Hi Darrel, I have got the posession order and tenant should leave in 2 or 3 days time. Is it better to proceed with money claim now before they move out? or is it better to let them move out and then proceed with money claim? Regards

Hi ...I would wait until they have left and found somewhere else ...no point getting a ccj lodged at your property

Hi Darrel, I'm an overseas landlord (travelling, no fixed address or home abroad) who does not use a management agent for our property in the UK (we use OpenRent as our platform). All issues are resolved between myself and our tenants directly. We wish to return to the UK and take possession of our house (actually our home, we only have one house) and I'm a little concerned about issuing the Section 21 notice. You advise not to use e-mail but this is the only way we formally communicate with our tenants. How would you advise we issue the Section 21 in our scenario? Many thanks

Hello Steven I would use a friends/familty address. Personally, I would still serve the notice as per my video. You might need someone in the UK to do the posting and hand delviery for you. They may move out when you asked them to do so, but if you ever needed court, then old fashioned service is the best.

@@thelettingsguru Hi Darrel, thanks for responding and happy new year. I've been doing a little more research and noted that the AST that we have in place with the tenants specifically states that issuing notice by email is acceptable from both sides. The AST tenancy even specifies the email addresses to use (all still valid). Given this I assume it will be OK to serve the Section 21 notice, form 6A, via email. What do you think. I have a supplementary question if that's OK. I have all of the requirements in place to issue the Section 21 notice. However, I'm confused by the date that needs to be stated for the date of possession of the property. The tenancy runs from March 21st 2023 to March 20th 2024 inclusive. We'd like to take possession of the property on the 21st March 2024 which I assume is the date we need to specify in item 2 on form 6A? Many thanks for your help.

Hello, i would always serve notices based on my video. Obviously, you can chance it based on email only , and just hope the tenants leave. If they dont, and you need to go to court, pretty much every solicitor, I ve ever met, would say email service is not sufficient and a judge would likely dismiss your claim. On the section 21, I would state the expiry date as 20th March 2024.

Hi Darrel, Great video! When and where do we submit the N215, is it right after issuing a section 8 order or when the court proceedings begin?

Hi Khidr , its evidence of serviuce, so include with the possession claim when submitting to court.
