Whether an experience letter would be demanded or not by your new employer is immaterial,but absconding is something that will definitely put a black remark in your career documentation. Refrain from doing so and get proper exit from your current employer by serving notice period or pay in lieu thereof. .

Other than account holder or court orders, no one is authorised to check details from bank. Even bank are not authorised to share such details. Pl ensure, while joining, you are not permitting to check your bank details ..

It depends upon the company policy whether they accept candidates with such type of cases or not. If a company asks, any such disclosure in their joining docs, it is better to do that , rather than the company getting to know through the bgv outcome. Whether the case is true or not, that court has to decide, which of course is a time taking process.

Sir mene abhi recently switch kiya hai notice period serve karke aur abhi new company join kiya hai offer latter bhi aagaya hai aur abhi mera bgv chal raha hai. Mere pass sab documents hai salary slip, reliving latter, epf, form16. Problem yeh hai ki meri previous company not responding for bgv verification. I called my previous company HR they said company not responding because you and one more colleagues recently joined the same organization. Aur abhi current company bol rahi ki jab tab tumhara bgv clear nahi hoga tb tk hum tumhi client side onboard nahi kr sakte. And current company bol rahi agar previous company bgv clear nahi karti to hame aage action lena padega.

Instead to seeking hike on the last drawn salary, why don't you ask hike on average monthly gross CTC - salary ( include your all ref. Bonus and client bonus, etc.) and increase your percentage of demanded salary. This way, you are not hiding correct thing . Even if this is cross checked by your company, there would not be any untrue facts. Hope, you are clear now.

Nothing is preventing you to apply for the job provided you qualify the eligibility criteria. Upon selection, you need to support your claim with documents, which you have in your hands now. There is no set rule regarding seeking information or documents from the candidate before rolling out an offer by the HR. Be confident what you said and support through docs. All the best.

Seeking exemption from becoming PF member is for those employees, who are not yet member of the fund. If you are already covered under PF with your present organization, then your details are already with the PF department and you have to be a contributory to the PF fund and you cant hide your employment. These details are easily traceable while checking for BGV.

What happens after termination due to background verification failure. Is that person liable to get a job or the career is spoiled as the experience letter shows separation type as termination. Also, if there is a possibility of job then what kind of companies can hire?

Generally, an employee is asked to resign if his bgv is not favorable and in experience letter cause of his separation is shown as Resignation. No one can take away the right of livelihood of anyone. Assuming if some company is adamant to put the remark as termination, a request can be made to them to change this as resignation. Logically , a employee is already punished for his bgv conduct , he should not be punished for his whole life. There are various opportunities, wherein the employer do not demands any letter , that option need to be explored by the Employee. This is not the end here..keep trying..

If they have agreed to your notice period and issued offer letter with proposed date of joining ..then you need to trust on them..however, you stay connected with them regularly and talk on the company's news etc. hope, you are getting my point. BGV policies are company specific and as such there is no set rule to my understanding. It is difficult to comment whether company has such policy or not. You would get to know, once you are part of that organization. It is always better to disclose true facts at first instance to show your bonafide and justification at a later date.
