He is not talking about your house or your farm buddy. He is talking about jahgirdars. The socialist ideas that you hate also gave us many land reforms post independence. Without that we would ALL be living in a feudal system slogging on the farms of a feudal jahgirdar. Many people in rural India still survive this way. Sweating on a farm owned by someone else. Look at pakistan. The army rules them and picks out a random jahgirdar to become its PM/puppet. Their country is basically 30-40 jahgirdar families that profited due to partition and an army. Ruling over poor people with no employment and no food. Whether you like it or not, you need left leaning intellectuals to keep a check on such things.

It is sad that while we Indians are distracted by rhetorical politics, there are forces in our "democratic" government and political parties that want to seize our property and destroy our rights. It doesn't matter which party wins when ultimately we lose our rights yet again. We need to come together to stamp out socialism and government tyrrany, don't let the politicians distract you with emotional rhetoric. It took a lot of effort to undo the horrors of Socialism, but those horrors have been slowly coming back.

What Justice V R Krishnan Iyer's long winding orders used to do for lawyers, is what you just did to laymen like us, Shekar :D I might need to revisit this video several times (in addition to some independent study on this matter) but great job shedding light on this judgement. I've been conveniently avoiding this topic due to the very reasons you mentioned, but my habit of consuming hot chocolate along with your CTC video, forced me to look into it.. and I'm glad that I did.

As a person from that era, Shekhar ji, maybe you must talk about whom the amendments impacted the most - big zamindars or small farmers? This is an important lens to review the laws with. The law will have to apply to all, but who gets impacted reveals the intent of the government.

I am a Senior Advocate of standing and after hearing the analysis, I feel that it is an exceptionally good one. Krishna Iyer J was a Communist as he was a Cabinet member in a Communist government, on the Bench. Nehru was apparently a Democratic but was a closet autocrat. Even Russia got rid of Socialism.

Thanks for explaining the background of the issue in simple terms. I was hoping that the SC was more clear in its order defining what are the privately created & owned resources/assets & what are the privately run/administered licenced natural resources by private parties, like coal, minerals. Leaving it to the govt agencies to decide is dangerous. Like govt cannot take over a manufacturing facility set up by foreign company in India on India's invitation & encouragement.

The erstwhile Fundamental Right to Property (1950) was done away with Keshwanand Bharti Case (April 24, 1973) by 13 Judge SCI Bench and now it is our Legal Right. This 1973 SCI Landmark Judgement gave us the BASIC STRUCTURE of our Constitution. Yes, from this date, all acts in the Schedule 9 of our Constitution come under Judicial Review and can be challenged in the court of law.

Look at the process of elevation of VRK to SC ! Today such an appointment would have raised heckles across all the media and opposition ! VRK an MLA was a minister in a Communist Govt of EMS Namboodirabad ! Then later astonishingly he gets elevated to HC. Within 5 years he is further elevated to SC ! It is like today Sibal / Singhvi/ Chidambaram is elevated to SC directly ! Imagine the legal consequences and the havoc they would wreck on SC and the constitution! CJI rightly critical of his doctrine ! But instead of shutting the door on expropriation of Private property the Bench has left the door slightly ajar ! Sad that at a time Pappu is speaking about wealth distribution etc SC lacked the will to call a spade a spade!

This judgement is correct but also the dissenting note of Justice Nagratna. You cannot make a comment against judges for cases where things are not black and white. Socialism and everything related to that was prevalent at that times. So the comments by CJI is not correct in this respect only. However this judgement is correct in this case.

.Art 39(b) contemplates only pragmatic socialism, not any doctrinaire brand of it Art 19(1)(f) guaranteed fundamental right to property subject to reasonable restrictions in the interests of the general public and the protection of scheduled tribes. Reading Art 39(b) with Art 19(5) would have provided the answers. Ignoring Art 39(b) was the blunder. Not defining the right to property in the light of the Government of India Act, 1858 which was nothing more than a perpetual lease was the other blunder.

Contrary to public perception , right to property as enshrined in Art 19(f) was deleted by Shanthi Bhushan , law minister under Janata Govt headed by Morarji desai and Art 300A was instructed instead. If a fundamental Right can be removed and if it is not part of the Basic structure, then it is a mockery of the verbose Keshavananda Bharati Judgement.

We already have decent pollution laws, way better than what China. What we don't have are honest government employees who will implement it ruthlessly. Question is how do we staff government departments with honest employees?

To Sanghis in the comments ranting against Socialism, the BJP joined hands with the Communists back in the 90s when then Congress dismantled license Raj. the RSS advocated for the same protectionist policies that the Congress did back in the day. Now Sanghis pretend as if they introduced Capitalism into India.
