Sir is it mandatory for wife or her advocate to follow the exact guidelines/format of SCmandated Rajneesh vs Neha affidavit format? In one of the maintenance case in the wife's affidavit the individual questionnaires and Declaration part has been completely tampered in complete meaning and interpretations. Could the wife be liable for criminal prosecution?

Hello Aman...now a day, court is taking notice of such transactions...and if these transactions are done just to defeat the rights of a female or wife like rights of maintenance or right to residence then court can give the female that right irrespective of those transfers...like right to residence...thanks...good luck...

Sir jaise mujhpe v fasle dv act & dowry hua hai. Sir jaise k meri maa ne mujhe apni property mere naam ki hai. But sir just registary hui hai. But uss property ka intkaal nahi hua hai mere naam pe. Aur sir agar main uski propert ki Fard v niklvata hu to wo abhi v meri maa ke naam per hi bolti hai. 2. Sir maine tehsildaar se v poocha tha to usne bataya ki jab tak intkaal nai hoga tab tak property apki mother ke nname se show hogi. To sir kya aaise jo property document mai abhi v mere naam nahi hai to kya main uss property ka jikar affidavit mai na kru. Hello Bharat..look this is an affidavit...so if she hides and you have got certain information that she has another account then she has done offences mentioned in the declaration of this affidavit and its punishable....but your information must also be certain and verifiable....so a complaint can be filed if she hides or gives incorrect info in affidavit...thanks...good luck...

Sir I have file an case against my wife and his parents on October under IPC 323,452,147,148,506,315. But due to awaiting report it's still pending till now, no hearing started. I have file case with all proof of cctv and documents proof. But now in December my wife file an case of dv. Now all councelling has done and case is gone on court. She file an false dv case on me. My wife gone from my house in September with herself only. That proof also I have. So how can I quashed it's FIR, and can I get benefits that I am file an case before her. I file an case in October and he file an case in December after 3 months. So can I get benefits of it. Please suggest sir

Hello Himanshu....case will not be quashed just because you file earlier and she filed later....it will be quashed only if its based on false facts...so if you can prima facie prove that allegations are false then you should go for quashing....good luck....

Hello Dupinder....every husband claims like this in court....court says that if you have married then taking care of wife , maintaining wife is also the responsibility of husband....in this case if 38k is expenses and 40k is income...then if wife come to husband how will he be able to maintain wife....court will look into all things but in a neutral way....court is much clever than husband or wife....good luck....god bless....

Hello dupinder....wife right to maintenance is all together different from her other rights....even if husband is not earning it is the responsibility of husband to maintain wife....its only in case of husband body disability that court can think in favour of husband....moreover whatever you said has to be proved by way of evidence....and evidence stage comes later so till the final decision of the case court will fix maintenance....your health problems can help you in fixing less maintenance but it very rare that it interim maintenance won't be fixed or declined by court altogether....good luck...god bless....

Mere beti ka Case 498a Aur treepal talak me section 4 ..2019 Muslims adhiniyam laga hai uske pati par Aur Sir abhi ipc 125 ke tahat case shuru hai Aur isi me Sir Supreme Court ka judgment ke Afidevit.. Me Aaropi parti ne uska property chhupa Lee Aur Zoote Afidevit Court me deeya.. Just.. 11/08/2021 ko.. But Harare Advocate Sahab ne argument kiya.. Bahot jumke.. Sub kagaj judge Sahab ko deekhaye.. My monthly salary 48k including shift allowance, broadband allowance.will it be included in affidavit or excluded . Hello Debashis....yes all these will affect the maintenance....as per affidavit...husband wife both need to file details of property held at the time of marriage....any property disposed after marriage....so the court will look into circumstances in which property was transferred...if the sole intent was just to avoid maintenance and such other things court will take due note of it...also all perks have to be mentioned in affidavit...post is also to be mentioned....even if you are working in bpo...but basically its the income or the sources of income that will matter....position of manager is not relevant it will be just for the sake of argument but the main thing will be your income and living status....thanks...good luck...god bless...

Sir, my sister and brother-in-law have filed for the assets and liabilities. The husband has issued few bank statements, not shown all bank statements including Joint accounts, parents flat. Should I file an reply application regarding the same and also do I give the balance sheet of all his papers I had with me to show his wealth MF his investments To my knowledge my father-in-law's property his office is given on lease.
