Actually, from what I've seen from Gooseworx, Caine isn't the one kidnapping them or making them go insane. He's the antagonist but he's not a bad guy. He's also trapped in the circus, he's making them go on silly adventures just so they have something to do and not lose their minds However yes, he still committed murder

Personally it's not fair to charge Caine, since we only have pilot and we don't even know if he is the one putting humans in the game in the first place, also Pentious tried to kill Charlie, Vaggie, Angel, Nifty, Husk along with Alstor, so 4 first degree attempted murder and an attempted Regicide (since Charlie is a monarch)
