Yeah I like how human he is. People always perceive lawyers as some stuck up robots that just care about money but the documentary really showed how they’re just as human as anyone else. Plus I like how he talks with his hands so much lol you can really tell he’s from NY.

@@bigoshify it’s funny you say that because he hates how he was portrayed in the HBO series. He mentioned how he would never meet with a potential client at a diner while shoving food in his mouth. Plus he mentioned he hates pastrami. Thinking about it after hearing him talk about that scene it was obvious how prejudice it was. A Jewish lawyer from New York eating a pastrami sandwich while first meeting his client who was involved in a serious crime with a charge of first degree murder. Like c’mon lol

This was such a great interview/podcast. This man David Rudolf is an amazing Lawyer and an even better human he understand the system and what he has been up against for many many years. He knows its all about power and what they want not whats right or truth and thats very sad because its the entire justice system we rely on throughout this country.

Personally, I think that most people who plead not guilty, are in fact, not guilty. I also think that lots of people who plead guilty are in fact not guilty, they are simply bullied into pleading guilty, because it is sold to the defendant as the better option, and due to a lack of education they aren't in the position to argue. I went to court when I was not guilty of something, and my Barrister said "if you plead guilty you'll get 6 months in prison, but if you plead not guilty and you are found guilty, you'll get 2 years in prison." I huffed back "AND, if I plead not guilty and I'm found not guilty I can go home!" He then bullied me for a while trying to convince me to plead guilty. Then he brought up the strength of the witnesses, CCTV and fingerprints. BUT, CLEARLY, there was NO CCTV, WITNESSES, OR FINGERPRINTS, as the police were lying and I didn't do anything! I then started to get incredibly upset as MY BARRISTER almost made me believe I had done something wrong, which I hadn't. So, I called the cavalry (mum & dad), who both said to me "the pr1ck just wants an early lunch, under NO CIRCUMSTANCES plead guilty!" I didn't and I won, but had I listened to my Barristers advice, I would have been sent to prison for 6 months! Beyond reasonable doubt, kids. Remember that. The Judge/Jury/Magistrates have to believe you are guilty BEYOND. REASONABLE. DOUBT. 👍

@ADF Audio I totally agree, but having lived through the experience I completely understand why an innocent person would choose to plead guilty, especially if they were uneducated - around 60% of people in prison can't read 😞 The Judge was absolutely lovely though, as I've got mental health problems, so she put lots of safeguarding things in place so I could have breaks whenever I wanted and the prosecution weren't allowed to be aggressive with me or upset me in any way ☺️

I have a very similar story in the US. Only my deal was to take 6 months in jail by pleading guilty or go to trial and possibly get 12+ years. My Public Defender urged me to take the deal because he claimed that they had CCTV, fingerprints, DNA, and a witness. The law in the US says that the prosecutors have to share their evidence with the defense. Once they finally did it showed that my DNA and fingerprints excluded me from being the perpetrator but they wanted to charge me with it anyway. I consider myself pretty intelligent (and also humble, others tell me that I'm very smart) and figured that if they were offering a 6 month plea deal on a possible 12 year conviction, they didn't have diddly squat and were just trying to scare me into taking the deal. It almost worked. I was terrified but my mom urged me to fight it. To me, and a lot of people in the justice system, it is terrifying to put years of your life into the hands of a bunch of strangers and most people take the deal. The county I was being tried in boasted a conviction rate of 95%. What they fail to mention is that was mainly from plea deals. When they go to trial, they have a conviction rate of less than 20%. I played the odds in addition to knowing what "evidence" they had, and beat it. Immediately afterwards I moved out of the country and I'm currently living abroad. I don't want to be part of any system that works like that. "Land of the free" my a**. We have the largest prison population in the world because of the private prison industry that's contracts requires states to keep a minimum amount of people locked up or the state will be sued for breech of contract. It is a joke.

@@jima1135 oh my god! If I was facing a possible 12 year prison sentence I'd definitely plead not guilty...I'd be going bonkers, but I wouldn't plead guilty. Not a chance. It's such a stressful position to be in. The police annoyed me the most because they said that they had fingerprints (my fingerprints) right up until they were called to produce them at the trial, then they stated the fringerprints were "inconclusive," AKA they had f-all. The only thing that kept me going through the process was the thought that 60% of women in prison can't read, and 50% of women in prison have long term mental health problem, plus education/library engagement was 80%, so I thought I might be able to help the other prisoners while I was in there. I told my friend my 'prison plan,' as I had obsessively structured a week timetable of how I could personally help them all (mindfulness, meditation, art therapies, CBT, reading classes, Résumés, yoga/Pilates etc), and my friend laughed at me, then said "they'll kick you out of prison within a week." It was a tough time, as I'm sure you understand ✊✌️ What made me laugh though, was that before I met my Barrister, my solicitor advised me to plead guilty. I refused to do this, so I had to sign a disclaimer to state that I had ignored my solicitor's legal advice etc. As he was writing out the disclaimer, he said to me "whenever I write these letters, the defendant always wins." Then he chuckled to himself and said "It's like a magic letter." He must have then remembered I was a client, and quickly added "not that I'm always wrong." 😂 (I feel this confirms your 95%/20% Plea/Trial stat 🙏)

I was on a jury selection this week and I could tell one of the lawyers was trying to be charming and get people to laugh at little jokes and he succeeded in his little game. The grooming was very apparent to me. I had my own objections on why I believe I would not have served as the best juror for that particular case and I was dismissed but it was a very interesting experience.

+ThatDutchguy The problem is that in the US the (state) judges (and district attorneys) are elected/appointed, so some are corrupt. With a jury you get a random sample of people and all you need to do is convince one juror to hang a jury, but a guilty verdict has to be unanimous, ie: all 12.

ThatDutchguy Explain how it works perfectly fine. You give all your power to one guy who can be bought, biased or otherwise unfair. The jury is a pretty solid method and it really does generally work just fine. I think the only way to improve it is to maybe have multiple juries, one hand picked like normal and 2 randomly selected ones, at least one of them should be anonymous or in a separate room watching on TV and don’t get any interaction with any of them.

@@mcearl8073 It's not "one guy" (or woman) whom gets "al the power" m8, that alone is a severe mischaracterisation of our justice system. It's 3 judges, and an independent professional judge untop of that whom will have nothing to do with either the trial or the people involved, that will follow procedures to make sure it follows the law and avoid any and all miscarriages of justice regardless of which side is guilty of that, to serve the people's interest in making sure the law is followed by all. That person is also backed up by an organisation that provides legal advice to both sides and is made up out of independent law professors and former experienced lawyers aka professionals. Than you've got the prosecution, one main prosecutor or crown prosecutor (acting in the name of the King and the state), flanked by deputy prosecutor's 2 or sometimes 3, they too serve the people. They represent the crown and state aka people, not as a bunch of laymen or women, but actual professional experts. A lawyer or team of lawyers can draw on the power of oversight of the independent judge and their advisers at any stage, they can even have a judge or prosecutor removed from the case if warranted via this system. Jury systems have time and time again proven to be biased and fully unchecked AF. Can't have laymen and women involved into serious business like that, it doesn't work, hence the many miscarriages of justice under the jury system's.

Dear Russell, I am a History Graduate and addict who had been on a Subutex script' for 6 years. I am finding it extremely difficult to get off it, and the absolute purgatory is making me so miserable. I am now in my 40's and desperately want to turn things 'round but I find it exctremely (irrationally) scary to attend NA. Hey, I'm not Russell, but I thought I'd reply. It's not irrational to be scared of going to NA, it's completely rational. It's a new situation, with new people, and you don't know what will be asked of you, or what you're signing up for, alongside this you're trying to give up a crutch and walk again (metaphorically speaking) by yourself. It's a lot to take in, and a lot to consider, so it's completely rational and understandable that you would be scared...I imagine everyone is scared at the beginning. Although you may not believe it, you're doing really well right now, as you're currently considering the option of NA, which is an incredibly positive step forward. Just take things one day at a time. Everything will be OK 🙏

In Australia we sometimes have 13 jury members and if one is sick or misses any court hearings there are still 12 jurors so the trial doesn't have to be held up. If by the end of the trial all 13 are still there one juror is eliminated by drawing a name out of a hat before deliberation.

There was a ton of evidence, it just wasn't in the Staircase. For one thing, Kathleen had red neurons in her brain, meaning she did not die between the first and second 911 call as Peterson tried to portray (to establish a fake time of death) - she lived for hours before she bled to death. This will sound naive to some, but besides all of the obvious signs of this dudes guilt, the clincher for me, is, that why, if someone is truly innocent, would they not take the stand? I would be dying to get up there and defend myself! There is also the whole intuitive facet that if one were to speak for oneself---just tell the truth---that is more powerful than any million dollar lawyer. It occured to me that if one is a liar, one could not risk being exposed by the prosecution. AND if one is truly innocent, why would one not mention the fact that a similar situation occured some 17 years earlier? Hell, I'd be telling people something like, "My God, this same thing happened back when I lived in Germany. How is this even possible that I was involved in two very bizarre and extremely similar incidents?" In the doc. it appears that the Germany "Staircase" incident came out from a source other than Mr. Peterson. If this is not the case, I apologize.

I listened to the whole podcast and would just say making laws with the knowledge that one size fits 330,000,000 is plainly insane, not to mention cruel. I think society in the US would benefit from some kind of separation based on what people think is the best way to organize society. The left, the right, and the libertarian/anarchist....lets split into 3 entities and see which society pans out in about 20 years. However, this kind of sane, responsible agreement of sorts will never be enacted by government....they love the power they have and think quite highly of themselves.

I sure don't know about being in any other culture but the police and consequently, the court, have me pegged as someone who I am not but it is offered as its own evidence and so any time they need a suspect then I am qualified.

David Rudolf millions off of Michael Peterson- until he was broke. And then backed away as defence, except for a very thin advisory role(remember, he legal fees stopped). Instead Michael Peterson had to get public defence. That tells you ALL you need to know about David Rudolf He's greedy. He wily. He's mercenary. (The producers didn't even edit this bit of ugliness out of the series, which i find pretty honest) Michael Peterson became indigent. David Rudolf became rich(er).

This lawyer is too much in his own head. If Rudolf thinks he's picking the perfect jury by asking questions and watching for the wimpy guy in the corner, he is sadly mistaken. Perhaps he's not as good at judging jurors as he thinks. Otherwise he would not have been handed a guilty verdict in the Peterson case.

Evidence? it's funny that always dumb people assume things based on their intuition. Have you seen a comment who says (He did nothing!! he is 100% inncoent) ?
