It's 100% legal for her to become president if it went that far because the 1947 law doesn't require Senate confirmation as Secretary of Labor cabinet position. All it requires is Senate confirmation. She was confirmed by the Senate to the deputy position. The 1947 law not 1974 like that idiot Katie britt kept saying, changed the verbiage from the 1886 law that would have required confirmation to the cabinet position.

Well the answer is yes. Under the 1947 law that Katie brick keeps saying is 1974, the requirement for being confirmed to the position of Secretary of Labor was removed. It used to be in The 1886 law, but now all it requires is Senate confirmation and she was confirmed by the Senate for the deputy secretary of Labor position. By law, she can become president
