While that is true in general, the idea is that you cannot fire at someone who is no longer a threat. They initially had the homeowner at gunpoint and he turned the tables. I'd say he could argue that he knew they were armed and was concerned the threat was still present as they could retreat, gain cover, and return fire. Plus it happened so quickly he'd probably be able to say he was only focusing on protecting himself and had not yet processed they were retreating.

this is one of the more disturbing home invasions videos on youtube imagine being the suspect running out of thar garage in total darkness and hearing gunshots next to you and seeing muzzle flashes as you get shot, body goes limp and your vision fades as you die OR you're the home owner seeing a Silhouette in complete darkness and shooting at it knowing you're about to kill a human being.
