However, the law also states that a "School Zone, is no more than 1000 Feet" And if you give me a ticket for something that breaks the law itself, who is the real law breaker at this point? These Cameras are already under investigation in numerous counties for issuing citations for school zone violations OUTSIDE of school hours posted. stay in your lane buddy, I'm 42 and got my DL at 16 and I have YET to get a single citation for ANY reason, including speeding.

In my opinion, if a speed sign is posted, you follow it. They even let you go 10mph above speed limit.... is it really that hard to follow speed signs? If anything the city should just change the law back to 2000 ft.

Several years ago I was driving down a road doing the speed limit in Altadena Ca. 45mph when children are NOT present, 25mph when children are present. This was about 5pm and there was a cop in the middle of the street directing everyone, everyone to the side. Thought maybe there was an accident. While in this long line of vehicles one of the cops walks up to me and asks for license and registration. Asked what’s going on and he said I was speeding in a school zone. When I told him it’s long after school was out, he just said tell it to the judge. When I was in the area again the next day I stopped at the school to check the hours, 7:30-3:30 were there hours. Got a card from the counter person and weeks later took it to court with me. Turned out the whole court room was full of people that got tickets that day and has been all day long. My turn before the judge to make my case with the card, pictures and time written on ticket. Judge said he doesn’t look at evidence in traffic court. My word against the cops. When I said that seems like a scam he threatened me with contempt. When I told him I’d like traffic school to get the ticket off my record he told me when I chose to fight the ticket I gave up my rights to traffic school. The whole court room was full of people going crazy at this total scam. Never forget that BS.

We have a similar situation around Chattanooga where it’s not uncommon to have a school zone with no school anywhere in sight. Fortunately word has gotten out that the automated camera tickets are not valid in Tennessee so people are starting to disregard the tickets when they come in the mail.

Several years back I received a radar ticket from the Beaverton, OR police for 35 in a 25 (no school zone). One savvy motorist found that the radar van was set up one block outside the Beaverton city limits. Their limit was on the west side of Target and the van was on the east side of Target. Received a surprise letter in the mail with a check from the City of Beaverton and a Xeroxed letter of apology from the mayor. All citations for that day were refunded AND DMV ordered to remove the violation from all records of those cited. So proud of it I hung it in my cubicle at work for a time with a small sign above it saying "score one for the common people".

I was mailed a traffic ticket from a place I had never been. Hoffman Estates, which is near Chicago, sent it in the mail. It was a ticket for a rental car I had returned a week before the ticket was issued. I was in Chicago on business the week before that. The rental company even charged me an administrative fee for getting the ticket. It took 2 months of mail, emails, and phone calls before all was fixed. And it was only a $100 ticket for not coming to a complete stop before turning on red. A victimless crime. Its all for revenue.

I've beaten these unlawful camera tickets where I live in Cleveland, Ohio. I'm excited to see people do their own research by studying what the law says and using their own codes and statutes against them. It's to bad most people are believed they can't seek a remedy in court or thinks they have to hire an attorney. I was also happy to see the judge rule based on the facts and the law. Mad respect for that judge, I'm proud of him, because there are judges that don't want pro se litigants winning in court. They view us as being stupid or anti govt. Sick of hearing that argument when people served and died for this country to allow us citizens to challenge the people they swore to protect us. I'm disappointed with the city saying they don't care what the statute says and their going to continue to do this. Which means the powers at be that swore to protect our rights will choose greed in order to gain revenue for their political subdivision (city to the ones that don't know law). I hope people go to their city council during an open forum meeting to address this, but they'll sham you mostly, but hopefully someone is smart enough to hold them personal responsible. I got a ticket a few years ago in CA for doing 35 (the posted limit on that street outside of school hours) on a weekend, during the summer, at around 11pm. The judge upheld it saying the sign said "When children are present" which means children can be present any time day or night as that is their safe space. I took it to the next city council meeting and demanded they change the speed limit on the street to 25mph if that was the case and they refused saying it was the drivers responsibility to decide if they needed to slow down outside of school hours.

I told him it was Saturday and the school zone sign said only when children are present. He was rubbed the wrong way but had to let me go.

So legally it is this, if it is a city law, you have to pay, as the judge is correct, as children may be present. However, if this is something that affects a code of law with the DMV, as in their publications it specifically has the code of law, and the definition, to which that usually would stipulate during school hours. If that is the case, you can appeal on those grounds, and the case would be dismissed.

In the early days this got a few tickets tossed. The officer couldn't say they saw anything themselves. Later they decided the signature meant the officer witnessed the contents of the photo as valid and this was considered good enough in most jurisdictions. Those that had laws that required witnessing the actual violation in person (or wording the courts wouldn't accept meant seeing a photo counted) Took longer to update their statutes. There are still a few jurisdictions where you have a way to refuse the validity of the ticket or some such. So basically it's optional to pay them IF you do the refusal correctly. That last is pretty rare though so check with a lawyer first for that or anything else legal. I'm not a lawyer and not giving legal advice.

we had that in ohio until they changed the law that said a police officer had to be present when the traffic camera caught the supposed violation. some places still use them, but in my home town in particular they just shut them off because of that ruling, and conflict in the appeals process if you wanted to fight the ticket.

The argument about it being cheaper to just pay the fine doesn't appear to include the increase your insurance bills will get for getting a speeding ticket..

Good point, but it may not involve the insurance at all. I've had a family member get a red light camera ticket and since no police issued the ticket it didn't involve any points added to the driving record nor any notification to the insurance company. I don't doubt that it's probably different for each state.

So let's say at approximately $75 a pop, the city of Atlanta raked in almost half a million on improperly placed cameras and illegal tickets. SMH.... who's benefiting from those funds, there needs to be an investigation into them, the camera placement, DOT (state and city)

Can we follow the money? If you map out the location of the school, revealed in the citation shown in this video, you will see that there are no areas at all within 1000ft, and thus, no way to make money without expanding that circle.

If you really want to see a bad one, go look up the N. Slappey Blvd. cameras in Albany, GA. A five lane 45mph road with NO flashing yellow lights to even warn you there's a sudden 25mph school zone, and the school is on another road and nowhere near that main highway. Thousands of tickets dished out with residents threatening a class action suit against the city and the camera company. It's a huge mess.

The letter from the school (3:17) only shows that speeding tickets declined not that any accidents/incidents involving the school staff or students did so. I hope the school/city gets sued and has to give all of that money back with interest.

How can that street be considered a school zone when the school is as they 1600 to 2000 feet away on a whole different street. It is nothing but a cash grab, $75 by nearly 6k people. That's almost half a million dollars.

Hundreds of miles of roads are mislabeled with speed limit signs that are placed by the locals, and not the state. It would be a really good idea to check on the actual speed limit set down by the state on that particular road.

Here's the caution on that one. Many such laws have "or such (lessor) limits as the dot (and/or local municipality) determines" so if the official law defaults a road to 50 and the dot in it's official capacity places a 35mph sign for a stretch of that road and you do 50 anyway the ticket will be valid. So double check with your DOT and/or lawyer if it matters. A handmade sign from nearby landowner who also wants you youngens to stay off his lawn doesn't count, and an HOA printed and placed sign at worst gets an hoa fine for violations (NEVER LIVE IN AN HOA). Sometimes municipalities think they have more authority in this than they do, usually smaller ones run by ego's vs brains. And sometimes a sign is not in the city limits even though they thought it was when placed. I know a guy got pulled over under that situation once. Lawyer went into court and pointed out the sign almost a mile outside town the cop parked next to it and pulled him over still a half mile from town. ticket went bye bye. Took a few more cases before the sign finally got pulled. I think a miner state official got caught and raised a stink.

It's not a legal ticket unless it's served to you by a law enforcement officer who personally observed, estimated, and verified the violation and contacted the driver and verified ID.

@@KingFergus The right to confront you accusers merely means they got clever on how they define accuser Is the officer or his radar gun your accuser? The reasoning behind enforceability of these speed cameras is that they now require an officer to look at the speed reading and photo and sign off on them unless there is clearly and issue. This makes the officer your accuser. A bit of a stretch, but not as obviously a 6a violation. This is why fully automated systems where all a human dose is reload the paper and envelopes and ink in the printer can often be successfully fought in court. Especially when entirely done by a contractor who often gets a percentage of the take.

@@KingFergus that amendment has nothing to do with speeding cameras. The cameras were there for awhile and “grandfathered in” it is clearly posted, so if someone speeds that is their fault. If the camera is against the laws of the town then you need to go through the proper channels about getting it removed. Not sure what the amendment about a criminal defendant having a right to a speedy trial, a public trial, a right to a lawyer and a right to know who your accusers are has to do with speed cameras. FYI I have a degree with a focus in constitutional law. You are just being ignorant and I am done stumbling on stupid. Have a good day.

We used to have cameras like that but most of the tickets were dismissed because the cameras didn't show up to the hearings to testify. Something like that but they got removed.

There was a sign marked with a 25 MPH speed limit and these people continued to speed. Moving the sign 1000 feet closer to the school isn't going to make these law breakers any more law abiding.

Cities near me went all-in for red light cameras. What we finally found out was that they shortened the yellow light duration. It was private companies that installed and contracted with the cities to collect the fines.

We have a school zone in our neighborhood in OKC. 25 mph "when children are present." As far as I know, the speed limit in the entire neighborhood is 25 mph.

The State Law defines a School Zone as being up to 1,000 feet from the boundary of a School Zone, therefore a school zone camera installed at 1,600 and 2,000 feet from the school are not LEGAL!!! Therefore every Ticket issued by these 2 Cameras are not Valid and must be cancelled, expunged from the Driver's Record and the Fine refunded...

These school zone cameras are turned on well before and well after school start and end times. Why? There few to no kids walking during most of this time. The longer the cameras are on, the more money is collected.

School zones are typically operational from anywhere between a half hour and an hour before through a half hour to an hour after the school start and end times. This is because children (shorter legs than adults) are walking (not driving) to school, which takes time. The school zone has to take into account children needing time to actually get to school, and providing a little bit of a cushion should they happen to be running late. Just because there aren't as many children crossing at certain times doesn't mean that they don't have to take these considerations into account. The cameras only make them money if people feel the need to ignore the speed limit signs. What is so important that you can't slow down for a block or two? And I'd question your judgment if you think the school zone doesn't need to be active because there's only a "few" kids walking.

After a trip to OH, I was mailed an $85 ticket with an image of me following behind 6 other cars at 31 mph after just having turned onto the road in front of a school with no speed limit signs after I made the turn to warn me. Not one policeman would have pulled any of us over at 31 mph any jury would nullify this ticket. Thank God my State does not allow this kind of entrapment and uses actual law enforcement officers to enforce the laws.

This was a problem 40 years ago. The town I grew up in, the law was that roads near schools were maximum 25MPH (but could be set lower by posted signs). Default speed limit if not posted, 25MPH. I was driving down a street marked with a speed limit of 35MPH. I passed a local cop obviously running radar. Didn't think anything of it as I was driving exactly 35MPH. To my surprise, the cop pulled me over and told me that I was speeding. So I told her that the posted limit was 35MPH, which is the exact speed I was driving. She then told me I was in a school zone, so I had been caught 35/25. Now, here is the problem. The closest school to where I was pulled over was 1/2 mile to the East. I was on a road that was oriented exactly North/South. The problem is that the law wasn't specific enough. The cop claimed I was near a school. I guess 1/2 mile from school is near enough, even though I couldn't get to the school without making several turns, and I was far from the school, getting farther away?
