Posted a vacation video with a song on Facebook. Within 1 minute got a reply that the song had copyrights, and 197 countries would not hear the music. STUPID !!! It is a post not a sell point for $$$$$. I have a MPC and create music, so I used one of mine, but still I rather used my first selection.

"Bull" is when you can create something (like a song) that is easily recognizable in pop culture and appears all over the place, used to hustle ads or to popularize other people's content and you can't control it nor get any significant financial restitution. KZbin runs these filters not to benefit any music or artist, but to make sure they themselves can get maximum dollar for its usage..

I´m trying to do the same, Im learning how to sew for costume design, animate for cgi rendering, photoshop for videos, etcetc. I´m dedicated to get it done, but I'm poor ofc and idk how hard it will be to find people who will voluntarily work. I want to start making videos explaining various things - I get an idea for a video, I script it, and I enhance it... the enhancement involving quick cut-aways to a famous musical or movie or TV show, particularly a famous scene and a famous line or piece of a tune. I might even want to use a melody from a famous movie’s theme melody running at low volume in the background as I narrate my video... where’s the clearing house that I can go to, to quickly buy the rights to use such little bits of copyrighted materials in my videos? Or maybe under fair use law I can get away with this because my videos are educational in nature?

Same here I want to use small bits of music and this is really unfair. KZbin atleast must say one can use a music bite for some seconds only then no copyright. If I make a big video and add 4 to 5 different musics from different songs then if they give the strike then yt channel gone. Bad part of yt. This must be changed.

There's no clearing house... you have to find, ask and negotiate with the copyright owners for each piece you use. What you describe is almost certainly NOT "fair use" for the music... but the single line snippets might be. No. Write a new song and you can own it, but merely changing a bit is called making a derivative work. That’s infringement.

You're talking about "Dramatic Performance Rights" (if it's within a performance of a play or musical), (Oftentimes this is referred to as "Grand Rights") (BMI and the other performing rights organizations don't collect for such uses). But if it's just a concert type performance, then it WOULD be a BMI license, and you needn't do much beyond registering your songs with the PRO

I would think that artists(s) want to make money off of their songs so I would think they would make it easy regarding contact information for permission and if they don’t they are stupid. Many have KZbin videos and I would hope they have an up to date: phone number, email, or address to write to for permission, a management company in charge of permissions, or a list of names to contact.

WATCH THE VIDEO... it explains. You don't get permission through youtube. You have to identify and contact the copyright owners directly. If they've already filed a claim with youtube, it's unlikely you'll get the claim removed. KZbin will only know you've got permission if you negotiate for the rights owner to notify youtube.

DJ_Wolff Copyright is a form of property and can be transferred by contract, or by will, probate, etc. the death of a copyright owner results in a transfer. So permission is still required. The tough part can sometimes be tracking down the person or company that currently owns it. It might be necessary to have a lawyer help.

If copyright is so damned important, why isn't the process to request the ability to use a licensed work made super simple? Wouldn't that promote increased respect for copyright as a whole? The current structure of copyright seems to be counter-productive to itself. Not to mention the ungodly court costs I assume are involved in suing someone for infringement!

It’s a complex system that was devised long before most people had access to the means of production (or reproduction)... new technologies have made copying so simple, it’s natural to expect every aspect of life to be simple. Sadly, that’s not the case. While it’s easy to break the law, and somewhat difficult to get caught, following the law is REQUIRED. The consequences when you get caught (eventually, you will) are quite dire. Costs incurred by a successful plaintiff get shifted to the defendant... so cost isn’t often a deterrent.

Rates probably start at around $300/hr and rise as high as $1000/hr. depending on the lawyer's level of experience, specialization, and city\. Since copyright litigation can take years to reach resolution, it's not unusual for total fees for a copyright case to reach 6-figures, and even into 7 figures. It's increasingly rare for such cases to be handled on contingency basis.

IF you can show it is personal use only you can probably get a much better quote. Stealing is not the solution. Go about it the right way is.. If yo like the piece so much you want to integrate it in a piece of media you are creating you still have to do the right thing.

Remember, you've got to incentivize the creation of works... not just make everything free for anyone to use. @@slanderxtezz I've not found a solution other than disputing the claim each time. Also at times my dispute has then been dismissed and the claim has been reinstated and then I have to appeal their decision. It's a whole lot of work! One tip I've learned is; save your license or proof of permission for use to google drive and link it in your submission when disputing claims.

Question: I want to use “ Pachelbel's Canon in D “ - that I will play and record on my keyboard. Google said “ Pachelbel died in 1706, long before copyright existed in its modern form, and so the composition is most definitely in the public domain. This means that if you can get an orchestra together, you can perform Pachelbel's Canon in D major without having to get permission from Pachelbel's heirs, estate or agents.” So, do I consider Google search as legitimate under the law that I can use that song for free? A lot of performers are playing classical music and posting it on KZbin. I don't think you have any problem with doing this. If its in the public domain then you shouldn't get any copyright strikes.

I have a question that is not related to this content. sometimes I watch other Shorts using the original music BUT the sounds are not the same as the Original music should be, I take the "Can you feel my heart" song as an example. When other Shorts playing the part of a Original music and start playing "Can you hear the silence? Can you see the dark? Can you fix the broken? Can you feel my heart?" Then the music plays the Theme of the song with little low deep, so I tried the same thing but it goes the same thing without the low deep in the theme. like why I can't make the same music and how they make it? there is no features to make it.

Long road to nowhere. Unless you're in the circle of the powers that be, they don't even know you're alive. And will not respond to any email inquiries. I been doing this for many years. This is the cold hard truth. Notice how he recommends being better off by using your own music. Sure! That makes it feasible and you will actually get to move forward now instead of waiting for inquiries that will never be answered. Only one problem. Your own music just doesn't have the popularity level as the music you were trying to get. Or the third option. Take any song you wish and USE IT! Since they don't and never will know you even exist on this planet, they will never know you're using the music. Have fun. And always remember ... The powers that be are IN the circle! If you're not in that circle you are OUT!

How would you change copyright law? Remember that the constitutional mandate is "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." so, how do you incentivize creative work without giving the creators the right to control how, when, and why that work is used by others?

Copyright laws should only be applicable to the authors, and no others. Once the authors have died, no corporation should be able to claim ownership of any copyright.

No. You must get permission, or operate under a legally recognized defense or exception. Whether you make money is not a factor at all. Copyright ownership means having the right to say "NO" to a use, for any reason at all, regardless of whether there's money involved. Likewise, giving credit is irrelevant, except that it could be the "smoking gun" that proves you knew the material belonged to someone else.

Tbh, I disagree that you can't use copyrighted music for your KZbin videos. Isn't that a free advertisement for them? I think it should depend on the content, but if copyright owner doesn't approve it, you have to delete it, but charging you for that? What if I already paying for that on Amazon or KZbin Music? I wish that we had just to leave a referral under your video or write down the link. I'm still surprised that you can stream video games with no copyright rules. Why? And the funny thing is, that you can stream a video game, but not the music that is playing in that video game. This is so ridiculous and doesn'tmake any sense! Game owner can actually ask you to give him a part of your monetization income, but they are bot doing that. Why? Because you are a free advertisement from them? If yes, why same thing doesn't apply for a music? I don't understand all that. But the only thing I understand, that it's all about the money.

You can disagree all you like, but you'd be wrong. Copyright law gives the copyright owner the exclusive right to control how the work is used. Sometimes, "reaction videos" of video game play are considered fair use (a defense in copyright claims), and sometimes, the game makers don't care... or view it as free promotion of the game. But music owners (the people who own the songs and recordings) don't benefit from unlicensed use in videos. They expect to get paid... its how they actually make their money, especially now, when nobody buys music the old-fashioned way anymore.

When you pay for music on amazon or youtube music, you're getting a limited license to LISTEN to the music, not to use it as a building block for videos or films that you make.

Overkill for KZbin, my ass! This seems mandatory due to KZbin being a bunch of people who are very strict on their copyright laws and their monetization. If anything, this should be used EXCLUSIVELY for KZbin videos.

Does this apply to parody videos? If you are parodying a music video is it enough to parody the visual aspects of the video and use the original audio, or must you also make a transformative change to the audio for it to be safe?

I think as long as you transform the music "enough" you're fine. A famous artist in my country would usually rewrite all the lyrics and sing over the tune and keep the rest of the song. He's somewhat despised for that, but as far as I know, it works. Oh and no clips allowed. You gotta record your own clip.

There's a reason KZbinr's want to use copyrighted things in their videos. Because it's necessary for the video. If we wanted to use copyright free material, we would. But there's no sense in doing that if the copyrighted material is the only possible thing that will make the video tick.

This video is almost 3 years old and there's almost 300 comments so I'm sorry if I'm asking a repeat question. I've got some parodies that I've written (more in progress.) Is this pretty much the same process I need to go through to publish them? I plan on recording and editing myself and going no farther than Facebook and/or KZbin with it. It's something I'm doing for fun and do not plan to make any money on but I want to be covered just in case anything happens.

Ian Mitchell they are businesses. They do have contact email addresses. They have websites... get a phone number or write a letter. Be resourceful. Or hire a lawyer to help...
