“No person shall voluntarily land or unlawfully operate within or upon any park, any airplane, remote control model aircraft, helicopter, unmanned aerial system, drone, balloon, parachute, or other apparatus for aviation. ‘Voluntarily’ in this connection shall mean anything other than a forced landing. Rescue and evacuation aircraft are exempt from emergencies and approved training exercises.” That's the VA State Code for drones in state parks. The only thing it actually restricts is landing. The rest says to not "unlawfully operate" which is not defined anywhere. So I can only conclude that means I must follow all other laws pertaining to drones which is just redundant. It technically doesn't even say you can't take off there, you just can't land there. They probably intended it to mean you couldn't fly there, but that's not what it says. If that were true they'd be banning everything from passing overhead which certainly isn't within their authority.

Flying in from the outside, especially densely wooded parks, immediately presents VLOS and/or transmission issues. By FAR, not a 'one size fits all' solution. The excuses used for not allowing take-offs and landings in the parks near me are absolutely ridiculous in comparison to what IS allowed within park grounds. Hunting (live ammunition), boats (dumping oil and gas in the water and exhaust in the air...(don't tell me they don't lol), thousands of people trampling all over the land, on a daily basis, that they say they're trying to preserve, and let's not forget about all the littering and vandalism that goes on. BUT, a drone which leaves zero 'footprints' and zero emissions, in their eyes, compromises the safety of hikers and the preservation of wildlife. Pardon my French, but what a total crock of f*****g bulls**t. It's discriminating towards photographers, ESPECIALLY TOWARDS THE ONE'S THAT TOOK THE TIME TO GET CERTIFIED, plain and simple. I mean, seriously, I'm not 'little Billy with a drone' over here. My certification MEANS SOMETHING!!! *This rant is not at all aimed at Drone U*!! Thank you for your quality content!

4:54 Is that still true when the line of sight from the pilot to the drone is broken? As I understand, the pilot must always maintain a visual line of sight to the drone. That limits your flight radius from your take-off point considerably, limiting how far you may go into the State park.

QUESTION: How is it Seattle can make it illegal to fly your drone within city limits unless you pay them handsomely for a film permit every time you takeoff and land?

because nobody is fighting them in court. Unconstitutional laws still exist around the whole country, its only when fought with thousands or hundreds of thousands of dollars from citizens does it ever get rescinded.

But the FAA encourages to respect and comply with local rules, state park regulations, etc. Here in New York, we can only in the assigned AMA fields as guest or members. If I want to fly in a state park, I need to request permission from the OPRHP.

What about army Corp of engineers? I have a local hiking trail that is watched or governed by army Corp of engineers and they came and told me I was not allowed to fly over there? But everything says it's clear to fly ?

I'm pretty sure they're just dead wrong and need to be educated. Better yet, educate yourself so you have a leg to stand on in any civil conversation with authority figures.

Flying into State Parks or National Wildlife Refuge might be allowed but then they just pull out the generalized Creating a Catastrophe or Harassing Wildlife charge.

I want to be able to fly in parks....but, one big problem I see is flying in very dry times when there is a risk for fire...since you are flying with a lithium ion battery. If you crash...that's a very flammable pack that can set a nasty fire in the right conditions. Even when flying during a wet time....that drone may crash in a inaccessible area and not catch on fire until its dry enough to set a fire. That's a hard problem to solve for.

Cities containing more than a million people have the authority to create their own ordinances...unfortunately.

I'd think they could only ban take off/landing on city owned property. If you own property(or have permission from a property owner) in that city, you can take off/land there and fly anywhere that is in a line of cite from your property. Still, in a city like new york, I'd expect them to exhaust you in legal fees and crush your soul to enforce their will even if they are in the wrong.

Why do you use mics that are bigger than my car? And what's with the mic stabalizers when your mics are on mic stands? Isn't that overkill?. But that's off topic....thanks for making this video as I'm anxious to fly over as many state parks as I can because there just isn't enough air space anywhere else.

I don't buy into this flying "In" loophole. I think if a state/local .gov decides they do not want drones flying into parks/etc. drone operators need to respect that. Hopefully, this will be clarified by some legislation in the future.

Indeed. Flying an airplane into controlled airspace from outside is still a violation. Also, the concept of complying to community rules and regulations is just good practice. I'm a former park ranger and wildlife biologist and also fly a drone. It's simple to respect boundaries, to educate yourself regarding the reasons why restrictions on flying drones over certain areas, and to comply. We have the same argument regarding ORVs vs hikers vs horse riders vs snow machines vs X-country skiers. Just because you can, doesn't mean you should or that you are entitled to. Be an intelligent adult.

@@MikeShipmancontrolled airspace is the key term you use here. Again the FAA is the ONLY governing body for airspace. Respecting boundaries and being an adult is a different conversation. As someone who is a pilot, unrestricted airspace is exactly that, unrestricted.
