I had this issue when my leaves outside UK were not only annual leaves only, but also unpaid and sick, but I got it approved. As all these leaves, though sick leave or unpaid or day offs, are all authorized leaves from the department.

Your first COS may have validity for 3years usually,then need to extend the COS,some hospitals give 3more years or else 2years. If you have COS extended for 3more years ,you have enough time to apply for ILR after being in the UK for 5years. But ,if you have COs ,which is extended only for 2years ,then you try to apply for ILR do it as early as you can . You can apply 28days in advance from the date you arrive in the UK. Regarding DBS ,you should have it,if you are working for any firm.please enquire with your HR department

I used the DBS in 2023,which is issued in 2021. The recent COS which I used to extend the visa after 3years of initial contract. The PCC ,is the old one ,which you have used for the initial visa purpose.

Hello...Thankyou so much for this. It's been really helpful. I have few doubts - First for the proof of address, can we keep tenancy agreement or bank statement? Secondly, I am applying this while I am in maternity. There is this question that my sponsor need to provide information regarding when I have started my maternity and what is my salary before maternity leave and what is my salary after maternity leave. Do I need to provide this? I got the employment letter from my HR in which they have already mentioned that I am currently in my maternity leave. So should I tell them to mention my start date and salary details in the same letter?

Hi, Thank you for the comment. Firstly, tenancy agreement or bank statement,you can submit any document which shows your current address and your full name .I have submitted my council tax which has my full name. For the second doubt,please kindly request the HR to add a few line notifying that you are going to continue the employment with the hospital afyer the maternity leave and the salary will be same. It can also be mentioned by your Matron or ward manager in the Annual leave letter ,which has a confirmation of the employment ,annual leave and mat leave .I think it is better if HR can add this information in the Employment letter,if not you can request you Matron or ward manager to add those information This is my opinion. In my case, I have arrived in UK on 13/01/2019. So only by next year Jan 13th, it will be 5 years for me. But we can apply 28 working days prior. So what should I write in that case?

One more thing along with the same question - am I eligible to apply now for my ILR? As I came to UK on 13th Jan, 2019 and my current BRP is up to 10th Feb. As it says you can apply 28 days before the qualifying period, I just want to whether I can apply now for my ILR or not?

Hi, I have enquired with one of my friends regarding your previous doubt.she submitted her ILR during maternity leave. She submitted the Letter from HR and Annual leave letter as they have given and she had not add any special information regarding the joining date and the salary after maternity leave. She has submitted her Mat B1form and payslips before maternity and current payslips. She has not submitted any extra documents for the proof of joing back after mat leave. For you recent doubt ,you can apply for ILR any date within 28days before your arrival date to the uk,because we need to submit our initial visa page which shows the arrival date to the UK and we need to live in the UK for a continous five year period in order to apply for ILR and you should make sure you have not exceeded 180 days away from the UK during your holidays or travel to any ither country. If you have exceeded more than 180 days, you need to submit the relevant reason for it. Thanks

Hi Maria, I think the annual leave letter confirms that the employee have been to another country during the employment period and those leaves were authorised and paid one.I think it is necessary to submit even if it is less than 2weeks or more than that. When I submitted the application,I received a checklist at the end,in that under the heading ‘other documents’-letter from employee was a requirement to submit.

These must be dated no earlier than calendar month before the date of the application. The statement must show the payment, as shown c the payslip. You should not provide any additional payslips or statements, unless you are currently on maternity, paternity, shared parental or adoption leave. If you are currently on maternity, paternity, shared parental or adoption leave, you should provide the payslip and bank or building society statement you received prior to the start of your leave. The staten must show the payment, as shown on the payslip. You must also provide payslips and bank or building society statements during the period of maternity, paternity, shared parental or adoption leave. The la: payslip and statement must be dated no earlier than one calendar month before the date of the aoolcation. A document from the sponsor who issued the certificate of sponsorship that led to your last permissio stay as a Tier 2 migrant confirming that you are: • still required for the employment in question for the foreseeable future, and in the case of Tier (General), Tier 2 (Sports Person) and Tier 2 (Intra Company Transfer) migrants this document should also contain: • the nearest applicable SOC code which best describes your employment • your current rate of pay (this should be given in the same format as given in the codes of practi for example hourly rate or yearly salary), and • confirmation that this is at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors. Hi Maria,if they didn’t ask you to submit ,it will be fine,but most of the people submitted this Annual leave letter. You haven’t been to any other country more than 2 weeks,that may be the reason that they have not asked you. But in my opinion, if you submit Annual leave letter (if it is easily available from your manager),it is good ,it will not affect the application in any ways,because most of the people submitted that.

I received my ILR. Thanks for your explanation. There are just a few corrections needed in the documents I need to submit. They haven’t asked me for a PCC or DBS. Submit only the documents they have requested.

You have to submit the same documents mentioned ,especially your Employment letter ,Annual leave letter and so on ,which I have mentioned in the video.I suggest you to submit COS as well. I don’t think that there is any difference in your application as you are coming under health and care visa . But please kindly enquire with your colleagues or friends as well before you submit the application. I have applied under skilled worker visa ,so I am not quite sure about carer visa.
