Because technically Rapunzel was tied up by Gothel and Gothel used Rapunzel's hair to let Flynn in with a false sense of security, which made him easy to kill.

Maoi sure had a lot of crimes under his belt there. And he never got pardoned for them. Eugene at least got pardoned for his crimes for saving Rapunzel. But since he's also the hero of the movies it checks out even if the sentence is still the same.
