edwin, one time my husband went to small claims and the defendant didn’t show up... my husband won... years later... the defendant went to buy a house and since he had a judgement against him he had to clear everything before getting acceptance for the mortgage... so he had to pay... it was about five years later my husband got a check in the mail... so if he ever tries to get a mortgage then you’ll for sure get paid then...

It just doesn’t pay to not pay what you owe, especially when a judgment is put on you. Someone literally owes me $30K. I know they can’t afford it. The law doesn’t care. You make a payment plan you pay when you can. You can’t blow it off but a lot of ppl do and get screwed in the end. Greed is a sad thing and also throwing away a human for some cash (which normally isn’t as high as mine!) is even sadder.

ilikepiratesroar Yes, and then the court will take a percentage of your wages. Problem is: many people get paid in cash or direct check. Then when the court finds out they somehow get chastised. Same with when people don’t pay child support except child support is not a civil matter thus they can criminally penalize those cases.

@@Mytube777 I m not from the US, but I think this problem exists there too. If the person, who has to give you the money, has no work and no money, you will not get anything. I have the same problem, my exboyfriend has to give me 20.000€ (and another 10.000€, but atm the court is not finished on this), but he has official no work and no money. Because of this I have to pay the 30.000€ without getting anything back from him, it does not matter, if it s my right, that he had to give the money. On the other side, I have to pay the 30.000€ - there it does not matter, that I have no money (I study at university and have 400€ in a month). These laws are just terrible and destroy small people, who did nothing wrong, while save criminals.

So I have to pay for the damage. Plus he got a lot of traffic Tickets for driving too fast or driving on the Highway without paying the taxes for it and such things in this time periode. These (a few thousands) I had to pay too in a certain time or I had to go to prison for.

I don't normally comment but My fiancé and I are going through two cases that could take years. He got mauled by a dog and the owner ran trying to leave us in quart mil in debt but we found her. The court case is taking forever but it's gonna soon happen. 2nd was a hit and run (we're still healing from the injuries) We recently found the guy who hit us. Both people that we are suing are trying to fabricate what really happened saying that they stayed or they tried to get into contact with us. Hopefully the judges sees through their BS. It takes a lot to sue because it's not as easy as hiring a lawyer to win the case for you. I had/have to do research on the law myself to make what I have to say stronger. Good luck to you! If you really want you can refile for failure to comply with the court order and if a judge sees your way, they can be held in contempt of court and maybe get jail time as punishment. great video too.

It's not contempt to not pay a judgment. It's contempt if you find an asset he owns, get a signed order from the judge (aka turnover order) and then he doesn't give you the asset. Debtor prisons are no longer a thing

Legally you don't have to be in the lease, if you receive mail at that address they absolutely have to give you 30 days! We just went through this! Edited to add that you should ALWAYS try to put your name on the lease though.

Since you won he will have to pay eventually. If he ever needs credit for a big purchase, say a car or a home he will have to pay. But if you do take the extra steps which, I personally would take if you have the money to, they will collect all the money from garnishing his wages or acquisitions from his bank account. It’s a process and it’s not easy, but at the end you get what you are owed. Just one will take longer than the other.

I had to sue someone last year who hit my car. Through the insurance they were saying it was partially my fault and wanted to give me a fraction of the amount of money that it would cost to fix my car. Negotiation was denied from his side and getting him served was this whole other story. I won though and walked away with 4grand.

You can now legally place a lien on their property since you have a court order showing the debts owed to you ( this will screw up their credit if they have property on credit ), if they have no property to lien on, you can legally garnish their wages.

HAHA THE PEOPLE'S COURT. So, what they do is they look through public records and find interesting cases and contact them to be on the show. A while ago, some girl came into the vet's office that I worked for to collect all her dog's records because she was going onto the show for money related to a previously shared dog with her ex. She told us a bit about the experience. She also came back later and told us more. She said it was a really good experience. Also, maybe pay back Edwin Cyr? And if you don't have the $ at the moment maybe, talk to him about it Cyr? - Also congrats Edwin on your Bachelor's degree! That's pretty cool. It's a shame Cyr that you wouldn't give that back. That rubs me the wrong way.

I’m 28 and I sued someone in small claims court a few years ago for not paying for petsitting services. I also got a letter from a show- Judge Mathis! Haha they have people who go through the public records and look for cases like ours. Anyway, I went to court, they didn’t show, the judge ruled in my favor. All I had for evidence were Facebook chat messages between the woman and I agreeing on time period and price and messages I sent while she was out of town with updates on her pets. I watched her dogs and cat for 2 weeks while she was in Thailand for a friends wedding. I knew her from volunteering at a local animal shelter, so she wasn’t just a random person. She did the whole “oh I’ll meet you at this time to give you a check” then bailed, told me she sent it but never did, etc etc. I hesitated on going to court, but it was a decent amount of money and I had just moved into a house (I actually postponed my move in date because I was petsitting for her) so I really needed the money. After the judge ruled in my favor, they sent her a letter telling her she had to pay within x amount of days. The judge had awarded interest with his decision, so the longer she waited, the more it increased. She didn’t pay. I went back to the courthouse and had them send her another letter which basically said if you don’t pay within 2 weeks, your wages will be garnished. She didn’t pay. So I went and filed the paperwork to have her wages garnished. The way they do that is the county files paperwork with their employer and the employer sends money to the county from their paycheck, before they even get it. They dont take it in one big chunk because they have to leave money for them to live on. I had the bulk of the payments within a few months. I got the final payment the next April, after tax day when I guess the county was like oh here’s some more we forgot to send or something haha. In the end, she ended up paying about $400 more than she would have had to pay. The thing is, I love petsitting and I knew her. If she had told me she couldn’t afford it, I would’ve accepted payments over time or whatever. I’m not unreasonable. But instead, she was sketchy and lied. She’s in her 40s and has a daughter my age. I doubt she’d be happy if someone did that to her daughter. Anyway, it seems sort of tedious and annoying, but persistence pays off! The reason people don’t get their money is they forget to file paperwork on time or they don’t do it at all. Keep at it and you’ll eventually get paid!

Hearing this helped me further conceptualize how law would work in an anarchist society. People want to know who they're hiring/who they're buying from, so they'll want to verify their identity. An organization could exist which builds a reputation for verifying information about the identity of people who register with it, and employers would make it a requirement that they get verified with a trusted identity organization first. Then, if someone steals something, you can ask them to go to court, and if they fail to show up and you have a good case, their name will be tarnished until they repay their debts, and you could get them potentially get them fired if they have enough debt to their name (or murdered/raped someone) or something like that. Or people could just choose not to lend them money, or any number of things you'd normally do to voluntarily resolve disputes like this.

Edwin, I feel you on this one. I had a similar situation, except it hasn't even been a year since it's happened to me and he wasn't even my best friend at all. He was a person I met once and 2 yrs later, he became my roommate and HE was the one that needed a place to stay. So, I kindly took him in because he had a job. But 3 yrs later, he stopped paying me rent and bills, even after he signed a lease with the apartment complex and signed a WRITTEN agreement with me. He owes me $3500 in back rent, including bills. He became full of excuses and he started avoiding me, hiding in his bedroom, changing the subject each time I was asking him about the rent money and the bills. Then he found out that I sued him in small claims court and because he never showed up in court, I filed a default claim and, of course, had all my evidence and the judge ruled in my favor but he is nowhere to be found. Needless to say, I won't give up! However, it would be my luck if I found out where he is and where he's working. But, oh well!!! Karma will get him either way!

Going through this. 10 years ago paid a lawyer for a friend $50k. He recently won a settlement for $1.1 million and refuses to pay me back. Have letters from him over the years telling me as soon as he gets the money I will be paid back. Now I will have to file this myself. Lawyers telling me I am past 3 year statute of limitation.

i wanna sue my old roommate cuz he would harass me, try forcing marriage onto me, assaulted me, started withholding rent and utilities because i wouldn't marry him or give him attention. he also is a king pin drug dealer, and threatened to have people go after me if i nark on him. but he then said if we broke the lease, he would pay all the fees and pay me back what he owed, as long as i didn't nark on him. and being afraid and foodstamps broke, i agreed to it. but now he blocked me on fb and refuses to answer to the debt collector for him SQUATTING FOR TWO MONTHS AFTER I LEFT. omgggggggggggg

I’m glad that you are suing. I wouldn’t get your hopes up about seeing anything. Something happened to me where an acquaintance stole my debit card. We had her face on camera, and filed a claim. I won by default, however it was up to me to find what assets she owned that were equal to the amount owed. Unfortunately you cannot get blood from a stone.

i had a similar experience... i moved out of a place where i lived with a friend. we had a really bad fall out because she'd been emotionally abusive for a long time and i was finally standing up for myself. she did not like that one bit. there was money her boyfriend (who also lived there) owed me that i never saw, and she didn't give me back my bond money either. which was a lot. she was sending me abusive emails, so i just let her keep the money to shut her up. if someone was going to stoop that low i didn't want to bother with them anyway. not saying that that's what you should do... you're brave for suing

And what I learned because I recently was in a couple similar situations, as a resident in that house you can legally break in and get your possessions if your roommate hasn't given you proper 30 days written notice. If your roommate calls the cops on you, they won't arrest you because you are a resident that wasn't given proper notice.

Winning a case and getting them to pay are equally as difficult. You have to folloe through after the win. Suppose to garnish their wages, which means there's like a tax on their wage. They literally might not have the money at first. But the "tax" will be attached to their social security, so when they get a LEGIT job (some ppl get paid under table), part of their wage will always be sent to you.

I am going through a similar case with someone i paid to develop an app for me. Its 4 years later and no app. I paid him 10k and he has returned 5k but i guess he expected me to shut up and be happy because he is now ignoring my messages. Just like you said, they hope you will forget and move on. Well i wont. He lives in Miami and I live in California. This video has given me hope though because I will now be pressing charges against him in That county. Only question is how do i serve him if i dont have an address?

Should I sue? I signed up for a class. I put $200 down to hold my place and the registration said $1700 remaining. 1 week before the class I get an email saying that the remaining balance is really $1990 and that the $1700 was a typo. A guy called me being really condescending saying I made a mistake and I must be confused. Meanwhile online it still says $1700 due. I recorded everything. The guy said that he can refund the $200 that I put down but I cancelled all my plans this summer for this class and did not work summer school because I signed up for this class I’m out already about $7,000 for lost opportunities. I really want to sue but it’s $300.

Don't give up file that complicated paperwork and finish him! Lol I believe in you this has helped inspire me to try to follow through with a discrimination issue I've been having at work! I've been dreading having to compile my evidence I've accumulated for the EEOC because I don't want to have to think about or relive what I've been dealing with but I need to suck it up and follow through.

Very good overview! My friend and I have both passed through similar situations. My friend had to evict two of her roommates but went through the proper procedure to do so. She is now looking to collect what she owes them. Let me know if you want to know more .

Omg!! Hey I’m from Arizona too. So many likable ppl are from here ! So my roommate left me midway through the lease in college to go back home to California. I wanted to sue her but I ended up never doing it because I didn’t know how to but omg it was so stressful! My grades definitely suffered that semester. Thanks for this informational video

You do not get 30 days notice in NC for month to month lease. You get 7 days in North Carolina before the landlord can end the lease and file for eviction.

Hi Edwin. I am going through the same thing here in South Africa. I agreed that a guy can take my car and pay me in instalments. He only paid a couple of installments, and then stopped. I gave him informal warnings, but he rarely gave anything after that. I took him to small claims court. The judge ruled in my favour, but he is still not paying. Now I also would have tp trust the sheriff to take some of his assets, but they might give up before they find him. I will have to pay a lot of money to proceed as well, but eventually he will have to pay it all back...I hope...

Well, It seems like YOU have to give her a date. Decide how much time you'll give her, and tell her that if she doesn't pay, you will sue her and file the papers the day after your end date. That is what I did, and it worked, I got my money 3 days before the last day. 🙂

I totally understand what you're going through! it's so stressfull especially if a close friend did you dirty like that... My close friend from University and I decided to go to London as a trip for a week, she said she didn't recieve her paycheck from her work yet so she couldn't help me pay for the hotel stay (which is expensive) so she asked me if I could pay it fully and then once she gets her paycheck she would transfer her part back on my bank account. When we were in London I noticed she actually wasn't that broke after she started buying expensive stuff from victoria secret. I asked her if she made the transfer and she said yes, 2 days later I still haven't gotten anything (in my country it shouldn't take more than 2 days to receive your money). She started acting weird and said ohh idk maybe it's the bank's fault bla bla bla... I started to stress out cause I was running out of money and I really relying on that money so I could have enough for my trip. She gave me every excuse not to make transfer in London and I even threaten her to kick her out of the hotel considering I fully payed for it. I didn't and later we returned to Belgium, and she kept making false promises for a whole month. I just couldn't believe my OWN FRIEND would do this to me and watch me suffer in London worrying about if I will have enough for a meal or not while she enjoyed her tecnically free stay trip. Just a week ago I told her that if she didn't send my money I would go to the police, she said "oh come pick it up if you want it so bad". Really?? it was so easy for you to ask for it but now I gotta make effort and go all the way to another city to get my fucking money back. I told her to do a last transfer and gave her 3 days to do it otherwise I would make a declaration and it would be a bigger problem. After 3 days she finally made the transfer and we blocked each other everywhere. Now was that money really worth our friendship? I don't understand

Oh man. It's the worst when someone owes you money and they don't pay you/say they can't pay you back yet you see them casually spending money. It sucks you had to lose that friend, but at the very least you got your money and saw her true colors. The next person she takes advantage of might not be as nice as you were!

Hello, This was so good & helpful. I am taking someone to court who asked for a $2,000+ loan. Now for them to pay me back when they Claimed they would & refusing to pay me. they was given enough time to pay back the loan. I get threatened & cussed out for my own hard earned money. I have all my paperwork & proof, evidence. I am ready! to take them to court Glad I found out this video will let you know how it goes

I got a divorce which was also super tedious. At the time, we lived in different cities and I don't have a car. He was not interested in doing ANYTHING for himself in getting divorced (figures) but it is easier and faster if both people just sign the bloody papers so I paid for us both to file, had my mom drive back and forth with the stupid papers, and part of the deal was I don't sue him for everything he stole from me since he emptied the bank account and the apartment we shared. Because of this, I have no advice on collecting but I can relate to the super annoying paperwork and how it can feel like there is always another step you didn't know about.

Dudecito, call up the people's court, since you are both social media influencers they will still take you and if the deadbeat shows up he can clear his debt, its in his best interest to go too. On the flip side you are doing so well out of Cyr's shadow, hope you don't dwell on what a creep he is too much, just thinking about him is going to take you to a dark place.

It's safe the take the approach of don't lend it if you can't afford to not get it back, with the exception of course of someone you trust at the highest level. You can still get burned, but loaning out money that if not paid back puts you in a difficult monitory situation

Lol they’ll never talk to you again. 🤦🏻♀️🤷🏻♀️ ps I’m very sorry this happened to you, I’ve experienced it before but it was never a crazy amount of money. I don’t believe in lending people anymore. I’ll buy them gifts, pay for dinner and other shit and they’ll do the same back but nope. I’ve seen money destroy my family and I’ve seen it ruined friendships.

Rae Annabelle I live by the same rule. If, and that’s a big if, I ever loan anyone money, it’s money I don’t absolutely need to live on. I loan it with the expectation that I’ll never get it back. I never consider buying someone dinner, a movie ticket, or other smallish item as a loan. You’re just asking for trouble by expecting to be paid back for things like that. Plus, I don’t believe anything is a loan unless the parties agree beforehand that it’s a loan.
