*🔹Understanding of Immigration Appeal Hearing:*
An immigration appeal hearing is a crucial legal process that allows individuals who have received a negative decision on their immigration application to challenge that decision.
If a UK visa has been refused, the applicant might be able to appeal to the first-tier immigration tribunal.
Immigration appeals can be on paper; in this type of hearing, you present your case and all evidence in the form of papers to the judge.
You can also appeal and request an oral hearing; in this type of hearing, you attend the court in person with any other supporting friends, family members and other witnesses.
*🔹What happens at an Oral hearing?*
In an oral hearing, you would usually be represented by your representative Barrister and the Home Office will be represented by a Presenting Officer.
Your lawyer will make legal arguments to support your case. And Home Office lawyer will make legal arguments to support their case.
The judge can ask any questions to the appellant in addition to the lawyers.
*🔹Which Visas can be appealed?*
Family visa applications and Long residence applications, which include family and private life applications and some European applications, can be appealed.
*🔹Which visas can not be appealed?*
Nonhuman rights visa applications can not be appealed. Some examples are Student visas, Skilled worker visas, Graduate visas, and Charity worker visas.
*🔹Positive points at the Court:*
Anyone who wants to come for the moral support of the appellant is allowed to come to the court.
If the appellant or witness needs an interpreter, they can be provided with one at no cost to them.
The appellant can ask for gender preference for the judges to be heard.
