EB1(c) One-in-Three Rule: One of the requirements for qualifying for an EB1(c) position is that the individual must have worked as a manager or executive for a company related to the U.S. petitioning employer for at least one year within the past three years (referred to as the one-in-three rule). If, however, the foreign national enters the United States to work in nonimmigrant status for the petitioning employer or a related entity, the one-in-three requirement is tolled to look at the three-year period before the date of admission. In other words, rather than looking at the three-year period immediately prior to the filing of the petition, the USCIS will examine the three years prior to entering to work for the U.S. entity. This provides more flexibility to the employer and the foreign national worker in the timing of filing EB1(c) petitions.

Hi Sel, Thanks for your video. I got my EB1A approved. I applied for my adjustment of status. I saw your video and you said you got your green card when you travelled to Britain. How did you enter back to United status like on L1 status or with green card. Thanks Dr.D

That is great news, hopefully not too long to go now. With an L1A, you can travel whilst you wait for your AOS. My green card was issued and posted to my US address whilst I was travelling in the UK. I used my L1A, to get back into the US.

Thank you for sharing this, was very helpful to understand stepwise guide. I am in the same process too and I want to know would it be okay if the manager is leading the same team in the foreign country that he was leading back in the USA? Will USCIS raise any concerns such as while moving back to the USA, the team should be different than the one that he was leading being in the USA?

Good question. I am not 100% sure on this and would say to check with your attorney. What I can say is, that I do know people that have moved here on an L1A that were managing the same team from the foreign country first. And then moved to the US to manage, the same team. They still managed to get their L1A transfer.

It took 10 months from submitting my paperwork to go from L1A - EB1C. Ant, took longer for his L2, as he needed to wait for an interview. His took 1 year and 9 months.

We are in a similar process. Came on an L1a visa. Biometrics in march 2022. Since then nothing has moved forward. Still waiting, still checking.

@@marwankarnib3841 it can be submitted even in the first month you moved to US, but the constraint here is that it’s up to the company to submit as only employer can sponsor your green card, not yourself. So it will completely depend on arrangements you make with your company. Ours will be submitted only after visa extension, not too soon.

Did you hear anything in between filing (December) and approval of I-140 in May please? Were there any status changes or just riding blind for 5 months please? I’m also UK - US, L1A to EB1C, filing tomorrow (my evidence gathering took a lot lot longer)

Thanks for watching and following. My company uses a law firm in San Francisco. You will need to use with ever immigration attorney your company uses. It is recommended to use the same attorney that filed your L1A, that way they have all your information already.

Good question. Assuming you are the main applicant, you will need to inform USCIS right away of your marriage and name change. If that happens your immigration attorney will help with this.

Happy to share. Not sure I understood the question. We were living the in the USA on an L1A whilst we applied for the GC. They recommend not travelling whilst applying but you can travel outside the US with an L1A. I travelled a couple of times.

@@ANTSEL Thanks for your reply. I am a Canadian and My L1A visa is in process. My Emp is ready for supporting me on my GC journey. Due to some commitments I can't leave Canada right away. I was thinking if it's ok to apply GC without moving immediately, but move later sometime at the medical stage of GC process. But, I was not sure if it’s mandatory to be in US to apply for GC? Thanks.

Oh, thanks for the clarification as I was not sure. If you are doing the L1A to EB1C route, you need the L1A first. And normally (based on the advice I was given) you need to have been on the L1A for at least 6 months before applying for the EB1C. I have never known anyone that has done the L1A to EB1C route without moving to the USA on the L1A first. I would speak to your attorney to see if you can apply without moving. Typically for GC applications, it is not mandatory to be in the US. I am just not sure if you never move to the USA on the L1A, then apply for the EB1C, how that affects your chances of approval.

Thank you! The attorney we used only files for corporations. The EB1C must be sponsored by your employer, unfortunately you can not personally file for that type of GC without them. It is worth knowing why they won't sponsor you now, and whether they plan to in the future, as they will need to cover costs to renew your L1A. If they say they are not going to sponsor your GC, then it would be worth getting advice from an immigration attorney to see if you have another GC visa option you can go for.

Great video! If spouse enters with an L-2, can the L1-A apply for green card? In that case, will L-2 holder lose their status ? Slightly confused on how to go forward.

Thank you! The L2 is a dependent visa holder of the L1. So if the L1 gets a green card, the L2 will lose their status as an L2. So in Ant's case he entered the USA with his L2 visa. I also entered the USA (a week later than Ant) on my L1A visa. After I returned I had my GC approved. From that moment, I became a lawful permanent resident and that took over my L1A status, which means Ant no longer has an L2 status. Irrespective, when the L1 applies for the green card, they are also applying the green card for their dependents too.

Are you in the the US currently? On an L1A? If so, depending on the fees of the attorney used, it is in the region of $10k to file for an L1A to EB1C.

I come from India and do not have most of the vaccination proofs taken in my childhood. Is there any other way to determine that I've taken prescribed vaccinations?

Thank you! Fortunately for us, I obtained a paper copy of our medical records before we left the UK. We then gave that to the Physician when we had our Medicals. Somehow I was missing my mmr vaccine from my record. I was encouraged to get the vaccine again, so I would have proof. I decided not to and fortunately they did not make me get it. Some vaccines can be detected by tests and others not. If there is not a test they can do they will most likely make you get the vaccine.

Hi, I am now in US on L1A visa. Can i apply for a green card through a lawyer or should I go by the company lawyer. The reason is because the company said they will not sponsor before working 2 years with them. Can I do it with external lawyer?

Good question. I actually looked into this myself when I moved to the US and was not sure if the company would sponsor me right away. Because the EB1C has to be sponsored by your employer, you really need the company lawyer to do it. I did look into covering the costs myself and getting my own lawyer but was recommended not to do this, as the EB1C needs to be done by your company. I am not aware of anyone that has had their own attorney do it.

It is not a big deal if you do not have your vaccinations records. Some they can do blood tests to see and others they will make you have. I personally can not remember all the vaccinations but it is the typical ones of MMR, polio, tetanus. They will make you get the flu jab, if during flu season.

In theory You can start putting the paperwork together, but it’s not advised to file too soon. It is best to wait 6 months before filing the paperwork.

I am really not sure on that. I do not believe your EB1C application needs you to be on US payroll, as you could apply for an EB1C from your original country. I would check this with an immigration attorney. Are you on an L1A now and being paid from your base location? Not paid in the US?
