I think the main thing is to issue a warrant if it is judged he is complicit in war crimes. That would have it's own power. Anyone with integrity that believed in the rule of law by the ICC, would hand themselves in. Nowadays, I think very few people have any expectation that the president of the USA has any morals, ethics or integrity of any sort whatsoever.

In the ICC, there can never be equality between the victim and the perpetrator between Israel and Hamas, because Israel is an occupying power according to international law, while the Palestinians have the right to defend their land by all available means.

Agree. Hamas didn't even attack Israel under international law. It is Palestinian occupied territories that Israel annexed illegally. These people had no right to live there in the first place.

I think that is mostly true for the ICJ, but the ICC tries individuals. Whatever right Hamas has to attack the state of Israel, they don't have a right to attack unarmed civilians. Not all means are available. As such, individuals leading Hamas are culpable for the acts of their combatants against civilians. Being occupied doesn't absolve them of that. Of course, Israel as a state should be sanctioned and Palestine as an occupied state should not, but that isn't the same as saying Palestinian actors did nothing wrong.

There hasn't been an investigation so there are no facts or evidence. Just a punch of lies. There is a reason why Israel refused to allow investigators to investigate Oct 7th. Second, these civilians are occupiers. They knowingly moved and settled into homes built on the rabble of Palestinian villages, bodies, lives. The majority of them serve or have served the occupation military that continues to commit crimes against these Palestinians on daily basis. You can be sympathetic to the colonizer all you want but don't expect the rest the world to see it moral or just.

I think it's fair to say that many of the crimes levelled at Hamas could also be levelled at Israeli officials. That is not to excuse Hamas' responsibility but for example, rape, cruelty in captivity and other horrendous crimes committed by the IDF. More warrants must follow. I do wonder how effective they are seeing as there is nobody to enforce them.

Great episode and job as a host! Very refreshing to see some new faces up front. At 13:45, the idea of a "international rules-based order" is precisely the term that's used (especially by the US) instead of International Law to elide, weaponize, and distort their obligations under IL, and project their own power. International Law is not just about rules that come out of thin air, and especially in IL where rules are often defined by the powerful, only appealing to abstract rules without the context of global legal community/culture/treaties/processes only empowers that hegemony, excluding the other aspects/actors of International Law. International Law is a very idiosyncratic patchwork, and works horizontally against/alongside/through vectors of politics and power. But it's important to look at specific international bodies on their own terms, and keep in mind that analogies to vertical national/supranational legal systems often do not fit. It's easy and justified to question IL's utility, and there's a lot to complain about re the ICC - aka the European Criminal Court of Africa given it's historic lack of prosecutions against Europe/Israel - but this is one of those moments where a court can escape/build on it's history to forge a new path and breathe life into what were dormant/empty legal norms.
