That's right, while in some countries like the US the relevant is "the first to invent" in other countries (specially in europe) the "first to file" applies, so in order to avoid the problem of losing novelty of your invention file an application and then you market it (in my opinion).

I work on legal end of the invention industry. Some inventors are so caught up in prototyping or selling there idea most rarely consider properly documenting the idea. Many are still under the false belief of a "poor mans patent" I spend hours consulting new and experienced inventors on setting a game plan before actually filing a patent. Typically it includes immediately getting the opinion of a registered patent attorney.

I've heard from a number of sources that if you bring a product to market (execution) before applying for a patent, you've then created prior art and cannot file for a patent later. So while I agree that execution is key, make sure you file provisionally before announcing or selling the product publicly.

Jay ! filing first a patent does help for a techostarter. once the patent filed then you can get plugged in to strategic player to co-implement the idea. and then for an entrepreneur it is the only card where he/she can have a say

Useful advice. I always say to inventors 'Do you know what you want to do with your patent?' and 'Who are the bad guys?' and 'Are there any bad guys?'

Hello, if you wanted to make a prototype of a product is it wise to show your rough daft of your patent to the developers when you can just tell them the basics with drawings and verbal direction.

This is a very useful video but I also want to know how to protect myself from patent attorneys. I don't want to tell them all about my idea just to find out that they stole it and I have no proof it was mine. Should I film our encounter? When you said to create intellectual property and to document in extreme detail. Would this also aply to a crowdfunding sites? Also would there be any risk to your intellectual property or losing it by doing a crowdfunding ad? Or would this be a good way to get your idea out to market?

Jay, I have a lot of business ideas but I am stuck on legal structure and patents. I don't know which structure to choose but I know I am NOT interested in sole proprietor or partnership...I know I would like to be able to sell stock but not in the beginning...and I know I can do that with an LLC, a C Corp or an S corp. I thought of a company name and dba's under it? please help...

I haven't got a scrap of money, I think the enemy is on the verge of realizing my idea. I know it will become successful. And I am not sure weather to patent the idea, or to carefully suggest my idea to the company already in the business. Just to let you know it is worth billions!

BELIEVE ME OR NOT. I actually came up with the invention The Cloud or as Apple call it the iCloud. About 3 years ago I evolved on the idea after having a dream (I know it's weird) As I was young (14 years young) I never thought about patent it, I really wish I did now. I started to write a website called The Cloud. And then soon after Apple released the iCloud. That was exactly the same as The Cloud. A few of my friends knew about my idea and they was shocked when Apple released iCloud.

Isn't having a pattent first before everything? I mean you can have an idea, be first to market and execute it but someone else see's it, gets a pattent on it and then sue's you for copying, and he has the pattent on the idea..
