Hello my friend I have a whole plegic may help us or you may guide us to the right direction my wife was on medication for three months and she was not feeling well at the end and we went to a check up she was subscribed to a different medication and the doctor said do not continue the old medication in the pit of three days we were waiting on a new medication she did not take because we were waiting on the new medication and then she was not feeling well we went to the doctor again checking in right away they took her away for the 72 hour baker act and now we don’t know how to get my beautiful wife out of there

I have a brother that needs help from the state but the state keeps releasing him, he's mentally disturbed and suicidal but authorities do nothing. I'm afraid the next time won't be a failed attempt.

Thank you for sharing this, I’m very sorry to hear about your brother. However, you cannot rely on the state to take care of him. If you do, I fear that the results you will get will not improve his quality of life. She has no criminal record the took her from her school and a police officer made the determination that she needed to be baker acted.

The Baker Act is a statute that allows the State of Florida to take custody when you present as an immediate danger to yourself or someone else due to a mental illness.

I'm slightly confused,the Baker act was proposed in 1971 and enacted in 1972,,,,, Why all the fuss at this late date,and I'm guessing this was well into being when you became a lawyer.

Got you,I'm not for it that's for sure.I remember this kind of thing happened yrs ago in Massachusetts,friend of family had his wife committed to a psychological facility in Gardner MA, She was there a while and received electric shock therapy,finally got released but left her with permanent emotional scars,sometime in the 1970's that practice of a family member or some official without qualified medical training being able to commit someone. Sounds almost like a twisted version "Red flag law".Good luck on this legal endeavor.

They should not be allowed. Granted most times then others you realize hey this was helpful and ok. But then again. It's total BS. Alabama has a" petition " and you have to have evidence and signatures. Stating why this is occurring and why and basically the petitioners is your team. Backer act , is total BS. ANYONE WHO KNOWS YOUR NAME AND OR ADDRESS OR LAST NAME CAN HAVE YOU BAKER ACTED. TOTAL BS.

Your point is well taken and thankyou for sharing. We advise people that it only takes two things to get you Baker Acted, a finger and someone to point it. Getting into court as fast as possible is the best defense against the state taking custody of somebody.

The Baker Act is over when you’re free. The examination period is merely words in a statue.

@@astorsimovitchlaw the baker act was expired and i no longer met the criteria for an extension and was discharged i’m reading as many statutes that relate to involuntary holds and examinations and if an observation counts as a commitment so typically when someone os released would they meet the requirements to need a petition of rights back?
