Some question(1) Do all NPA go through IBC? Or is it upto committee of creditors to determine what path to take? Also what criterion determine NPAs will go through NPA. (2) If IBC is better than sarfesi or 5/25 scheme, why don't govt simply repeal other acts?

1. No, the creditors decide the recovery legislation. It can also be under the SARFAESI Act, RDB Act or even Civil Procedure Code. 2. IBC is not better or bad when compared to SARFAESI. Both have their own pros and cons, the creditor seeks remedy under the legislation that suits it better. Like take for instance, under IBC a creditor can directly file an application before the adjudicating authority (NCLT) for recovery whereas under SARFAESI, there is a waiting period of 90 days which is basically a window to the debtor to clear all his debts. There are also other provisions that affect the suitability of the laws to the creditor. Practically speaking, SARFAESI is sought more often by the banks.
