Perhaps not, and I'm not defending any of this here, but the statement and confirmation of "YOU CANNOT CANCEL YOUR SUBSCRIPTION WHEN YOU MAKE THIS DECISION" looks to be more of a legally-binding contract. They could defend on "we made sure that you agreed to the terms before you made this decision".
