Hello Mr. Subhan, let me start by telling you we've enjoy your video. We are from Canada. We've sold our house. Our closing date is May 2022. The plan is to use $100,000 to purchase a convenience store in Houston, Texas. 1. Do we wait until we have the funds to start the E-2 Visa application? 2. Are we able to purchase a house instead of renting one? 3. Is our daughter (19 yrs old) able to study at any university in Texas as resident student? 4. In regards to medical plans, does one purchase as a resident or tourist?

E-2 visa holders can purchase a house in the U.S. 3. Your daughter can qualify as an E-2 dependent and study at any U.S. college or university that she is eligible. She may qualify for in-state residency tuition rates in TX as an international student after 12 months. Speak with the college or university that she is interested in attending for more info. 4. There are medical insurance plans available. You need to speak with an insurance provider. You can own a business in the USA, but you cannot work for the business in the USA, unless you have work authorization or a business visa. Thank you for sharing these valuable information. I'd really appreciate if you could clarify the following queries: 1. How can someone set up a LLC ,obtain an EIN and open up a bank account visiting the US physically? 2. Is it necessary for the principal applicant to prior business experience? 3. After transferring the funds is it required to spend them on business activities before even applying for E2? 4. What if after spending a fund on any business the applicant doesn't get a visa? 5. Is it possible to invest on a current business run by the applicants siblings? 6. Is it true changing status will give a 2 year visa and going thru a visa process may allow 5 years from countries such as Bangladesh?

Thank you. Glad you found the video helpful. 1. Contact us and we'd be glad to help you form a U.S. LLC and walk you through the steps. 2. No. 3. It depends. You can use an E-2 escrow agreement in some cases and then have the purchase of the business or asset contingent on the E2 being approved. In other cases, yes, you most invest/spend the funds prior to E2 approval. 4. There are ways to mitigate loss of investment. Contact us for more details. 5. It is possible. However, an E-2 visa requires at least 50% ownership by the E-2 investor and such application would be scrutinized to ensure the E2 criteria is met. 6. Changing status is done while someone is in the 🇺🇸 under a certain status. Changing status does lead to an E2 visa, but rather E2 status. Hi Mr. Subhan. I'm from Canada and I want to go through the process of the E2 acquisition. I have a question for you in 3 parts in the specific context regarding my situation cause I'm looking to open a new business as opposed to buying an existing or buying a franchise. You mentioned that once I put the investment at risk, I have to go through the application process at an embassy or consulate in my own country. Part 1) Do I have to physicaly be in Canada to start the application and stay there for the duration of the process? Part 2) If so, can the business be up and running generating sales as opposed to just sitting idle, while I'm in Canada and having fees, taxes, rent etc. eating away at the funds in the business account? (As we speak the application process in Canada has slowed down and they've announced that the process can potentially take up to a year.) Part 3) What if after a year of processing the application, I don't get approved, have I lost all the funds that have been already spend? ( Is there another way to apply, in order to speed up the process instead of waiting for a year to have the embassy and consulate in Canada to process it?) Thank you in advance.

Hi Castro. Thanks for your questions. 1. You do not have to be physically present in Canada while the E-2 visa application is processing, but you may need to be present for an E-2 in-person interview at the Embassy in Toronto. Please note that you cannot work for your business from inside the U.S., if you do not have "work authorization." You can work from Canada. 2. After the capital contribution is made to the business account, then the funds can be used for operational and other business expenses and it can be generating revenue. 3. Possibly. If denied, the money invested in professional services, rent, and any taxes, would be forgone. However, money invested in equipment, inventory, etc. may be able to be recaptured upon sale of such goods. Lastly, we have helped clients expedite their E-2 visas in much less than a year. Also, generally we recommend that investors look for 3 things when considering investing in a franchise: (1) a track record of successful franchisees, (2) history of franchisees receiving a good rate of return on their investment, and (3) experienced principals and management team. It depends on the type of business. For example, if you are going to invest in a brick and mortar business with a physical location, then generally we recommend the state of operation. Hi Tony. Yes. A Canadian can own 50% of a real estate brokerage firm and may be eligible for an E-2 visa. However, please note that there are licensing requirements to own a "real estate brokerage." Thanks for your video. Let me ask a question. We want the E2 Visa as my wife's name, but she can't come to USA bcz of taking care of our children. In this case, can I (husband) make the contract of business & open the bank account instead of her in the USA? Otherwise, is there some other way?

The E2 investor forms a U.S. entity and must own at least 50% of the entity. Then the U.S. business will enter into a contract for purchase of a business, assets, etc. Your wife can sign a contract from within the USA or outside. Yes. Foreign nationals can start a hedge fund and management company in the USA. There are specific places in the U.S. that offer more advantages than others. You can start and manage the fund from overseas without a U.S. visa/status. Hi Vahid. Unfortunately, Iran does not have a treaty with the U.S. to allow for the E-2 visa. However, an Iranian citizen can obtain citizenship to another country that does have a treaty with the U.S. through a citizenship by investment program (CBI) and then apply for the E-2. We partner with a CBI program in Grenada in the Caribbean. It takes as little as 90 days to obtain Grenadian citizenship. If in the U.S. under a valid status, then you can apply for a change of status to E-2 status. If you depart the U.S. while under E-2 status, then you must apply for an E-2 visa at a U.S. Embassy/Consulate to return to the U.S. E-2 status is approved for up to 2 years. E-2 status is applied for within the U.S. and an E-2 visa is applied for outside the US. Hope this helps you.

Hi Fatih. It may be possible for you to file a change of status from H-2B to E-2 status. E-2 status allows you to remain in the USA for up to 2 years at a time. If you left the U.S. under E-2 status, then you would need to apply for an E-2 visa at a U.S. Embassy/Consulate. Therefore, you may be able to apply for an E-2 visa, but it would require that you leave the U.S. Lastly, please note that under an H-2B, you are only supposed to be working for the employer that sponsored you, not for your own business. Thus, working for your own business while in H-2B status may be an issue.

You cannot apply for an E-2 based on permanent residency in Canada. You must be a Canadian citizen or a citizen of another E-2 treaty country.

You have to start or purchase a franchise or existing business in the USA to apply for an E-2. You must invest a substantial amount of capital in the business. Hi Raghavendra. Great question. Unfortunately, being a day trader would not qualify. Generally, any type of business can qualify for an E-2 visa as long as it is not considered a "passive investment," which requires little to no day to day management. For this reason, some real estate and stock market investments may not qualify. Also, the business must be a "real, active commercial or entrepreneurial enterprise," which produces services or goods for profit. Being a sole entrepreneur that is day trading does not produce goods or services. If you ran a day trading school, then that may qualify. To apply for a change of status to E-2 status, you'd need to be in the U.S. in another legal status. Also, selling at a farmer's market or setting up a kiosk in the mall, may qualify for E-2, but it depends on your business model, your educational, professional, and technical background, the country your from, the amount of capital, and other factors. Great question Teddy. There are two main ways to mitigate loss of investment under an E2 application. If purchasing an existing business or franchise, you can use an E2 compliant escrow agreement that makes the sale of the business contingent on your E2 approval. However, this option may not be available if starting a new business. It is available to new businesses making asset purchases. Also, if starting a new business, you can have some of your investment invested in something that you may be able to sell regardless of the E2 visa decision. For example, an ecommerce business could invest in inventory that it can sell whether or not the visa is approved. Both of these options help to mitigate the risk associated with an E2. Hi Teddy. I definitely understand your concern of losing your investment or partial loss. Other clients have felt the same way. Please note that "asset purchases" such as CNC machines can be purchased through an E-2 compliant escrow agreement. Hello My husband and I are looking for information about E2 visa and how to apply. He is a British citizen and I am Venezuelan. We are thinking about our own trucking and logistics company. It is important however that we can base our operations in Florida because I am self employed doing cryptocurrency trading and as far as I know Florida is becoming crypto friendly. Hi Elsy. Your husband can start a trucking and logistics business based in Florida under an E-2 investor visa and you'd be able to immigrate as an E-2 dependent. Being a Venezuelan citizen does not impact your husband's E-2 application nor your E-2 dependent eligibility. E-2 dependent spouses qualify to apply for an employment authorization document (EAD). An EAD allows you to work anywhere that you are eligible including starting your own crypto trading business. To apply for an E-2 investor visa, the E-2 company must first be registerd through the U.S. Embassy in Turkey. Also, the E-2 investor can only work for the E-2 company. However, the E-2 company can own subsidiaries including overseas companies which may allow you to continue to transacting business from within the U.S. for your existing businesses. In addition, an E-2 dependent spouse can work for any company that he or she is eligible including overseas companies. Therefore, there may be a few solutions for you.
