Thanx for the vid, DWK. But I am confused... why does it says Form 6A and not a Section 21 form? And then it says a Section 21 form will only be issued if the tenant does not leave?

HI Sue ... They are basically the same thing, but if you want to serve a section 21 notice, you have to use the Form 6A. It does confuse people.

Been served section 21 has he has given the house to granddaughter but his name on notice but she is pestering and moving in next weekend and we have nowhere to go but not for trying

Stay put ...they cannot force you to leave without court order and bailif. Phone council for advice

When you say put all the tenants names and on the form, does that mean all occupants like dependants etc

Just the tenants named on the tenancy.... not children etc

Hi. Do the certificates and rent guide need to be served when Form 6A is served? If I served Form 6A and gave those 3 documents at the start of a tenancy, is it valid?

Hi, my landlord sent me a WhatsApp message on the 20th October, saying he will "state the same in a letter, but please consider this message as your official notice, end date of tenancy being the 20th December". He then went on to tell me that if i didn't move out his sale would fall through and itll cost him thousands. This message didn't include my full name, property address or his full name and address. I still haven't received a formal letter. Its now the 25th October. If I received a letter tomorrow with the 20th December as the end date would it be valid? Thanks for any advice Ami

Nope ...it needs to be a proper notice as per my video.......the notice is the first step in the process.... you have no legal duty to move out on the expiry date

The last part of 6a do i actualy need to tick next to relevant word eg land lord , Agent etc Thank you

Hello. How about if i hand deliver the S21. Do I then put the notice to leave date as exactly 2 months after the date i sign the document? Won't the judge think i have filled it in incorrectly - how will they know i hand delivered it? Thanks so much!

Hello Katie, i would always add three days service, even if hand devliered, so 2 months and 3 days as the length. The notice is a minimum of 2 months, so it can be longer if necessary. In terms of showing the judge it was hand delivered then you need evidence. I have a notice service video in here, which will help explain what you should do.

Hi Darrel, thanks for the helpful video. What happens if you send a notice through special delivery with enough time, but the postage falls on a bank holiday and the notice is then delivered to the tenants after the date listed on the form. So in this case we asked the tenants to leave after 29th October 2022, however they received the notice on 31 August 2022 instead of 29th August? Would this invalidate the notice even though they are still in the property well after 29th October 2022?

Just to add we followed the section 21 notice up with a whatsapp message with a scanned copy of the section 21 notice and have evidence of this.

HI Fagoon, what was the date of the notice? The date just under your signature.

@@thelettingsguru Thanks for the reply! The date the form was signed was 26th August and we hoped the latest they would receive it was 29th. They however, received the notice on 31st due to a bank holiday! Would this invalidate the notice and would the WhatsApp sent to the tenant on 26th August be considered as evidence to show the tenant had seen the notice on 26th August? Thanks!

Just to add the form was signed 26th August and they were asked to leave 'after' 29th October. But the special delivery got to them on 31st August. We did follow up with a whatsapp on 26th so the tenants has seen the notice on the phone and were aware.

@@FagoonVinitaDave HI Fagoon. I think you should be okay because the courts normally allow 2-3 dasy service time. Its not really your fault, the post was late. IMHO, in future, never serve by special delivery, just send first class with proof of posting (a post office receipt)
