@@peterlongprong7521 for me, the question is who's liable for who's decision, and who made money off a bad decision? In my state, developers built a neighborhood (for the Rich), on sand dunes, perched on the edge of a fifty foot cliff, overlooking the ocean. They are now about to become mobile homes on the way to the beach. And, of course, taxpayers are expected to do something about it. In California, the rich buy property in the middle of nowhere, so they don't have to live around slobs. Wildfire season comes, and $ millions of dollars are spent trying to stop the fires just for them. Someone made these decisions, and they or their insurance should carry the entire cost .

Chances are the builder started the HOA. Then as homes were sold handed it off to the homeowners to manage. Meanwhile the HOA is wonder how in the hell they are supposed to do anything with probably less than $20k in the bank for a multi-million dollar problem.

Actually the trees were removed after the landslide. But still build on a hillside at your own risk.

@@RichardFelstead1949 Get sued. But since HOA's have no assets that can be sold, where does that go? So they'll go after the builder. But the builder protected themselves by off-loading the warrantee for the home to an insurance company that is probably deep underwater. Meritage is the 5th largest builder in the USA, but that probably means that they've got good lawyers to limit the damage. If the HOA was at fault due to negligence in maintaining the hillside, then it might have to raise homeowner's fees, which will decrease the property values for even the houses that were built away from the cliff. But I'm sure this will provide a lot of money for some lawyers.

The trees and shrubs were removed before the landslide, as you can see in the before and afters. Only some were removed afterwards.

My father was a civil engineer - he used to always tell us that people were nuts to build so closely to cutoff land like that. Of course its going to slide eventually.

Pay better attention when buying property. Dont EVER buy to close to any kind of ridge, drop off, coastline, hillside, etc. Erosion is always a possibility. Choose a better, safer and more flat area to live.

Also you forgot tornadoes, fires, earthquakes, even lightning storms..... love the sarcasm though. Being a homeowner, i know that there are many things to factor in when buying a home. Specially when spending so much money on such an investment. And location is a huge factor. One my husband and i both took seriously. Not my fault that its easily overlooked compared to other factors.

@juju-xx5xn well it depends on a few factors. If you terrace it, with retention walls, no it won't. That's what retention walls do, especially if they are terraced correctly. That's what engineering is for. You have heard of civil engineering? Isn't Machu pichu terraced?

@@trainwreck420ish I disagree. There are foundation problems on properties built on a cliff. I like a view too but I am going to need a property with a large lot size so that the cliff is a good mile or 2 away from the actual house. People forget about weight. When one builds a house on a cliff eventually they and all their neighbors on the cliff are going to want extra things like pools, growing families, multiple cars, etc all of which adds to the weight of the property and these old cliffs are always shifting and losing a little bit of land each year so it is best not to build right on the cliff. Every time it rains you lose dirt on a cliff and that dirt is needed to support the weight of all the houses on that cliff

The house I grew up in was on a hill like that. Before the houses were built, the hill had to be reinforced. They drove steel poles 12 ft into the hill every 20 ft along the hill. That area has survived a number of earthquakes and storms and no landslides have happened. Funny what happens when you build prepared.

@@ladin425 there are coatings to prevent that. They have to do it with rebar too, since rebar will also rust inside concrete if it isn't protected.

The problem started when homes were allowed to be built in an area of poor soil compaction plus vibration from trucks, cars on the road below. Why were homes allowed to be built on unstable land to begin with ???? should be the first questions attorneys ask contractors, builders, inspectors, and city permitters.

The city/county should have required very expensive but needed hill stabilization before allowing houses to be built. A setback from the edge of a soil cliff only delays the inevitable.

Yes, while your statement is correct, at the same time, the builders had to have gotten a permit either from the city or county to build on unstable ground (which wasn't unstable at the time). The question is, did the govt okay the build without batting an eye or did they demand the builder get confirmation from a geological firm that the land was stable on which to build? Liability depends on what was initially demanded from the local govt authority who issue the permit for the go ahead.

Oh good God. Another useless fee to pay in 99% of the cases. Try to build a house these days. Everyone is after a cut. For Maryland, the state. Transferrable Development Rights. That 3 acres you bought? Not so fast building a house. By the time you're done that'll be about $45K more - IF you can get the TDRs. We have building codes. That's why we have a government to do these things. THEY are supposed to be responsible for things like that. If they can stop me from building on my own property, stop me from building a shed, stop me from parking my tractor where I want, stop me from building a fence, why couldn't they stop this? They knew. Someone was probably paid off.

I can answer it for them: Their houses are built next to a steep hill on what looks like sandy soil meaning that its very prone to erosion. Then you have the fact that all the trees and vegetation that was originally there was cleared to build the houses. Meaning that all the roots and etc. that were protecting the hill from erosion and eventually catastrophic collapse are now gone. Finally you have the developers that built the homes in the first place that either didn't do their due diligence to ensure where they were building was stable. With the latter being paid the city a fuck ton of money to build there so they could profit and leave ASAP. So yeah, there you go, that's why the hill is collapsing, and is why it's important to leave the vegetation alone around hills and cliffs.

My same exact feelings, what makes anyone today even find it reasonable to buy a home on the side or close to a cliff, mountain or hillside think they are secure. Its like building a home on top of a in active volcano, but when that volcano goes active who's responsible.

That's what happens when you build your house near a hillside or near the beach. So it's the owners who want their house near a hillside, if it rains a lot it's going to cause mudslides and it's going to eventually make your house go down the cliff and then there goes your house.

No, in Court, all the Developer has to proof is they followed all Construction rules and what happened is not their fault, such as house is damaged due to Mother Nature. They also going to say "The City Approved it". Home Owner can't really expect to get the City to pay for the Home either, because what happened was due to Mother Nature. This is going to fall on the Home Owner Insurance, but if the Insurance plan specifically exclude land slides, then the Homeowner is on his own. Afterall, is HIS/HER house.+ If this get in court, most of the time the Judge will try to get both party to settle it themselves, but if 1 party refuse the Settle, then it would be up to the Judge to decide who is going to be responsible.

These homes should have never been built this close to such a steep ravine. The Township should not have approved building permits for these homes nor allowed the subsequent building of homes there, that were ultimately sold to unsuspecting buyers.

Any civil engineer with “soils” experience, would have stated unequivocally not to build their without concrete columns placed deep into the soil. This looks like alluvial soil and probably wouldn’t support homes.

Behind one of my friends house I watched a developer level off a greenbelt and develop it. The reason it was a greenbelt surrounded by development was that it had a dry creek running through it. The developer leveled, built, and now the seasonal water flow is cutting itself back into the land.

Builders are obtaining permits to build on land that is completely unsuitable. Buyers have to investigate the history of the area, especially if it is a new sub-division, to get the real picture.

I have a cabin that was built in 1700’s back from a creek called “Middle Island. Well it’s 2023 and the water (which becomes a rushing river) has eroded right to the back porch. I am pretty sure that embankment will give way and wash it right down with it

County is responsible for the damage. They cut the road down the hill years ago. Who issued building permits for homes at the edge of a man made cut in the hillside?, causing the whole situation. Somebody is getting paid to look at the location before a building permit is issued. That's the person not doing there job ultimately led to this situation...

Any first year geologist can tell you that any hillside that is steeper than 30 degrees is inherently unstable and prone to landslides. Clear away the trees on it,you guarantee a landslide. Nothing to see here.

The developer probably cut all the trees down on the hill so the houses can have a great view of the low lands. That caused the hill to become unstable, and the first good rain that came along cause everything to go downhill.

When I was in High School I took a science class in geology that talked a lot about the power of water,, etc. As an architect is an area of ancient landslides next to the foothills I have refused to do work associated with building on or near the slopes. It has save me a lot of grief. Even with qualified soils engineers there have been a number of issues like the one depicted. You cannot fool mother nature.

Flat land at the bottom of alluvial, fluvial cliffs is also vulnerable. My rule of thumb: never buy near a creek, a river, a valley, fracking, meat packing, hog farming, chicken processing, schools, churches, shooting ranges, golf courses, and more!

Erosion - when all the old trees are being cut down across the globe, thus the soil is loose with no grip, this will get worse and worse - as well, these homes are on a cliff, the ground moves naturally with the erratic weather patterns of recent, sorry for the homeowners

I nearly bought a House in Canada 20 years ago, the day I went to review the house the landslide in the morning took 29 houses with it. Needless to say I stayed away from the area. The inquiry found that the county had not done surveys of the land to confirm it was fit to build on.

People build there house on the side of a sandy hill and wonder why it’s sliding down. I can tell you exactly why it’s happening. It’s called angle of repose. It’s the developers fault for building and it’s the buyers responsibility to do their due diligence. You don’t build a house the side of a sandy hill. I don’t feel sorry for any of them.

You have a home in a bad location, all these people build ocean front, on cliffs, in area known for land slides, and floods and other disaster's if you build or buy make sure you have good insurance buyer need to take responsibility for choices.

doesn't even have to be a cliff to start sinking and changing dramatically, depends on what's going on underground, this is why i find it amazing when i see houses over in europe that have been around for like 500 years, the odds of both the house and the land being undisturbed for that length of time is pretty low. there are some timelapse's of soil moving around up and down over the course of decades, the earth itself just moves, and honestly you can't expect an area to remain the same forever. anyways i assume these houses are fairly new since they look like cheap clones of each other side by side, so i bet they didn't even check the land much before building them quickly.

Hillside vegetation is important! But it's in the way, so let's cut it down to work on the hill. Doesn't the city, county, and/or state charge fees to approve building plans per codes for such things? 💸 Oh well, at least they had a nice view for a few years.

I guess there were no soil samples taken prior to building on that site ? Also the environment of trees kept the event of decay and erosion in check all those years before the upper soils were disturbed .

This is a highly rare situation. Usually homes can be built within inches of a mud cliff. But, in this unusual case homes are actually falling off the mud cliff...weird.

This same thing happened in Washington PA on Lobell Drive, they built a development on hill, man made or over an old landfill.. I can't remember exactly it was so long ago.. 25+ years now, but the same issue was happening, land sliding.
