I was told by a provincial court judge that the Charter was "more of a guideline than law". The court system is disgusting.

The fact that there is a notwithstanding clause likely discourages many from actually bringing a Charter challenge, apart from those that have nothing to lose like criminals charged with an offense.

I like the American constitution which clearly states "Let no law be written that would violate these rights" and those rights are clearly laid out in the bill of rights. We should adopt something similar.

Canadian Charter rights aren’t worth the paper its written on! The Police and courts still act with impunity and no Repercussions. You could have the strongest defence case, your lawyer makes the cops look stupid and incompetent, catches them both lie and contradict each other through cross examination, but guess what? If you get a judge who was a prosecutor before youll most likely lose the case anyways because of Politics! The judge doesn’t want to be known as going against the Police force who brings them cases (business) From my experience, ive learned that our judicial system is just another business out there with the goal to make money from you, same goes with Prisons, jails, rehabilitation centres. Dont think that bribery or extortion doesnt happen either because it is a common theme in all of it!

@@joannepatonai4114 your point being? Laws are meant to be justified by moral reason. Our country is really poopin the bed there, but change doesnt come from the bottom, it starts at the top and thats the a big issue. The government arent entirely the ones to blame either, because all of the lobbying that is paid for by the elites that bring policy’s into law. So there isnt a real solution but we know the problem and that is the greed of mankind as well as leaders thirst for power. Look at what’s happening all around the world, its falling pretty quickly into a totalitarian state.

I disagree with the prof. Who has the last word in Canada over the Supreme Court, the willingness of the people to take up arms and overthrow the court and government. The Americans stated in 1776 the right of the people to be free is a God given right, the right to overthrow tyrants is also a GOD given right , the ability to be armed to achieve that is also a God given right.

Checks and balances - that the Executive, Legislature and Judiciary are separate and equal is an American concept totally foreign to Canadian politics. In Canada the PM not only sits in the legislature but has exclusive power to appoint the judiciary = just like in any other dictatorship! The Canadian Constitution and Charter are a FARCE! Each are supposed to protect the INDIVIDUAL from the state but totally fails to do so as the Freedom Convoy exposed in astounding and brutal fashion! Canada didn't have political prisoners prior to Leach and others protesting violations of Rights and unconstitutional mandates. Canada has always been a dictatorship between elections but Treasonous Trudeau only exposed the truth of this in the last few years!

All legislation has only as much power as there is force being dedicated to carrying out its directives. Corrupt authority inherently selectively enforces the legislation that benefits in a manner that justifies its abuses. If such a law doesnt exist, they modify one or pass one to suit the need Direct result of abandoning the cornerstone of truth, for subjective perspectives and narratives.

The key word is in 59(1) """""""" shall """"' Until Quebec signs the Constitution the charter is nothing. Having said that Canada is ruled by Natural Law. End of story. The only Charter that exists in Canada is the "Hudson Bay Company Charter". You have to be an employee of this Charter to be ruled by it. There are no employees of the HBC Charter. The Charter of Canada or Constitution of 1982 is worthless.. The King and Queen of England answers to God therefore every resident in Canada answers to God hence the rule of law is Natural Law, This is not a bad thing. Every individual is equal before God. "Commencement of paragraph 23(1)(a) in respect of Quebec 59 (1) Paragraph 23(1)(a)"""""""""shall''''''''''''''''' come into force in respect of Quebec on a day to be fixed by proclamation issued by the Queen or the Governor General under the Great Seal of Canada. Marginal note:Authorization of Quebec (2) A proclamation under subsection (1) shall be issued only where authorized by the legislative assembly or government of Quebec.End note(110) Marginal note:Repeal of this section (3) This section may be repealed on the day paragraph 23(1)(a) comes into force in respect of Quebec and this Act amended and renumbered, consequentially upon the repeal of this section, by proclamation issued by the Queen or the Governor General under the Great Seal of Canada."
