Hi Marcus many thanks. I have a question about a friend of mine who has a mental illness and has been sectioned under the mental health act. He has been sectioned many times as an adult against his wishes. He is deprived of his Liberty. He is deprived of family life. Can this be regarded as being incomparable with his human rights.

It might be but that is not necessarily the case. The rights that you mention are not absolute rights and so they can be restricted in certain circumstances. A court or tribunal would have to examine all the evidence in line with the Mental Health Acts. I'm sorry to hear about the situation your friend is in however, it sounds terrible.

s.6 remains unclear when it comes to private individuals vs private individuals. If the courts are a public body, what is to stop private individuals from bringing claims against other private individuals?

+Chris Devine This is called indirect effect and is often seen in Article 8/10 cases where celebrities sue newspapers etc.

Human rights law isn't affected by Brexit. They are different treaties. :)

I am unclear on whether HRA permits private parties to bring HR violations against each other to court. You say ordinarily not, but you say the court argued ... etc. But if the court argued successfully, then all claims are brought before courts so this completely opens up the scope.

the british bill of rights didnt happen. the people wouldnt allow david cameron get away with scrapping the constitutional human rights act. our constitution maybe unwritten but its constitutional nevertheless.
