I'm going to submit a design on the trademark cloud, once l login. Does the trademark design & patent form let you download or take a picture of your design? Before or after payment of your review?

It’s a little unclear whether you’re asking about registering a trademark or about being granted patent protection, so, to clarify, please note that trademark registration forms and patent forms are different. If you want to register a trademark that includes a design element, you use a TEAS initial application form: www.uspto.gov/trademarks-application-process/filing-online/initial-application-forms. If you are filing a design patent, you use EFS-Web: www.uspto.gov/patents-application-process/applying-online/about-efs-web. In both cases, it is strongly recommended that you seek legal assistance. You can learn more about hiring a U.S. licensed trademark attorney, as well as find links to free and reduced-price legal services, on the USPTO’s “Hiring a U.S.-licensed attorney” webpage: www.uspto.gov/trademarks-getting-started/why-hire-private-trademark-attorney. You can learn more about patents, the patent process, and patent resources by reading the USPTO’s “Patent process overview” webpage: www.uspto.gov/patents-getting-started/patent-process-overview. It is also unclear whether there is a misunderstanding about when you create the actual design you want to submit. Please note, you do not create a design using the USPTO’s online forms or “on the trademark cloud.” You create the mark you want to register before filing and then upload that mark to the system as part of the TEAS initial application form. That is, if you are planning to register a trademark that contains a design element (sometimes called a “special form mark” or “design mark”), you must have a JPG version of the mark ready to upload before filing. This JPG is known as your mark “drawing.” You can learn more about mark drawings on the USPTO’S “Drawing of your mark” webpage: www.uspto.gov/trademarks-getting-started/trademark-basics/mark-drawings-trademarks. If you want to save a copy of your application before filing it (and before paying the application filing fee), you can save a copy during Step 3 of the application validation process. Once you file (and pay your fee), you will be assigned an 8-digit serial number. You can then use that number to view, print, and download all of the documents in your file at any time using the Trademark Status and Document Retrieval system, known as TSDR: tsdr.uspto.gov/.

Our office handles federal trademark registration, so we can't provide any information about establishing trademark rights in the state of California. But you can learn more about California trademarks by visiting the California Secretary of State website: www.sos.ca.gov/. If you're curious whether a foreign national can own, use, and register a trademark in the United States, however, the answer is yes. Federal trademark rights are based on interstate commerce, which might include commerce between parties in two states or between a party outside the United States and a party inside the United States. For more about establishing trademark rights, see our "Why register your trademark" webpage: www.uspto.gov/trademarks/basics/why-register-your-trademark.
