Look at it this way, you got someone that made a game essentially taking a lot of inspiration from your game by taking the basic context but making creative decisions that make it a very well made and very well loved game. On the other hand you’ve been coughing out the same game for over 15 years. Like copy and paste not a single improvement, no the same buggy shitty game you just change a few Pokémon’s give them some new bs names and call it a day because you know braindeads will still buy it so why would you put in an effort and make something good. But now someone else did it for you, answered the prayers of your entire player base and finally gave them something they want and that they enjoy. And cheaper too, it’s a feeling they had forgotten in this modern video game era, long gone are the days you get to pay a reasonable price for a good game that has some heart out into it. So now if you sue it’s going to be very public and the millions that like that game are not going to like you for trying to shut down the one things they’ve been asking you for but you never provided. You see where I’m going with this. You’d stand to lose more by suing than by not suing. Honestly I used to love Pokémon as a kid until paying $60 for the same game reskinned got old pretty quick as I got older.

By having that assurance that you will be able to profit from your own work and no one else can steal that idea from you, you may be more likely to put in the work to create innovations. However, I believe that when it comes to game mechanics patenting instead stifles innovation. Most games remix different mechanics from other games in new and creative ways to create something truly unique. Just to give some examples, turn-based battles, double jumping, a sprint button, charged attacks, dodge rolls, dashes, tower defense, dropping items on death and needing to retrieve them, etc. are all game mechanics that are in COUNTLESS different games. Each one of them was first introduced in some game and very likely could have been patented, but they weren't. As a result, new videogames get to incorporate these mechanics and innovate on them freely. Nintendo is not the first to do something like this, nor will they be the last, but I believe it is an anti-competitive and anti-consumer practice that should be frowned upon.

Nintendo has known about Palword for 3 years. They're the most litigious company i know of. They both are centered in Japan so they wouldn't even have deal with international law. Japan DOES NOT have a fair use clause. Palworld is out, and the pokemon mod got DMCA'd before it even got released. American laws are weird for other countries because we require active litigation to maintain trademark and copyright, so you aren't allowed to tolerate any infringement... except for satire and parody, which is super protected here and not in Japan. Japanese companies meanwhile... well I can tell you Game Freak and Nintendo are aware people are drawing Misty doing nasty shit with Pikachu and selling it on the side, they just don't pursue it. In doujin circles there's a bit of a gentlemen's agreement to not need permission to make "fanwork" but to squash it if the holder ever says no. In the States ever since we loosened the fuck up we don't have to rely on Tijuana Bibles to see Goofy fucking Minnie Mouse, porn is de facto satire and parody thus inherently copyright. Lesson of the story: if you want to protect yourself from getting sued, give your pokemon big tiddies.

Seriously, Pokemon needs the competition. Game Freak has gone to crap, the Pokemon Fans are trapped in their comfort blankets and nothing will change unless someone can steal sales away from them. Palworld shows a true open world Pokemon game with decent quality can be possible, if they put forth the effort and didn't constrain themselves to a BS release schedule no one cares about.

They may have used Pokemon as inspiration, but that's fine. You're allowed to do that. @@willoweable You're missing the point of what I was saying though. My comment was about a kid drawing pictures versus using the likeness of existing properties for profit. I never said how much I agree or disagree. I don't play Palworld due to it having guns and encouraging "stealing" pals, the latter of which I've read elsewhere. There are too many games with guns. If Palworld had heart and soul like the Pokemon games, I would of given it a try. The only pals I know of are ones seen in images, whether advertisements or other sources like video thumbnails, none of which looked like Pokemon to me. It's hard to tell for the ones in this video.
