this video highlights two major problems with policing, you have a good man, not knowing the "law," call for clarification on the "law." With policing you get good men that mean well, then, there are bad men that are here for a payday. it's like that box of chocolate, "you never know what you're gonna get." the other highlight... cops are not lawyers, don't know Legalese/Latin, so cannot possibly know "law" statutes and codes are written by lawyers in legalese/Latin which cops can not interpret.🤔

@@mr.duanesharpe ::: It is more likely what Perez said to the sergeant saved the day rather than saying how it would have turned out if he had arrived first. The officer said we do it all the time and then advised Perez to notify the sergeant. Perez told the sgt that Jeff and James were first amendment auditors. That probably rung a bell in the sgt’s head and I believe Perez lead the sgt in the direction of the terminal being public property. If the second officer’s supervisor is the sergeant, the sergeant apparently didn’t provide the same guidance to the second officer while he "did it all the other times".

The most disturbing thing to me is: If the cop in the car was the one in charge, you both would have been trespassed because they "do it all the time." He DIDN'T CARE whether it was public or private property. Somebody wanted you to leave and that was enough for him. He doesn't know the law for trespassing, doesn't know that PUBLIC vs PRIVATE is different under the law for trespassing someone... but he knows that KNOWING the law will get in the way of him generating revenue for the city and will inhibit his ability to enforce his will and other people's feelings (which gets in the way of the second duty he has - controlling the public).

It's part of a common qualified immunity defense - "I enforced the law **as I believed it was written**" is an admission that they don't know the law **as it is written.**

@Claus - That's "standard", in my industry. While I don't have 45 years, I do have 25 years. I also have worked bus terminals, here in Riverside County, CA., as a supervisor, having to hold post from some deadbeat that called off, at the last minute. At no point in time was there ANY training as to whether a bus terminal is PUBLIC, or PRIVATE. So, although I have "some" grievances with HOW Jeff conducts business, he's also been invaluable, as well. I've never given that aspect of the job, any thought, or even about taking pictures of governmental buildings, which I have found, through Jeff's insight, and my own follow-up research, that even that, is allowed. And I've advised MANY, in the past, they could not do so, as required by my superiors, and the company's I've worked for, without ever thinking to ask those kinds of questions. But this wasn't arrogance, or a power-trip; it was clear ignorance, or naivety. Had I ever been called out by someone challenging me, like Jeff does, I would have been like Ofc. Perez, and asked someone higher. You need to understand, security is a "bottom-feeder" industry. It generally pays minimum-wage, thus getting the worst, dummest, and laziest of society. I have excelled in every company I've been in, BECAUSE I'm NOT like the rest.

@Jon Samuda::: That other cop gave him some very bad info regarding his past experience of trespassing people from public property but I am not sure if he had NOT suggested Officer Perez notify the sergeant he wouldn't have trespassed them. When the two guards said Jeff and James were on private property Perez didn't attempt to correct them at all. Then he told Jeff/James that they were ON private property and only expressed some doubt when they pushed back with "whoa" at which time he changed his tune. After determining it's public property Perez appeared to find it very difficult to inform the guards that "it's public property". Only at the very end. He tried too hard to please everyone and came out not looking good in my view.

Cop was getting mixed messages. Employees telling him it's private property, his common sense telling him it's public, his peer telling him yeah/no you can trespass them. Rather than accept any of those as being definitive, he sent it further up the chain so that he can say he did his due diligence. Those in higher positions know what kind of sh*t storm they'd be creating if the cop trespassed them, and set it straight. About my only criticism of this cop is that his attempt to tell the Voltran employees that it was public property was not the most eloquent, and I think it's highly likely they learned nothing from it. They'll run the next person off if they can. This cop seems like he doesn't hang out with the cops who are fully ego-driven. I'm pretty sure that men who categorize themselves as "Real Men" would disparage his behavior. But to my way of thinking if our police force were as easy going, diligent, and friendly as this guy, and yet have the bravery to protect lives that are in danger, then as a nation, we'd be in a much better place.

They were absent entirely. Learned nothing. But it's not the cop's job to educate them, what needs to happen is that the Voltran people need to change their policy. They are the ones who have a policy that is unconstitutional. I love how Jeff warns folks that they are about to make a mistake.

as much as one officer stated, "we do it all the time" you can tell he is clocked out of being a decent human, but the officer we follow on the body camera, is actually caring, listens to both sides first, didnt push on getting them off before double checking their rights. on top of being Cordial the whole time. i feel this is a good video showing the range of what investigations should be done before rights are intruded on, the officer even expressed Jeff/company's rights to the complaining party before he left saying they are within their rights to do what they are doing, so in a way telling them not to harass them any further. as i always say Jeff amazing video's and solid video gathering. keep up standing for the rights of the people. you are the change everyone needs to see.

Very professional, courteous, and thorough officer. Doesn't go on a power trip, understands that they have rights, makes sure to tell the other officer "they're cool" so he doesn't escalate, verifies through proper channels by actually investigating, and doesn't need their IDs for his "investigation" either. This is the most transparent body cam video I have seen, he didn't mute the body cam to talk to the other officer, as they usually do, or for his convenience.

There are numerous videos proving security guards are not fully trained in all aspects of their jobs. This is a prime example of another one. The fact the cop actually checked whether the area was pubic or private was refreshing. We seldom see this happen.

I didn't usually go out on a limb for cops, but this guy did an amazing job. He checked with his immediate supervisor who dropped the "we do it all the time" bomb, but still checked on with their supervisor because the real question was"is this legal". Big props for doing the right thing.

Agreed, but one first must learn that it is a valid civil right. Schools aren't teaching it. I spent 16 years working at or for state agencies, never was taught that. Now cops... no excuse. All LEO should be taught that... no quarter given there.

They think it's private property because it's what they're told to think because they wish to keep their job. Some folks feel safe mired in ignorance. Learning new things and thinking outside the box, can be painful.

First class officer, polite and dignified, most of all he wasn't sure and sought confirmation from a supervisor without any raised voice ir demands. A PROPER COMMINITY OFFICER. NEED MORE LIKE HIM.

He explained Jeff and James twice that "this is private property, that´s the only issue" BEFORE he asked the 2nd cop or called to his sergeant. But I understand, the bar is very low in the USA nowadays and many people not able to follow simple conversation.

I've never minded when they don't know everything and have to defer to an legal source or supervisor, what I've always hated to see is them deciding they're the lawmakers and enforcing what they don't even know.

That cop should’ve already known if the bus terminal was public or private. Officer Perez failed that task so he deserve no pat on the back for learning in the middle of an assignment. Cops don’t need to know EVERYTHING but there are somethings they must know.

Good thing the "we do it all the yime" cop wasn't leading this call. The other officer who handle the call did a great job. He wasn't sure if the place was public or private. Asked the idiot "Just trespass them. We do it all the time cop" for his opinion. Obviously felt that answer was bs because he called a supervisor who advised him it was public and from there respected everyones rights. That's how it should be.

I think we learned that the Daytona Beach Police trespass people from public property all of the time. A reasonable person might think that sometimes the officer will do this just based on a person in charge of that property asking them to do it and sometimes an officer might not do it if they find that the people were acting within their rights and committing no crime. Let's hope more educating encounters like this will increase the odds of the latter happening when officers respond, even if you aren't a First Amendment auditor.

The cop that actually handled this, and saw it all the way through was awesome. He kept his cool, he didn't take sides, and he vigilantly sought the facts needed to properly protect and serve. He protected their 1st amendment right instead of immediately siding with the complainants who called in, and he made sure that he was getting it right before taking any action. He even called a superior instead of taking the wrong advice from a fellow officer. Bravo! This is what a law enforcement officer is supposed to be like.

Been a fan of yours for years and don't understand how these public officials wouldn't automatically know who you are. The sign is a dead giveaway.
