It's clearly implied that his brain wasn't eaten by the queen but, if that's the case he would reborn as a subordinate and not as the next queen. In order to transfer his soul to another body or the hability to "reborn" he probably had to meet several conditions in the fight (just like Kuroro and his hability to steal habilities), nobody knows those conditions except Togashi, and if this is the case Kaito probably has to meet even more than 5 conditions 'cause I imagine that it's a really tough one to do.
