Most believe that once they create a living trust and fund it with their assets, they are done and have nothing more to do. For the most part, this is true. The “decedent” or person that passed away has nothing more to do after creating and funding the trust. However, following their death, the person they have appointed as “trustee” (or person in charge of the trust) must “administer” the trust.

What if the person designated to be Trustee, simply will not respond to our requests to take the Responsibility for being our Trustee? Our Trust says we can get someone else if they cease to act. How long should we give them to respond to our request to assume responsibility. Side note, the Designated Trustee isn't holding any of our deceased Parents Assets at this time either. The assets are still in our Parents name. The assets are supposed to be distributed to my sister and myself by the Trustee. Thanks.

I am Trustee for my late mother. My attorney is quit expensive, it appears I may have to finish things on my own. I only have her car(paid for), her home ( which has become my sisters home) without a conflict, taxes and a portfolio to cash out. Portfolio is almost done! Have not transferred car ownership but I’m sure DMV can help me here. Just need to get thru tax season. Can I handle these last things as I cannot continue to pay attorney?

What happens if the beneficiaries are not notified when condition calls for trust payment upon last spousal death and beneficiaries have no copy of trust agreement or who wrote it? But was told a trust would be paid upon their deaths. How long does it take for corporate trustee to notify beneficiaries?

Hi, I realize that this is just information only and it is helpful. If I may ask, as a trustee myself, what on or where on a living trust dose it say whether or not it is funded? I understand if you are reluctant to answer. Thx.

I am the Trustee of a smallish Rev. LVG Trust. All is in financial instruments. No property. No will. I don't know of any reason I would need an Atty. Is there one? Thanks.

as a beneficiary of a share of a trust it says "trustee shall pay the entire net income in monthly or convenient installments agreed upon by me and trustee.." but for principle it says ""trustee shall promptly pay the entire principle outright and free of trust" does this mean that the whole share will have to be paid as soon as possible and if so why would there be any mention of monthly payments for net income if the whole principle was paid? if the whole principle was paid to me how could there be any net income that would paid monthly? it doesn't make sense to me.

Look at a beneficiary deed which gives the kids the house. Just an idea. I did that for my kids. Costs $80.

Does the husband of another beneficiary have any business selling an inherited house? He's also a douchebag I don't want mucking around in my share of the estate. My brother who is trustee was previously listing himself as the seller, now iits my stupid brother in law. I want a realtor to handle it. I DO NOT TRUST THEM!

Dodgy business, Trusts, in my experience. All this secrecy and legal entanglements. Money 'for the boys'. Too much secrecy around beneficiaries opens up to theft and corruption by Trustees. Lady presenting seems lovley but my experience with professional executors has been harrowing.
