Hi! This video was very helpful. I do have a chronic rare illness that I do treatments for every three weeks. I’m so sick some times I don’t have energy to research. I asked Emma one day after I was out of hospital and it was a very vague. I didn’t realize they were sending that conversation so I got denied. I have been checking my USCIS account daily and see some updated dates for "someone has touched" my case recently. I am so worried about the interview as they have been living in two different countries for the past 13 years. Mine was in the queue starting september 9, and currently it says February 23, which leads me to believed that an agent had a look at my case on the 23rd. @@myrondelapaz9579 ours was not financial duress, and I would be a bit careful with that one if that is a reason you're considering an expedite, esp w/ the new public charge law in effect. For us, it was because of mandatory civil duty required in my husband's home country. The adjudication of your I-130 will depend on a few factors, some of the important ones being your service center and if you're USC or LPR. what's your priority date and what service center are you at? If you keep monitoring your account, if you see the date change again after 2/23, it's a good indicator that they are actively reviewing your case.

Our congressman passed away earlier this year unfortunately. They have not filled his seat yet and no word on when they plan to host an election to do so. I filed my petition on 04/20/21 but my husband lives in a crime ridden country and he already has been robbed twice. The police are corrupt also. I’m trying to get his case expedited ASAP! I fear for his safety. In your personal opinion, do you feel I have a solid case for trying to expedite? I’m so stressed out and my anxiety is through the roof. 😔

hi Heather! the I-797 NOA1 will list your priority date, meaning USCIS received your petition and you are in queue. You'll get another I-797 NOA2 letter once approved. 2 diff things. thanks for being here!

I had more luck on the initial request calling them first to inquire. Make sure to get a reference number in case they dont get back to you in 5-10 days & you can use that number to reference if you need to call them again

im not familiar with CRBA so I'm not sure on timeline quickness but to combat that, did you already submit? I would submit with strong cover letter explaining presence situation. You can always do an I-130 and try to expedite there as well. The only hassle is the filing fees

Your doing a CR-1 or IR-1 which takes 10 months for the interview with USCIS. You must mean 86 days after your interview to get the I-130 approved.

I am doing CR1. You dont get to choose, the ploy determining factor is that you were married less than 2 years before, so you are CR not IR. Yes, that's correct, 86 days from submit to I-130 approval, no mention of interview

I also recall correctly--and this may have changed--California doesn't adjudicate US citizen I130s for spouses or children. So that would make it likely that the case is transferred--eventually???

I also recall CSC not being a service center handling for those categories, however, I think many of the service centers starting adjusting their scopes and processing timelines etc with USCIS going more digital

@@marny125 I called USCIS when my case was still there. And then once I advanced on to NVC level, all my inquiries were to the NVC. If your case is just awaiting an interview, then most likely the NVC is still handling your case unless they sent it off to the embassy, but you should be able to see where it is if you login to your CEAC acc't

I believe your wife should be the one filling the I130 form since you have the work permit you should file the form I485 as an adjustment of status since you are already in the US

when you call USCIS again, ask to speak to a tier 2 agent. also try to get a reference number next time you call, so you can use that number for them to look up your request if you ever call again in the future. I think 2 months for them to even decide whether they want to expedite or not doesn't sound like normal time

@@davidlu6041 hi Dave, so sorry to hear it was denied. You can always try to expedite again, but do be sure to either include more or different information. it cannot be a duplicate request. Even if its just a few more items of proof, then that at least will not make it a duplicate

LPRs have been known to generally follow the same timeline as USC applying and in some cases ive seen faster, but not sure if the trend has changed now with covid. It's frustrating but theres no real answer on how quick, but in many cases a 4-6 month timeline recently on a well-prepared application. I would check out visa journey to see timelines!

I have heard of some people having success with the 129 - If it were me, I'd definitely head for that route. (Most likely for expedites, if you are searching for a reason itself, then it might be a bit of a hurdle to prove)

I am not familiar with a re-entry permit. Whether you've done a biometric exam in the past or not, just make sure that it's within the threshold before interview so it hasn't expired

this sounds similar to what happened to me, I called to request the expedite. I had to do that twice since my first one didnt even go through successfully. After my 2nd call on 12/17, I got an email from my service center on 12/27 to provide proof within 48 hrs. I provided all necessary government issued documents to support my case + language translations of my husband's home country.

Hi Anass! thanks for being here :) whether they filed the I-130 online or hardcopy, expedite method is still the same. Ive found the best way is to call and explain situation, and say that proof can be provided. If they dont automatically deny, then in a few days they will email requesting proof and thats when you'll submit proof of the expedite along with recapping the situation for context.

wow good to know the IOE comes instantaneously for the online apps! cool! on the I-130 end, they are stricter about expedites. You would have to have a valid reason. Prep that before you call uscis and make the request, make sure you have proof supporting request

I called them and She told me that uscis office will contact us in 7 business days. Let’s say They turned back after 7 days . What kind of documents or transactions Do We need to Do? Do they tell us what we should do? By the way, It would be much better if you write down everything you do in a certain order and present it to us. everything is very nice but a bit complicated.
