Hi good morning! Thank you so much for your videos. As always are so helpful!! I'm not sure which tax form should I fill out. All these 5 years I filled 8843 since I didn't work. During my OPT a tax preparer helped me. But now that I'm back to A school to finish with my B.A degree I'm not sure what tax form should I fill since I passed the 5 years of substantial presence and not working. Thank you so much!! Keep up the good content! Thanks to your info I've got to travel out of state on an expired visa 😄

If you were in the US in the last year, you still have to file a tax return even if you didn't earn any US income.

The appropriate tax return form for non-resident aliens is the 1040-NR, which is not available in TurboTax. To be compliant, you would need to file an amended tax return.

No you should not. You have to file a different form which is not available of TurboTax.

How different is 1040 NR from 1042S ? I received money from an international organization and was sent the 1042S, do i file both with sprintax along with the general form that all internal students with or without income should file?

Form 1040 NR is the main tax return form for non residents. 1042S is a supporting document showing the scholarships received, just like a W2 is a supporting document for employment wages received. So if you've received a 1042S you will need that when filing your tax returnz with Sprintax. As that'll be sent to the IRS along with the Form 8843.

Non-resident aliens (which includes F1 students who have been in the US for less than 5 years) do not qualify for the standard deduction. The only exception is if you're an F-1 student from India.

Hi, thanks for this video - Quick question that I hope you may be able to help with please: First time filing tax returns in the USA as I am a freshman from the United Kingdom on a F1 visa. I have a part time job on campus which I earn a few hundred dollars a month on which tax is taken at source plus I have my scholarship's which I have also paid tax on. I thought that I would receive all the tax back I paid when filing, but when filling in the information I only seem to be eligible for a small portion of a rebate. I have filed incorrectly do you think, or am I incorrect in my thinking I get 100% back and I still have to pay some tax on income earnt? Thanks in advance for your reply

Can't really speak on your exact circumstance. Depending on your total income (from US sources) you might be eligible to receive all the tax withheld. That's why I recommend you use tax filing professionals like Sprintax as they can help foreign nationals max out their tax refund.

Filing IS NOT required by nonresident alien students and scholars who have income ONLY from: Foreign sources; Interest Income from a: U.S. bank U.S. savings & loan institution U.S. credit union U.S. insurance company An investment that generates Portfolio Interest (Described in Chapter 3 "Exclusions From Gross Income" - "Interest Income" - "Portfolio interest" of Publication 519, U.S. Tax Guide for Aliens); A scholarship or fellowship grant that is entirely a Tax Free Scholarship or Fellowship Grant as described in Chapter 1 of Publication 970, Tax Benefits for Education; and/or Any other income that is nontaxable under the Internal Revenue Code. However, income that is not taxable because of an income tax treaty must be reported on a U.S. income tax return even though no income tax is due on the U.S. income tax return. Straight out from the IRS. If I fall under the not required category I don’t have to file, right?

I cant say, maybe you owed taxes to the Fed/State government and had to pay that back. It's not always the case that you receive money when you file your taxes. You only do if you've paid more money in taxes than you were supposed to.
