How Defendant's Continuous Wrongs Temporarily Stop the Statute of Limitations - Extends Time To Sue.

A lawsuit must be filed within a certain time. The time is estabished by state statute. This is the Statute of Limitations. Typically, if the lawsuit is not filed within the time allotted (beginning from the last wrongful act), the lawsuit is deemed to have been untimely filed. But what happens when the wrongful act is continuous? This video addresses this question, illustrating the application of the Continuing Wrong Doctrine, using a real case.

@@advocatelucinda I’m in Massachusetts a liberal state, I was wondering, during the motion to dismiss hearing, the plaintiff set a motion for a sac, in that motion I stated I wanted to add more defendents, & stated that there was a wrongful interference in a business contract. It was accepted by the judge. Now that I am able to add the new defendent, would I also be able to add the new charge.

Look to the Order the judge signed. It should include the court's order permitting you to amend the complaint to add defendants and add a new claim. If the judge did not sign an Order, you may want to contact the clerk for clarification.

@@advocatelucinda the order stated motion to dismiss allowed in part & denied in part, & plaintiff motion to SAC is allowed. Which is pretty broad, but in that motion I plead that I was adding 3 defendants & made a claim of charge, I didn’t state I was going to add another charge though. I did call the clerk & he said just bring it in because he couldn’t find the docket # on the motion to see it I guess but i have to file this Monday so hopefully it’ll be fine. I appreciate your responses. 💜🙏

Could this be applicable to criminal acts? Sheriff deputy arrests trespasser on property he rents (not legal arrest), with unnecessary violence. Sheriff withholds evidence 2 years, the same ongoing case. (in Florida of course).

To the hiring of an defense attorney whom aquires brady excolpatory cps report and doesnt use the report after sentencing to, trespass by supposed victim, trespass from sherrif , same arresting sherrif second case now the defendant gives report to same sherrif that he was threatend by a known drug addict by text message, then shot at by the drug addict bullets go through house, same sherrif gets confession from drug addict, weapon and doesnt make an arrest, da takes months to pick up case ,neglegently charges and sets bail low, the victim in the shooting case case isnt treated right in any case and makes a complaint to the da. In person with da. Investigator and dda. And victims advocate. Its found out that the shooter is a c.i. Investigation is supposed to be under way by da. Investigator. The shooter is then allowed to hire by the da. And court a p.i on brady list whom is ex sherrif, also pi. For non profit of anti human trafficking in area, hotel now in 3rd case makes absurd statement to police stating that the defendant /victim has excesseive guests when none came to room or left room ,and that they were just trained in human trafficking, its discussed on officers body cam that no pc. Or reason to harass this person and officers retrieve key and come through door based on 4th waiver in sentence of the 1st case, all officers and sherrifs da have continually ruined there targets life. The same attorney hired for all three cases ineffectivly represented on the criminal cases and he was even inneffectivly hired for shooting victim case. Was coerced on every case by this attorney and tried hiring second attorney only to be continually railroaded by this county .
