If no one was their. It's your word vs. Hers and that a 50/50 type of thing and that falls bellow beyond reasonable doubt. I'm going through the same thing and my case hasn't went to trial im 2 years in 3 months now. They haven't even released discovery at all in 2 years. I think they are banking on us getting in another confrontation to force me to take a plea deal from the first case in my opinion.

I lacked fear getting handcuffed because I knew they just took het word for it and that was the only evidence. We argued about money because of a PPE loan and my unwillingness to give her any of it. The money was deposited into my account the day of the arrest but cops wouldn't listen to me and said they believed her. An arrest is just the starting process. Beyond reasonable doubt is extremely hard to prove in he said she said

I tried to tell them what happened but they said I’d get my day in court. Never in my life did I think you could call the cops and have someone locked up with zero evidence. You gett caught around your S.O with a no contact order.. that's a violation of a court order and you will be arrested. Get it dropped first before going back to her. Not to mention, you piss her off. All she gotta do is call the police and say you're violating the no contact order. Get enough violations on your record against any one person, you could end up looking at stalking charges as well.

Moreover we need more laws out there to protect the rights of men, far too often the system is played by women and it diverts attention from and discredits actual cases where women are being abused. I have had a difficult time trying to obtain Legal Representation with meager financial resources. Many I have called that advertise as free- low cost did not prove to be the case. Yet other free services were not available to you, if you are the accused, even though you are trying to prove her words are false. I have had an initial hearing on 3/ 14/ 2019, but thought it wise for me to represented, since she was. I was surprised since this was a hearing and my first encounter with the law in my 64yrs. I have not been able to obtain representation to date and the next appt. is April 4th, 2019. Am I able to request an extension due to the fact I could not get help with over 25-30 different sources? Any suggestions, I have called all of the main sources; Legal Aid Services, Dade County Bar, Florida Legal Services, Legal Aid Society, and Legal Services Of Miami just to name a few. last time I checked "probable cause" as a standard is judged by "facts that lead a reasonable and cautious person to believe". The problem I find with this is that the key words in that are "reasonable and cautious person". Hence, cautious to me would seem to indicate that I should have some evidence other than testimony to prove that the wife was struck in the first place- otherwise, the lack of evidence tends to suggest that the police shouldn't rely on the wife's testimony because it is highly suspect to be a lie within the view of common sense. Therefore, I'd go as far as to say that an arrest in this case would end up under the heading of false arrest.

Unfortunately "he said she said" cases get filed on all the time. But it is usually up to the court, prosecutor, and quality of defense attorney to determine whether or not a conviction is attainable.

All about the totality of the circumstances. Did the woman pop him in the face and he immediately popped her back in self-defense. Did she pop him.. he walk away into a different room, think about what she did, get pissed off and go back and smack her across the face in revenge? It's all about who was the dominant aggressor and how did the incident go down? There are a lot of variables to think about for such a broad question. If she did hit the man.. Why did she? Was she defending herself because he was being abusive? Was she the one being abusive? A lot of variables.

So what if they arrested you more then 36 hrs after incident and at another place and you hadn't returned in that time to your residence and they arrested you under probable cause for misdemeanor domestic act on a Friday night at 10:30pm and held you til Monday after you saw a judge, however they never gave you a chance to give your side of the story before your placed under arrest, and she used her 14 year old son via text messages and manipulation of his emotions knowing he's seen his mother actually having gotten abused in the past as a means to not report or call the cops herself to file report but knew the school would have to as mandated reporters but she has ommitted the facts that she had ripped my cell phone out of my hands and threw it outside she never told cops that nor her son but cop didn't actually come til over 24 hrs later to investigate, then simply based on her sole statement and a couple of pics where she literally circled a couple bruises and at time of arrest was told that there also was video too, however during discovery court date the video didn't exist, but yet I got forced out of my house, and she lied and won an OFP as well because judge said the text messages I had to prove her a liar wasn't required and refused me the ability to submit for evidence. Is this a violation of my 4th and 14th amendments for locking me up when all they had to do was issues me a summons to court and inform me of a NCO to stay away from my house as I would have agreed. Also during the arrest I had relapsed and had a pipe on my person, but I also want to know why cops can lie when asked directly what evidence there was to validate probable cause for arresting me as they'd found me the next town over without aggression nor any intent on going home for awhile. So not only was I locked up, then forced into supervised visits which she suggested they took away my custodial parental rights and granted her sole custody with the OFP as well as the house and car and everything else and I still had to pay all the bills minus the $700 she paid every month mind you I was paying around $2600 on top of her $700. All because I refused to give her the house when she texted me the night after the fight and said she was done so I said I'd look into a real estate agent to sell the house then 2-4 hrs later I was arrested

Unfortunately, its whatever the State Statutes say. More often than not, domestic violence will always be prosecuted.. Your best bet is to give a sob story to the judge and hope you pull on some strings.. At the very least, the judge can order a batterers intervention course.. maybe DA supervision and other such things to avoid jail time.

We were arguing and someone called the cops on us. When they got to my house my daughter let them in. And we were asleep in bed. My question is will i go to jail for something that i didn't do and will this situation make me guilty . the DA picked up the charges and is the ones pursuing the case not my spouse. My son is 12 year old . i am worried .
