Good, relevant topic. Well done. I just want to ground the basics (not legal advice). 1. ‘Idea theft’ is certainly morally wrong but is not really theft, legally. Reason is 2; 2. It’s a maxim of Intellectual Property Law that, “There is no property in an idea.” Means, no ownership or possessory right. If there’s no ownership or possessory right, there can be no theft. 3. You can guard a valuable idea by treating it the same as a Trade Secret. Ie: Hide it and take the risk of revealing only to trusted persons, until you can transform it to a form that you can apply property rights over. 4. To transform an idea to property, you need to transform it from being a mere idea: Write it down (script), and you can have Copyright over the script. Describe and register the invention, and you can have a Patent over it; Design it, make a prototype, perform it, and you can have multiple rights over it including Dress Design, Copyright, and Patent over it. 5. Most violations of traditional property right (eg: right over your car or shoes) is criminal and so can be policed by the State and litigated in criminal court. By contrast, most infringements of intellectual property rights are not criminal. So, you have to police it yourself and pursue those who infringe on your rights in civil court (which is unfortunately expensive and difficult). Even then, most of the time, your remedy is limited to tapping into any money they made with it, or to obtain cease and desist order. 6. Some intellectual property can be lawfully copied without your permission (eg: for small-sized personal use that does not hurt your brand. Personal use means the copier does not have a profit motive and your copied work is not a significant portion of copier’s entire work). This is ordinarily called fair use.

This is a good topic and I think time stamp is one of the best Ideas , You can easily accomplish time stamping by sending yourself an email or text containing the gist of your idea. If your idea requires a longer description, create a time-stamped document, and save it in a designated file. Time stamping shows exactly when you thought of the idea and helps prove that you did not steal an idea that’s already “floating” around in cyberspace.

I stand corrected but I think no idea is new, no matter the idea you have, someone else have something similar. However, there's no justification to someone stealing his/her friend's idea that was shared out of trust. If you'll implement it let the person know, ask how they'll feel if you do implement it, if their response is positive then go ahead to implement it but lastly always give them credit because i feel the major annoyance is when you don't get credited for something you own or even contributed to. My best KZbin podcast i love the show even though sometimes i do not gv a 100% to somethings you guys say but that's what makes us humans right, but the honesty is top notch. Kudos

So I experienced idea theft sometime this year when someone I was making wears for was rebranding them and sell as hers, she even had the guts to send me a message asking me not to post the clothes I make for her. I was beyond shocked so now I’m learning about patent laws and copyright so I can protect myself next time

@Nedu is 100% right, it is extremely rampant on this side of the world, creatives suffer a lot from this, but if you have spent as long as I have in the tech world you will know how bad this is and how these guys do it boldly, even after signing NDAs. The funny thing is patenting an idea takes about 150k, and you can literally walk into most of the federal universities in Nigeria to get a patent, trademark or copyright, but Nigerians have a culture of signing documents and then going back on precisely what they signed, trust me, I have seen quite a lot.

This idea theft thing ehnnn... In the world of tech it's something else. Most of us are just small boys without good funding, even when we decide to do it on our own, promoting it costs a lot! Just like there are many apps on your appstore that can do crazy things but you don't even know them, you only know the ones you hear of. Sharing these ideas with people, they'll take it to their companies, tweak it a bit, and then boob! The app or digital service by so so company is everywhere 😓.
