How long a noncitizen is not allowed to come back to the U.S. depends on why and how long they were in the country illegally. The bars on getting in could last for 5, 10, 20, or even forever. What about daca recipients who left the country to live somewhere else? I do not have any crimes just the 10 year bar and do not want to go back to work just to visit family and childhood friends

But the problem with this waiver is, this only applies so easily for the neighboring/bordering countries like Mexico and Canada, like the new memo mentioned, it doesn’t matter now, regardless of how you got back in, where you can spend your statutory 3 or 10 year ban, so for the Mexicans and other latin countries and Canadians, all they got to do is try to cross the border AGAIN and spend the remaining of their bans in the US, while the citizens from another countries such as the Philippines, it will be really really hard for them to come back since they will need to re-apply for a visa to which the chances are highly unlikely to get approved, or if they are lucky enough to get one, they will get denied entry at the airport by an immigration officer during inspection, which is exactly the reason why they decide to stay and hide because it is very impossible for them to come back, unlike the citizens of Mexico and other latin countries and Canada who have the OPTION of crossing the border and make it. So this so called TRIGGERING the bans are not for any other nations but mostly for the latin nations and Canada.USCIS needs to consider this matter. Not every nationality have the leisure and can just come back the next day or next week when they get deported.

You’re wrong ! Doesn’t matter if you are from Mexico or Canada, if you get caught crossing the border while they are reviewing your process, you will have your process denied and will be deported for good so you Must wait in your own country no matter what country that is!

Do you have to file the I212, if you got 10 years bar (not permanent) after being deported for overstaying, and waited the 10 years outside USA, before applying to a tourist B2 visa?
