Murder of Indian fishermen: Italy court dismisses 2012 case against accused marine members

A Rome judge on Monday dismissed a murder investigation into two Italian marines who killed two fishermen in Kerala in 2012, months after the case was dropped by India's top court. It followed an assessment by prosecutors last month that there was not enough evidence for a trial. In a statement, Italian Defence Minister Lorenzo Guerini welcomed the "positive outcome" for Salvatore Girone and Massimiliano Latorre. Girone and Latorre shot dead the unarmed fishermen off the southern Indian coast in February 2012 while protecting an Italian oil tanker as part of an anti-piracy mission. Watch full video.

Which was never proven conclusively, especially the muder part as it was a case of mistaken identity and an accident and also there was the fact that it happened right outside Indian territorial waters, so technically IPC and Indian law didn't apply here. Indian judiciary needed to be slapped. By not allowing the defense's experts to assist to the ballistic tests, the Kerala court discredited any result they provided. That's why the two couldn't be trialed in an Italian court, as, at that point, there were no evidencies against them. You don't make so that the forensics are prohibited to the experts of the defense if you don't want to forge them.

Also the Indian government released the marines in return for getting membership to MTCR. Italy, which is a member of MTCR had been vetoing Indian membership plea as revenge for keeping the marines in jail. However the case still continued on paper in Indian courts. Italy also approached the EU for help.

The italians were armed with weapons in 5.56mm NATO, not compatible with the findings. They didn't have weapons in 7.62 NATO but, even if they had, a 7.62mm NATO projectile is only 28mm long, so not compatible with the findings. The only widely used projectile compatible is that of 7,62x54R cartriges, used, IE, on PK machineguns mounted on Sri Lanka's Arrow boats, normally used to fight illegal fishing in Sri Lanka's waters.
