The latter would be fair play under warfare standards, as you said, but I’m not sure the conflict was significant enough to count, especially since neither Sera nor Lucifer explicitly declared war; the Angels were doing a routine job and the Hotel staff were defending themselves. (And most of Hell by extension, but that’s not the point) Funnily enough, if we do follow warfare law in this scenario, Niffty would be the most guilty for killing a defenseless enemy.
