that in his time, his business was a well oiled machine.

Maybe your right, maybe your wrong. As the judge would say " thats all speculation and hearsay". Sometimes people do misplace things. But Regarding this case it really seems to me that the defendant knew that piano would be sitting around for quite some time. He got a deposit but it seems his experience told him that it doesn't mean its sold which turned out to be true. Overall the defendant seems like an honest and extremely fair individual. I'm sure she tried to find a different dealer to buy it but they lowballed her and she wanted top dollar and right away. The plaintiff seemed like she really wanted to get rid of the piano and dump it on someone else's lap. She was probably harassing him so he probably told her ill give it to u when I sell my property but he didn't want to acknowledge that in front of the judge so he's not on the hook for it. He could've told her ill give u 500 for it like other dealers she probably went to but he was very fair with her. As the judge always says, no good deed goes unpunished.

She’s ridiculous. It’s a piano. It’s not a phone, computer/laptop, or a tv. It’s not going to sell fast. Plus the price over the electronics listed is higher than each alone. And they are ‘small’.
