You seem unclear on the role of the Senate in this process. The Senate is not responsible and doesn't have the ability to fill the role. The president nominates a person for the position, and the Senate confirms or denies that nomination. Biden has simply refused to accept the Senate's rejection of this nominee, made her "acting" secretary, and hasn't nominated anyone else.

If what a union does is required for the average worker to have better employment why doesn't that acting secretary just enact all the things a union would do at the federal level so unions won't be needed? If she truly believed the rules a union will make for its members are required then why not enact those rules by law so unions would become obsolete? I think there is a financial incentive for the unions to remain in operation, a financial incentive for the union leadership and the politicians that support them more than the vast, vast majority (94%) of private sector workers not members of a union. Why is it that there are more public sector workers who are members of a union than there are private sector workers?
