I have to say that I learned more from your video than I have from my attorney in 2 years in NY. I asked him if there was a formula for the 2 years of pain I've endured since falling down a flight on concrete stairs 2 years ago. I am a real estate broker and continued to work until I literally couldn't walk anymore. After 1 1/2 years of conservative therapy P/T, I Googled my symptoms and requested an EMG, i had nerve entrapment release, also known as tarsal tunnel release. Also, an orthopedic surgeon was going to tighten my ligament that was completely torn off, but "healed with scar tissue" He went in arthoscopically, but my ligament popped off. He replaced it with a cadaver (organ donor) Also, I had 2 back ablations and I am scheduled for shoulder surgery in 2 weeks to clean out the bone fragments, I chose this as an alternative to shoulder replacement. I am still in pain and not able to work. When I asked my attorney about lost earnings past and future, he told me he has worked with amputees and I should go back to work. Should I consider changing to a different attorney?

I am not sure what you're asking. My reply only applies to incidents in Florida or on a cruise. Different states have different laws. If you are asking if the injured person can send a demand (settlement) letter to the liable party 6 months after an accident, while they are still receiving treatment, the answer is Yes. However, the injured person should be very careful not to miss the time limit to sue, or he or she will forever lose his case. Additionally, it is often in the injured person's best interest to wait to settle until his or her medical treatment in finished. Thus, most often, in Florida the injured person sends demand (settlement) letter to the liable party after the injured person is finished with their medical treatment. I was in a accident last November I was in the passenger seat of the FedEx truck some guy was going 85 mph in a 40mph zone. And hit the back of the work truck I took most of the impact. I just finished physical therapy appointments a few days ago then in May some lady rear ended me. A few months ago my Doctor approved me to go back to work the job I was working for in November I called them and left voice mails and they did not bring me back to work without a notice or anything or a letter I just hope I get a nice settlement soon it's been a rough year.

While I appreciate kind words, I can't ethically say that I am the "best" attorney. That said, I do think that I am an excellent lawyer. BI (bodily injury) liability adjusters have a difficult profession. I often hear that BI adjusters are overloaded with claims. I do agree that some attorneys only share their best results. I tend to share many different results, including cases that settle for the $10K policy limits.

I'm in Michigan. We have Auto No-Fault. I've had 27 surgeries so far and have a catastrophic claim. I have been waiting for 10 years so far. No end in sight. Liberty Mutual is my insurance company. THEIR Dr.'s have 100% sided with me after thorough evaluations. I have met people waiting for 13 plus years with Liberty Mutual to pay a claim, this man is a paraplegic. In other words a couple years wait is blazingly fast compared to Liberty Mutual Insurance

just one other thing with high limits there is a rivk of making an early offer that may be rejected. so insurancr will make sure they have everything before offer.

Let me clarify what I think you are saying. Are you saying that if the liable party has bodily injury liability limits that are worth more than the case value, then the injured person should not make a settlement offer until the injured person is done treating? If that is what you're saying, then (in most scenarios) I agree with you. I think that you are also saying that if the injured person makes a premature demand, then he/she has now potentially set a ceiling on what the insurance company thinks he'll accept. Then, it can make it tougher to get the insurance company to then make an offer above the "ceiling". This is because the insurer may believe that the injured person "will" accept the ceiling offer. If my understanding is correct, then likewise (in most cases), I also tend to agree with your statement. However in all cases, the injured person should be sure to make a claim and sue within the time limit allowed by law. Missing the deadline to make a claim and sue will cause the injured person to forever lose his/her right to sue. Have a nice weekend.

Great video. Very informative. I hear a lot of these cases settling well over 100-200 thousand. My wife finally got her first offer after 18 months from Old Republic Insurance. 6K is what her lawyer said. She is beyond upset. The semi truck driver was at fault. He rear ended her at a red light totaling her car. She spent a year back and forth from physical therapy, doctors, chiropractic care. Finally all the doctors said she's over the healing, but she will always have these injuries now. Her lawyer said she'd be lucky to get 25K. I just don't understand how some lawyers fight their asses off, and some care more about their suit then their clients.

I think that every case that I've had that settled for well over 100-200 thousand dollars involved my injured client having surgery. I am just speaking for my own cases. Different attorneys have different experiences. Many truck insurers, given their insured's high policy limits, wait until the conclusion of the claimant's medical treatment to make a first offer. Thus, I've had trucking insurers wait many months to make their first offer. I can only comment on Florida personal injury cases. Each state has different laws. For example, in Florida the no-fault motor vehicle law cuts down the value of many soft tissue car accident cases because in some cases the claimant may need a permanent injury to be entitled to one penny or more for past or future pain and suffering. I'm sorry to hear that your wife is upset with the offer. While I don't condone the use of profanity, some lawyers do fight harder than others. This is true in any profession. There are professionals that work harder than others. Even if your wife's case is in Florida, I can't comment on the value of your wife's case because I don't know all of the particulars. I suggest that your wife have a sit down meeting with her lawyer and get him to explain why she'll be lucky to get 25k. One reassuring thing to note in most personal injury cases is that the attorney's fee is a percentage of the total settlement. Thus, an attorney makes more money only if the total settlement is higher. A higher settlement benefits the client as well because it increases the client's net settlement. We just have so many questions that has never been asked us, nor has he brought up any of the points that I've heard from your videos, but many more like them. I apologize for cursing, 19yrs as aircraft maintenance in the Air Force, sometimes I forget I'm not at work. Him getting paid a percentage of her settlement is one of the reasons we went with him, and he came highly recommended. After my case 14yrs ago getting T-Boned by a drunk driver who ran a red light. I waited just under two years, and walked away with only 6K, and a life time of chronic back, neck injury. I just fear she will be the same. I was hit by a car from the back while yielding for a red light. I’m a cancer patient as well. I went to physical therapy and they found 2 herniated disc from the accident. My oncologist said my back can’t be manipulated so l can’t received an epidural shot or surgery due to my current illness.( metastatic breast cancer to my sternum bone). So sort of recently we had gotten an email by the attorneys we went to saying that we should be getting an offer from the insurance company and they said that we should receive an offer the next week or hopefully sooner but when the time came, we hadn't gotten anything, and it has been 4 weeks since we got that email, so what does that usually mean?

I’d ask your lawyer. Maybe they’ve communicated with the adjuster and know the reason why you haven’t gotten an offer in 4 weeks (since your attorney told you that you’d be getting one). I’ve had insurance companies take a long time to give me an offer for many reasons. Sometimes the adjuster needs authority from his supervisor to make a certain offer. Other times the adjuster has too many cases too handle at once. There could be countless reasons for a delayed offer. My answer only applies to incidents in Florida, which is where I'm licensed. Unfortunately, insurance companies don't always do what is in the best interest of the insured. However, if they could and should settle, but they don't, then the insurer may be on the hook for an excess judgement and attorney's fees. I hope that you have a lawyer. If you have a lawyer, ask him or her why he/she thinks that the insurance company hasn't responded. Sometimes, insurance companies ignore me. Sherrod Henderson: Thank you for your comment. My reply only applies to accidents in Florida, which is where I'm licensed. In Florida, the insurance adjuster must disclose the insurance policy limits. Florida Statute 627.4137 This assumes that the claimant requests the disclosure in writing. Again, I'm talking about Florida's law. When I represent an accident victim, I request the amount of the policy limits in writing. Additionally, I request it under oath. Does the adjuster have to give you a statement under oath? In Florida, yes. Moreover, the adjuster may be more accurate with the policy limits if he or she tells you the policy limits under oath. When the insurance adjuster swears to the limits under oath, he or she is more likely to be truthful. I will share two of my real cases where the bodily injury liability (BIL) insurance company's disclosures were wrong. Basically, in both cases, the initial BIL disclosure failed to tell me about other available insurance. In the first case, USAA insured a driver who hit my client. She ran and red light and crashed into my client's car. My client broke her wrist. At the hospital, a doctor performed surgery on her wrist. I asked (in writing) USAA to give me its insurance disclosure under oath. USAA (under oath) told me that it insured the driver with $100,000 in bodily injury liability (BIL) insurance. USAA sent me a check for the $100,000 policy limits. However, my client's personal injury claim was worth $200,000. Thankfully. I didn't just rely on USAA's initial insurance disclosure. This is because it failed to tell me about an extra insurance coverage. I then requested that the at fault driver send me her tax returns, bank statements and other financial and insurance information. It was only then that USAA told revealed a new huge piece of information. Specifically, the driver (who it insured) was working at the time of the accident. It gets better: Old Dominion Insurance Company (Main Street America Group) insured that driver's employer with $1 million in liability insurance. Shortly thereafter, I settled my client's personal injury claim with Old Dominion for $100,000. That brought the entire settlement to $200,000. The best part? We settled without even having to sue. You can watch a video about that settlement here: kzbin.info/www/bejne/mJ-unKytlKaNqNE Basically, only when I pressed the insurance company to give me more information did they provide me with information about an additional $1 million insurance policy. The result? We got an extra $100,000. Needless to say, my client was thrilled. We still keep in touch today. Several years later. Now let's move on to another cautionary tale about how insurance disclosures may not tell you about all available insurance. This example is from a real car accident case where my client was injured. Another driver crashed into his car. In that case, after my written request, the bodily injury liability (BIL) insurer sent me the insurance disclosure. Again, it was under oath. The insurance disclosure said that there was $25,000 in BIL insurance. The disclosure said that the insurance company wasn’t aware of any other available BIL insurance. And, you guessed it, they were wrong! Seven months later, the BIL insurer tells me that “further investigation” has revealed that the driver had his own policy with another insurer. I think that this was likely due to one of two reasons: 1. The car owner’s BIL insurance adjuster did a poor job asking the driver if he had his own car insurance policy; or 2. Or perhaps if the driver wasn't paying attention to the adjuster's questions about whether he had an insurance policy. Maybe he didn't understand the question. Alternatively, maybe the driver lied to the car owner’s BIL insurer when they asked him if he had his own car insurance policy. Who knows? Are adjusters always truthful about their insured’s policy limits? I tend to give adjusters the benefit of the doubt. In regards to telling you the policy limits, I think that most insurance adjusters are honest. However, like any profession, they are adjusters who are sloppier than others. In (hopefully) rare cases, even under oath, some adjusters may lie. Why do I say this? Other attorneys have told me that adjusters have lied about the policy limits or failed to disclose other available insurance. Specifically, attorneys (who I know of) have claimed that this may happen more frequently with rental car adjusters. Sherri’s Henderson: Hopefully, the doctor has written detailed medical notes that say (if true) that the car crash caused the injury. Also, if the doctor believes the injury to be permanent, then he or she should specifically say that in the report. The doctor’s report should also say what the cost of future treatment will be. It should state any future medical problems that are likely to occur. The doctor should provide the injured person’s attorney with a detailed medical bill. The injury lawyer should send the medical bill and report to the responsible parties’ claim adjuster. Note: There is a time limit to sue. Always speak with a lawyer. Every case is different.

lore k: Great question. Ultimately, the adjuster is the one paying the claim so he/she is the one who makes the final offer. That said, many times adjusters have told me that they are giving me a "final" offer. Yet, they later end up paying much more to settle. In one case, I had an adjuster tell me that $150,000 was his final offer. Within 2 months or so, we settled for $197,500. The best part? We settled for $197,500 before a lawsuit. That kept my attorney's fees down, which put more money in my client's pocket. That is just one of my many settlement stories. On the other hand, I have had adjusters make an offer and not increase it. In the latter, I've sued to get more money. Or sometimes my client accepted the offer to be done with the claim process. I'm sorry to hear that you were in a vehicular accident. My answer assumes the accident happened in Florida, which is where I'm licensed. Many cases aren't ready for a settlement attempt until all of the medical treatment is completed, and the attorney has all of the relevant current and prior medical records and bills. From my experience, in Florida, which is where I practice, once the careless driver/owner's auto insurer has a reasonable amount of medical records/bills related to the accident, they may make an offer. If the attorney gives the insurer a reasonable time limited settlement offer, this often triggers an offer from the insurance company. I don't know how much longer it will be before you can expect to receive an offer. I say this, in part, because I don't know: - your past claims history - how much damage there was to the vehicle(s) - your past medical history - if the other driver/owner has bodily injury liability insurance - and many, many other factors. I am sorry that your attorney doesn't answer your calls, and that you only get a call back from the case manager. I suggest that you tell the case manager how you feel. If you want to speak with the attorney, tell the case manager this. If she won't comply, email the attorney. You can also make an appointment to meet with the attorney in person. Crimson King: Thank you for asking that great question. The length of time that it takes to hear back from an adjuster between counter offers may depend on several factors. To keep it very basic, I’ll talk about three big factors here. They are: 1. The particular adjuster (and his or his negotiating style). 2. The particular insurance company. 3. The reasonableness of the injured person’s (or his/her attorney’s) offers to settle. In some claims, I’ve made (and the adjuster has countered with) several offers in one day. In other cases, it took an adjuster a week or couple of weeks to respond. I’ve even had some adjusters not respond for a whole month or so.Why do some adjusters take so long to respond to an offer to settle? Because some insurance companies give adjusters too many claims to efficiently handle at one time. Simply put: Adjusters are overworked. The injured person (or his/her attorney) should give the adjuster every piece of supporting documentation. (Hopefully, you understand why you should quickly give the adjuster your medical records and bills.) I’ve also found that with some insurance companies, it is tougher to get in contact with the adjuster. Take, for example, Philadelphia Insurance Company. I had a misstep and fall claim with Philadelphia Insurance. In that claim, the adjuster took a week or more to respond to my settlement offer(s). And that was with my office consistently (and quickly) reaching out to Philadelphia after each counter offer that we made. Cruise lines are notoriously slow at responding to offers. You often have to sue them (in an injury claim) to get an offer. Also, in some cases, making follow up offers to settle that are too high may cause the adjuster to delay making a counter offer. Thus, the injured person must know the settlement value of his or her case. A great way to know the value if to hire an injury attorney with 15 (or more years) of experience. Making a Demand That is Too High May Delay a Counter-Offer. I’ll use an actual example from one of my cases. Please keep in mind that it is always the client’s decision in deciding the settlement offer to make. Of course, the attorney should tell the client about the estimated settlement value of the case. My client slipped and fell in a bathtub at a Marriott Hotel in Pensacola, Florida. She broke her arm (humerus). Then, she had surgery to fix it. My client was smart. She hired an attorney (me) shortly after doctors told her that her arm was broken. Travelers Insurance Company insured the hotel where she fell. Her personal injury claim was worth about $197,500. In just a couple of weeks, both myself (as the attorney for my client) and the adjuster made three or so offers back and forth. Here is where it left us: The insurance company’s offer was $100,000. My client’s offer to settle was for around $675,000. Again, at this time the adjuster had made around three offers. In fairness to the adjuster, his offer was closer to the actual settlement value of the claim than my client’s demand. Then, the adjuster began taking a long time to respond to our settle offers. I assume that he figured that the best use of his time wasn’t to try to settle this claim. Why do I assume this? Because our demand and his offer were so “far apart”. Remember: Adjusters may not want to spend their time trying to settle a claim if the counter-offers are too far apart after a few moves. The adjuster may want to focus other claims where the injured person is being more realistic with his demand. Of course, if the adjuster sees that the injured person is making reasonable decreases in her settlement offer it may trigger faster counter-offers. It gets worse: Making too high of a settlement offer can cause the adjuster to stall. A stall is when the adjuster refuses to make an increased offer even after the claimant has decreased her demand. In my bathtub slip and fall case, the adjuster told me that he was only authorized to offer $150,000. I didn’t believe him. In fact, believing the adjuster is one of the big 5 mistakes that victims make in an injury case. We eventually settled for $197,500. This case settled for an extra $47,500 because my client made a more reasonable counter-offer. I said earlier that her case was worth an amount around $197,500. The injured person needs to know the value of an injury case. Once we became realistic with our demand to settle, the insurance adjuster increased his offer above his prior "top offer". I submitted my counter offer about 3 weeks ago and haven't heard back from the adjuster. I suffered a broken leg, missed 3 months of work, and much more, so I'm obviously fighting for more than just my medical bills. Thanks again.

I still highly recommend that you hire a lawyer. That said, I think 3 weeks if plenty of time for an adjuster to respond to a counter-offer. In most cases with Philadelphia Insurance Company, so long as the injured person's medical treatment is completed, I would follow back up with the adjuster. Again, this assumes that the adjuster has all the supporting medical and wage documentation, and all other documents that support the claim. What insurance company insures the truck that hit you? Firstly, there is no guarantee that a personal injury case settles. However, assuming that the responsible party/parties is willing to settle, the time it takes to settle usually depends on several factors. The biggest factors are usually whether the at fault party (or responsible party): 1. Admits fault (or believes that a jury/judge would likely find it at fault). 2. Has all of the injured person's medical records, bills, lien amounts and other documentation of the injury. 3. Believes that the accident caused or aggravated the claimed injury. In Florida, we are capped at the percentage of the settlement that we can charge. Sounds like he was not up front with you and you should report him to some agency and /or even consider finding a good attorney to sue that attorney if you really had no papers from him or consult about amount to settle for...and you may get more of what you deserved if should have more. Jared Kennedy Thank you for your comment. Firstly, I don’t believe that my settlements are low. In fact, my first settlement that I talk about in this video was for $445K. Do you consider that low? Moreover, in each settlement in this video, my client was compensated for pain and suffering. Many comments on my videos say that my clients received too much money for a small injury. In other words, people have different opinions about whether settlements are low or high.
