Very informative. I do have some questions. If several of my characters appear in a work and I copyright it, are they all covered? Also, can I trademark a team or do I have to trademark each character separately?

You copyright your story and trademark your characters. You can trademark the team, the team name and each character. They would all be separate and all have to be charged individually.If you only copyright your story and someone steals your character exactly name and all (Not a variation of it) You may have a chance in court. But if they vary the character even slightly and it is not trademarked you will have a tough time proving it is yours.

So you copyright your story for $65 and trademark your characters, book title, logo. (Much more expensive) On paper, Yes you would have to trademark every character individually, but most creators do not and they are usually fine. I would copyright the book when its done. Just make your pitch document as a written book and copyright it. It doesn't have to be circulated. It doesn't need a UPC, It doesn't have to be printed out, unless your mailing it to the copyright office instead of digitally filing. I tend to write "bible" documents on my projects before or early in its origination. Who the characters are, their history etc. It reads like a story lacking prose. Half of it will never be shared with the public, but it helps me in the world building of my story. I don't copyright it, but I could. Its usually 10 to 15 pages. Its an expressed idea in a tangible form. That's all you need.

You can copyright your story, but not a character. Yes, someone could put your character in a book and then try to trademark it. When it comes to characters, If you have well defined character created and used repeatedly, and someone takes it 100 percent name and all, you can still fight for your character in court. Trademarked with government or not. Having it trademarked makes that fight easier. Characters have to be well defined and being used to trademark it. Someone can't just see your book take out a page with the character on it and then trademark that. Trademarking is expensive. If you plan on making a long series of books with your character, make plans at some point to trademark the charcter. Don't stress over it Save 5 bucks a week until you have it, if need be.

Once something goes into the public domain, it is always supposed to be public domain. Unfortunately corporate greed has finagled all kinds of loop holes in the law. Check out the It's a Wonderful life public domain case. That will give you deeper insight.
