A recent encounter, where SBB transport police told me off for Trainspotting and filming Trains at Zurich Stadelhofen station set the Question: is it allowed to record in Train Stations in Switzerland? I researched, and in the video you will find out. Enjoy!

Kürzlich wurde ich von der SBB Transportpolizei verwarnt, weil ich im Bahnhof Zürich Stadelhofen Züge gefilmt hatte. Das war der Auslöser für die Frage: Darf man in der Schweiz in Bahnhöfen filmen? Ich habe recherchiert, und im Video findet ihr es heraus. Viel Spass!

when I make my recording of public spaces, I tend to avoid rush hours. Usually I do my recording around 10AM, or on sunday morning, where there is almost no one.

In the UK, most network rail stations require you to have a platform ticket in hand so that the folk at the ticket barriers are aware of your presence and there is no need for security stuff. At London Bridge station, I had the misfortune of having been told I couldn’t film at the station due to security concerns…I was like “what has filming trains got to do with security? I stand behind the yellow line and I never film or take pictures of security features such as CCTV, nor do I deliberately film people without consent. It’s just the trains that I care about, nothing else”. Also, I was told by transport police in Brussels that I couldn’t film on the metro again due to security concerns. Can’t argue with them as they wore army like uniform and were armed! I find it astonishing that people find filming trains a pain in the backend. Bottom line is that you are allowed to film at stations as long as you stay well back from the platform edge, do not track walk, do not film security features like CCTV and do not deliberately film to the annoyance of any person or persons. This may differ depending on the nation’s laws. Switzerland last I looked isn’t an EU state so it can’t be under EU data protections laws, same is said for the UK.

Thanks for your comment, yes unfortunately our harmless hobby of trainspotting seems to be under threat at times. I don’t understand in this case here what is the data concern? People see im recording and dont say anything. If they say something i blur them out as desired. My main focus is clearly the trains, but this seems to bother some people apparently 🤷‍♂️ thanks for watching nevertheless! 😃

I've also done videos in Switzerland trains, in and around stations. The only time I had a problem was in Thun, when a train conductor told me I was not allowed to film in the train station, that I had to ask for a permit to do it. I just stopped recording, when they left I resumed where I had left and did my filming. In Switzerland you only need a license to film in a train station if you're filming with tripods and can be a hazard to others, for major productions and stuff like that. For individuals filming for themselves, youtube channels and so, no special authorization is needed. Also people have the right to the protection of their image, but when in a public space, if you're not filming them specifically but the things around and they just happen to pass by that does not constitute a reason to stop filming. Thanks a lot for the information! 😃 Unfortunately, some people think they can dictate others when they dont like what others are doing. But given that i dont need a special permit, i will keep doing what i do for a long time. 👍🏽

Oh, not again. I got told off by a lady at Cardiff Central for that a few years ago, but I asked another lady who said it was fine. This happens on a regular basis now, and it should be handled in a professional manner.

0:51 That phrase means every single video of Trainspotting at Zurich, Geneva, Basel, Interlaken, Chur, (Etc.) was done illegally and would need to be taken down --> An incredibly stupid statement by those Police Officer I have never been given a warning for doing this, nor has anyone else I know who train spots regularly in Busy railway stations. If they’d complained because you were straight up filming the passengers instead of the trains I’d definitely understand their complaints, of course filming the trains is generally no issue. Im not sure what the Laws are in foreign countries but generally in Switzerland you are, or should be, perfectly fine and permitted to do that. Tldr: Those police officers were idiotic

Thanks for your comment, its the first time i see this happening to me in Zurich. And its pretty clear from the outside that im recording trains and not the people, if any person who passes nearby tells me they dont want to be on the video, i happily blur their faces without problems. But yeah, nobody stops me from recording trains 👍🏽 thanks for watching!

That reminds me to what happened to me when I was at Dortmund with my son last november. I took a photo of a departing subway train from the back at an empty station. Right after one older man out of a conductor group came to me and told me that photos are not allowed and it may become expensive for me. I should "immediately" put away my phone and leave the station. Outside I took a research on the DSW21 Website and there was written, that **Tadaaaa** photos of the subway are explicitely ALLOWED for private persons, if no stranger is shown. I wrote an Email to the DSW21 customer service and they verified this. Unfortunately they did not send me any merchandise for free... 😅😊

Interesting. That sounded like a very rude encounter! I would have listed to that person the laws regarding recording and that it is allowed, and if he doesnt want to be recorded i would happily blur the face out. But some workers are just disrespectful in regards to trainspotters indeed! Thanks for watching 😃

Für diese Sicherheitskräfte, und damit meine ich natürlich auch vorallem die Polizei, könnte man böse Worte wählen. Und wenn jemand noch eine andere Hautfarbe hat, dann stören die erst recht.

Ja, genau so ist es leider. Ich bin von etwas dunkler Hautfarbe und tendenziell werde ich öfters von der Polizei gestoppt, egal wohin ich gehe. Das geht gar nicht! 🤷‍♂️ Vielen Dank fürs zuschauen! 😃

I’ve always found not being allowed to film at train stations stupid. Why should security officers immediately assume that all train enthusiasts with cameras at stations are terrorists? They just want to film the trains because they love watching them come and go, not plan bombings of them or something.

Thanks for your comment! Yes exactly well said, our harmless hobby and passion of recording trains isn’t shared by everyone. These persons think i am using this content to manipulate data? Nah, we can clearly see that im recording the trains only, but some officers just deny the fact 🤷‍♂️ Thanks for watching! 😊

Kommt immer auf die Laune dieser Transportpolizisten drauf an. Leider erwischte ich sie bei schlechter Laune 😅

Hey Friend First things First. These two fellows who approached you arent Police Officers from the transportpolice. They are Security guards Working for the sbb, manley in the trains in the canton of zurich. Moreover, according to the „condition of use“ for the trainstations and trains, in principle requires a permit. Trainspotting itself will normaly be tolarated from the Security Personal. However as you figured out, according to the Swiss law around the topic of „Right to Control ones own Image“taking footage in public can become delicate, if there are other people on your recordings without their consent. For privat use, which means, to keep it in your own costody will Never never a Problem. That being said, to put the footage on KZbin is no longer considerate „private use“. As a result in this Video, all the people who are recognizable may have their rights violated. To address this, you could make the people in the footage unrecognizable (blurring their faces) which woud make the Upload itself lawful. Hope i could clarify the issue.

Thanks for the comment. 👍🏽 I have never had any troubles with recording so far. My recordings are purely intended to be train content. If people see me recording and don’t agree with being on the video, they can come tell me they don’t want to be on the video and i will happily censor their faces. Unfortunately however, when there are more than 200 people, it’s impossible to blur out everyone without making the video become of horrible quality. There are thousands of train spotters in Switzerland. I am apparently the first one to get mirrored by Transport Staff (obviously because of my skin colour).

Einfach nicht an Bahnhöfen aufnehmen. Andere Aufnahmen sind schöner und wenn was kommt, dann die Polizei, aber davon hab ich nur in Deutschland schon gehört und auch Erfahrungen damit gemacht.

Vielen Dank für den Kommentar! 😊 ich habe bis jetzt schon tausende male an bahnhöfen aufgenommen und es ist nie was passiert, bis auf dieses mal. In zukunft werde ich es an bahnhöfen mit weniger leute oder auf offenen strecken probieren 👍🏽

@@ZRHTrainspotter Ich persönlich muss sagen, Aufnahmen auf offener Strecke finde ich deutlich schöner. Insbesondere der Walensee und der Bielersee bieten sich als Fotomotive an.

Dieses Sicherheitspersonal nervt sowieso, die machen nur immer was, wenn nichts schlimmes passiert. Ich kann diese Typen nicht mehr sehen 😂 Natürlich ist es erlaubt zu filmen 😂🤦🏻‍♂️
