Do you still need to talk about whether it is a term or representation with implied terms?

No you don’t, because an implied term is one that hasn’t been mentioned by either party to the contract. It’s being implied or construed as being in there for fairness, to make the contract work, or because an Act requires it. Term or representation is where there a word has actually been used by the parties, and the court is trying to decide whether it is part of the contract. Hope this makes sense!
