I covered this story. The cops also tried to say she was under the influence of drugs. They drug tested her. Took a blood test and she was clean on everything. Idk why this was never mentioned in the suit. I covered this story years ago for the news.

No, I think it is a great idea since 95% of a cop job on the beach/tourist place is just go around and give warning, tickets and just be ''present'' to keep the peace and order. The real problem is they should be mandated to call a real officer to be present if they want to execute an arrest. This whole situation would of never happened if they called backup for a permanent officer when they decided to arrest her.

This includes using language that is "Vehement, caustic and may sometimes include unpleasant personal attacks." If a cop arrests you for getting irrate sue the shit out of their town because they violated your rights. You can address them in any legal manner you choose as long as you don't issue a verbal threat. You can call the pigs etc and if they retaliate they attacked you and violated your rights just fuck them in the ass by fucking the town or city in the ass.

Milwaukee Wisconsin, once known as the "Beer Capital of the World" ... You can't buy alcohol anywhere in Milwaukee after 9PM except in bars. not sure on the justification of that law. If a person wants to just sit at home and enjoy a few drinks in the evening, nope, not unless they bought that beer before 9PM. It's better to drink in public I guess. I'm sure that doesn't lead to more DUI and public intoxication arrests.

Nevermind that the young lady could very easily have been more cooperative with the officers and had less attitude. Simply agreeing to pour out the alcohol would have been easier. She got caught. Now, during the arrest, did they need to punch her? No. But, from the beginning of the encounter, being intentionally difficult and escalating the situation with just about every action means she should admit that she had some accountability in the incident. Personal accountability is going out the window and the victim mentality kicks in placing blame on everyone else but themselves.

It seems to me that the reason for this is that cities settle because, regardless of their stance, they see it as better than losing a lawsuit and having to pay much more. The city technically wasn't admitting a "mistake" by settling.

I use to see people walk up and down the streets with alcohol beverages all of the time and never said a word as long as their acting like normal humans that’s all that mattered I had far more better shit to deal with. Not insane. In the scenario you describe, if that alcohol is not locked up, it would be as highly irresponsible as leaving an unlocked gun in the house with only minors. But then again, your premise is flawed. If you leave minors alone in the house and unsupervised, a crime MAY indeed have been committed, regardless of what is in the house! Social Services could take the kids away DEPENDING ON THE SPECIFIC CIRCUMSTANCES OF THE CASE. @@mangojulie123 That is insane. But I guess we just have different principles. I'm heavily in the libertarian spectrum and you are clearly near the very limit of authoritarianism. While some minors are infants, not all minors are infants. If you can't safely leave your kid home alone for a while starting from roughly 8-10 years old, you have most likely failed as a parent with a few obvious exceptions. You are like those who want all kids taken away from those of a different religion than you because you view any way of raising a kid other than your own preferred way as abuse.

Settlements are not an admission of guilt. They are damage control method to prevent possibly multiple times more costly litigation. In this kind of cases, the city has absolutely nothing to win. They can only loose. They assess the situation in strictly financial terms and more often than not a settlement is the best course of action. No matter what's the case, they should never be handled with knee-jerk reactions such as yours.

Try and run away, realise she's not gonna get anywhere, then assaults a cop. Then is surprised when she gets taken down. The only person that escalated this was the young girl. I will concede that the cops could have explained the situation better. But I strongly suspect that it wouldn't have had a huge difference in the outcome.

I live in NJ and grew up 15 mins from Wildwood. Imagine a state where cops are encouraged to walk around the beach to search for anyone drinking. And then when you prove them you weren’t drinking they look for the next issue to escalate. This wasn’t a rogue cop, this is the mentality of the whole force down there.

I grew up at the Jersey Shore, a block from the beach. The towns hire these "class two police" who have no training. If they do well they go to the academy. The problem is they are all trying to make a name to get to the academy. So they arrest kids for nothing. It also leads to the security in the area being garbage. Every failed class 2 or people they wouldn't even take ends up in a security job with a chip on their shoulder.

Because the logic, is you and police don’t decide what is or isn’t legal and police are supposed to be able to make an arrest assuming that they believe that a person has broken a law and that law constitutes an arrest. Then you would be called to a court where a judge should supposedly throw out any case that wasn’t a real arrest explain to the officers so they know for the next time and everyone leaves slightly inconvenience. So in this case while the “police” kiddie cops were definitely just abusing power, they could just say oh well we thought not identifying yourself is an arrest able offense because x reason So any resistance or struggle would be resistance because to the officers it is a legal arrest, and to the court, the officers were in fact trying to accomplish their job albeit in a terrible way.

I'm not sure about New Jersey law, but in a majority of the country, you are not required to blow into the preliminary breathalyzer. It is optional/voluntary. If you get arrested and taken to the police station however, you have to consent to blowing into the high calibrated blood alcohol machine or be subject to additional charges.

They don't have any authority other than what you allow them to have. They are offering to contract with you; they are doing business. You can ask them, "Are you here to do business for the corporation?" and if they say yes, then respond, "I'm not for hire and I'm not doing business with you." That's it. Repeat if necessary. Statutes are not laws, they are corporate by-laws. There must be a substantial contractual nexus between you and the corporation "STATE OF NEW JERSEY" and/or "CITY OF WILDWOOD" for their statutes to have any force.

It would be different if she was loud, obnoxious, and causing a scene that affected other beach goers prior to them showing up(she did do all that after they showed up). I’m also curious why they focused on her when she wasn’t the only one sitting within the beverages vicinity.

In law books, police officers are often referred to as "peace officers" because their job is to maintain the peace and safety of citizens. Most "peace officers" have now become petty pricks looking for nitpicking violations of statutes and ordinances that give them a pretext to flex their egos and exert power and control. Before the two "peace officers" arrived, everyone was enjoying a peaceful day at the beach. The "peace officers" turned it into a humiliating and violent confrontation, assault, arrest, kidnapping, and trip to jail. Cops are no longer clear on the concept of keeping the peace.

It really comes down to one word: Discretion. The cops could have just walked away. If federal prosecutors can refuse to prosecute war criminals and torturers in the name of “moving forward,” then I think local cops can turn a blind eye to such petty offenses.

I'm going through training right now that in part discusses physically restraining people. It should only be used as a last resort because of how traumatizing it is. That girl wasn't doing anything wrong, but bc they escalated it so much, the situation turned into a struggle. When people are being involuntarily restrained, the first thing that happens is panic and fight or flight. I don't blame the girl for freaking out.

I'm so tired of police officers almost never being held personally accountable for their criminal activity, but instead for taxpayers to be held accountable for their illicit activity. This needs to end. Require police officers to get insurance to cover any legal judgements against their employers for their behavior. And let the insurance companies decide how much each officer needs to pay for insurance, given their training, track record, and other factors. And if the officer can't find an insurance company to insure him or her, then he or she cannot get a job as a police officer. I'm so tired of taxpayers footing the bill for the criminal activities of people who believe that they are above the law.

Going to disagree, these problems are almost always agency problems, and the agencies should be held responsible for poor leadership. At the very least they have poor recruitment and training. Often poor leadership across all levels of the agency because no one is held liable for poor command decisions. For example simply pairing a class 2 officer with a regular full time officer might have prevented this situation. You don't let a probationary officer all on his own, you might give him his own car toward the end, but the FTO is always dispatched with the probbie.

I like the idea of requiring officers to get liability insurance, coupled with required reporting of complaints and incidents. Bad cops would get flushed out because insurance companies wouldn't sell them an affordable policy.

I don’t think this is the most fair breakdown of the situation. I do agree that the police officers should have been less aggressive and D-escalated the problem. They also should not have punched her. But she did try to run from police which is really stupid. And she continually mouth off which yes the police also did but in this situation, both of them did awful. Don’t try to spin this into a police are just evil situation. In this case everyone was in the wrong and it would’ve never escalated to the situation if the girl hadn’t of helped it escalate to that point.

As a Brit, it seems extraordinary that you can have "summer temporary hire police officers". I used to work in security, and I wouldnt trust a DOORMAN to work unsupervised until I had fully trained him, sent him on a legal course and watched them work for at least 3 months. How the hell can you take some rando off the street, give him a few weeks training and then swear them in as police officers, and let them loose on the public. This is absolute insanity... and this is how it ends up.

Our police force is not without its issues, but at least in the UK they get extensive training, then become effectively probationary cops for two years before earning their stripes. I think that is reasonable considering one asshole cop can change someones life with one bad call. Police everywhere have insane powers when you think about it. Just arresting the wrong person, then releasing them (without de-arresting them) will have repercussions for the rest of the persons life.

The cop was just doing his job, making sure no bottles are on the beach, making sure no alcohol is openly consumed or displayed, and making sure no minors have posession of alcohol. She was breaking all three of those ordinances, and would not just accept the ticket like her friend did. Notice her friend (the other girl sitting with her) did not end up in jail.

This is a common misconception, that police are out there just trying to make people's lives harder. The problem is, especially in this case, is that if they let it slide, then everybody thinks it's okay. Yes, the police have some right to unlawfully arrest you, (yet they seem to never get punished for their law breaking), but you have no right to resist their illegal act. How convenient. You’re not breaking the law, they accuse you of it anyway, they break the law and arrest you without cause anyway, and they are seemingly never charged. You do this, it’s assault and unlawful imprisonment. They do it, it’s just an honest mistake. A reasonable person, knowing they have not committed a crime, should be expected to resist efforts to arrest them.

It has become a business to pick a jury that would be sympathetic to your side. It always seems weird that you can be charged for resisting arrest when the arrest itself is unlawful. Like, even the military is supposedly clear to refuse unlawful orders, but if a cop gives you an unlawful order and you refuse, you get beaten into the pavement and catch extra charges for it.

I think it warrants some discussion about how this interaction even began. Why were they singled out? A 20 year old and a 21 year old is mostly indistinguishable at a glance. I didn't see anything that made me think she was drunk. Almost immediately after contact they question her about her parents and administer a breathalyzer test. I guess I'm not understanding what was the actual probable cause to even engage in this interaction.

It's so infuriating when even with body cams and bystanders and such that internal investigation can still come out and say "We didn't do anything wrong" outside of the most egregious offenses. It really speaks to why folks distrust the police in instances of misconduct: what good is a complaint or an investigation when they get off scot free in the end anyways? There have to be more independent oversight boards to handle this type of thing because at this point an internal affairs investigation is worth about as much as toilet paper.

Her reaction and behavior was Fight or Flight taking over. You could see the moment fear took over. 20 years old, no record, being threatened with arrest and jail. She was terrified, and the officers did nothing to calm or de-escalate the situation because they were too busy letting their emotions get the best of them as well.

In fairness, 'no record' isn't exactly accurate. She was serving probation after having pled guilty to assault and reckless endangerment. The fallout from getting written up while on probation is probably why she was both hesitant to provide her name and scared. Especially if she didn't clear the out-of-state travel with the probation officer. Notwithstanding... still bullshit.

Something I believe would be fair is if every municipality had to be covered by malpractice insurance. The settlement payments get paid by the insurance and the premiums are divided amongst all officers and taken out of their checks as a statutory deduction. Every time they fuck up, their insurance premiums go up, causing that statutory deduction to go up as well. This would offer a financial incentive, as everyone would have to work together to keep premiums low. If they lose insurance all together because they don't know how to hire, train, or discipline people, they have to pay out of pocket with their pension fund.

Girl played this perfectly. Was being accused of drinking underage when in fact she proved in several ways that she was not drinking. Proceeded to insult the officer's ego (which in this case was hugely inflated). Little officer got his feelings hurt and took it upon himself to repeatedly punch a roughly 90-100 lb girl on a public beach. Gets fat pay check.

As an epileptic myself, I participate in a few epilepsy support groups. There's a person there that I know who became epileptic after being hit in the head several times. Head trauma can kill you, or mess you up for life.
