If they are progressive or liberal judges, it's par for the course for them and they do not care. Same in this case. The persons on this court do not care and support government control over the sheeple, so they ruled stupidly on purpose. Of course all this does is reinstate the case and allows the NRA to sue. But since Sotomyer wrote the opinion and had scathing guidance in it on how indirect action through third parties IS abuse of freedom of speech, she basically outlined to the lower courts that not only this case should continue, but HERE are the guidelines to follow (and if you follow them well the NRA will win).

If her actions were unconstitutional, then she was not acting within scope of office and, therefore, no civil or criminal immunity exists. Since she had no authority to do what she did, she was, by definition, conducting personal affairs while on the clock. Enough with this "they cannot be arrested or sued for invalid acts" crap.

You can't sue them where the issue at law has not previously been decided, since there was no clear ruling that what was done by the official was unconstitutional on its face. See Tolan v. Cotton, 572 US 650 (2014). SCOTUS explains that "Governmental actors are “shielded from liability for civil damages if their actions did not violate ‘clearly established statutory or constitutional rights of which a reasonable person would have known."

Knowingly and willingly violating the Constitution (and consequently, their oaths of office), is a felony in most states. This crap will never end unless these people that do this are put in PRISON. Quite right. State officials have no right to violate the constitutional rights of others. When they do so, they are acting outside the authority and be personally sued with no support from their state. They bear their own legal expenses and pay all legal damages.

Especially since if the appeals court ruling had been upheld, it would essentially abolish the Republic. Anyone who made it into any elected office would be free to use that official authority to prevent anyone from running against them in the next election - you can't run a campaign, after all, if you can't get insurance, can't lease offices, can't buy anything, can't file official paperwork, etc.

These 9 people have a set of rules they must adhere to called the US Constitution, and any decision made by this court must reflect the intent of this document ( constitution ). If one doesn't like something in the Constitution, there is a process available to change the Constitution through an amendment procedure.
