"NOT LEGAL ADVISE" Insane automatism would be a valued defense, however, in consideration of the element of men's rea, the prosecution could easily say he is a danger to public safety. The Actus reus is obvious "but who's to say it was him?" where you can create reasonable doubt that can cause an interesting situation. Keeping in mind the witnesses are sometimes killed, and the mental state of the witnesses(s) could be argued against in cross-examination. Also considering the witnesses(s) is extremely important, who can testify properly? and who can remember all the information? Insane automatism would have to be studied by expert reports, considering the (voir dire) principle to show the court that the defendant still needs mental cognition. He needs to understand that his actions are illegal in a just, reasonable society and the punishment that would be brought forward. Depending on the jurisdiction, including for example: R v. Vaillancourt (1987) (CANADA) states, that where jail is a possible criminal sanction it would be evoked to have at least a minimum level of a mental element "being mens rea." and from the principles of fundamental justice and the right of liberty you could have an interesting hearing on that basis through mental health. - but it would be interesting to see a trial within this kind of position.

it'd be a very, VERY thorny (hah!) issue to unravel, for sure. On one hand, it's clear that Michael is developmentally arrested to some degree (why and how depends on which timeline you prefer), as he sees what he does as child's play, a game that he enjoys but no one else seems to. On the other hand, it's explicitly clear how much of a danger he is to others, and how urgent it is that he be kept away from society at large, possibly for the rest of his life depending on, again, why and how his "evil" came about. Permanent or near-permanent institutionalization seems to be the only real choice for Michael here--preferably in a ward with VERY highly trained, and plentiful, security.

Is Micheal Myers aware of what he’s doing? I know that sounds like a dumb question, but is he aware of anything or is he just a pure killing machine and more like an embodiment of death itself? I’ve only watched Halloween 1 and 2, the original films, and I think it’s pretty clear that he is some sort of supernatural entity evidenced by the… extraordinary amount of beatings that he takes in the movies. My point is, would he even care if he was put in prison for his crimes? He’s already escapes the law many, many times, so he probably wouldn’t care all that much.

Excluding the sequels, a friend once told me that Michael Myers would be found innocent. He seemingly lives in catatonic state with random unpredictable bouts of violent behaviour, with possible dissociative identity disorder. Personal culpability, questionable🤔 No staff seemed to know this except Loomis, who diagnosed him as “evil”...Not a legit diagnosis 😄 Did he keep this information from them? Why? So after Michael’s Halloween rampage - Michael should’ve been reinstitutionalised. Smith’s Grove - Sued. Loomis - Struck-off & possibly arrested.

Id argue Michael seems too lucid and aware to be found not guilty by this point. A case could be made as a child, but after his first escape, he shows that he is fully aware of what he is doing, being able to plan his escape, hijack a car, mask his identity and then stalk and murder like 6 people with elaborate planning that would require significant intelligence and awareness of the current situation to pull off. To be found not guilty on reason of insanity, you would need to prove that he was not aware of his actions and thus lacked criminal intent, but everything he does after escaping is far too calculated and full of murderous intent for him to get off on insanity again id argue. The only thing he has going for him is that he goes catatonic and doesn't speak after.

0:45 That actually may not be murder, a lawyer could make the case to a jury that it was Manslaughter, rather than murder, given that murder is premeditated. It would really depend on if the defense can show evidence that supports what his Mens Rhea (or state of mind) was at the time. While it really wouldn't change MUCH, the sentence might be lessened. Also, given it was his first offense, its possible he might recieve a lesser sentence as well. (However, every subsequent kill after that is another story entirely)
