Blood draws are normal, it’s called implied consent. If a person refuses to give blood then the implied consent we read off of a card allows us to involuntarily take your blood after we obtain a search warrant for the persons blood. It’s all done fairly quickly depending on how quickly the officer can type. The national standard for DUI is 0.08 or more it’s not just Texas. You didn’t get bamboozled

@@QuarterNickelDime-ti6vpthe blood draw stuff is messed up for real, I had mine forcefully taken and they weren’t properly trained and poked me 10 times until they got it and were laughing about it. (And I have a phobia of needles so it was basically torture to me plus I was sober🤦‍♂️🤦‍♂️)

Btw to u and Ian, prison and jail are not the same at all lol & Ian didn’t even go to real prison, he went to a federal prison camp which is a 5 star hotel compared to a usp or state prison

Omg right? I had a fried who violated felony probation with commercial burglary and they got less time and actually only did 7 months in prison. They tend to make examples out of sone people imo. It’s not fair!

This is cool. I've been out of prison now for about 4 years. I ended up doing two prison bids. My first one was 8 years. My second one was 3 years. I have been in and out of jail. I bet 30 plus times and I went to multiple prisons starting in Wyoming. Also going to Sayre, Oklahoma and Pocahontas Virginia. I changed my life about 3 years ago. I'm a welder, a father, an addict in recovery and I'm so grateful for the life that I have today and I would never take back all the years that I lost because it helped mold me into the person that I am today

Man, her lawyer should be disbarred for encouraging her to take a *FELONY* over a misdemeanor smh. That entire thing about a DUI causing more problems than a felony, I've got no idea how that would be true. My friend has a DWI on his record and he still got his CDL several years later, outside of doing 90 days in jail, it's had zero long term impact on his life, let alone anything involving his driving privileges. I'd easily accept the loss of my license for a short period and do a bit of time in county over being a felon for the rest of my life, my firearm rights are wayy more important than the ability to drive for a year or whatever! This entire interview is nothing more than a perfect example of why the war on dr**s is a joke. She had a DUI and one pill, I don't care what it was, it shouldn't have resulted in her having to go to prison and lose her rights for the rest of her life! It was one pill, she wasn't Pablo Escobar 🤦

@@maymalone1505 I heard it, doesn't change anything. I don't care if she'd have blown a .50, there's only so much time they're allowed to give for a charge and felonies almost always carry more time than misdemeanors. More importantly, a felony can impact you for the rest of your life including your ability to rent, vote and buy a firearm while a misdemeanor is really nothing. There's something called "sentencing guidelines" and reguardless of what condition she was in, a misdemeanor DWI can only carry around a 90 day sentence in most states while possession of what she had is a felony that carries up to 2 years in prison and carries a fine of up to $2,000. Idk about you but if my choices are between pleading guilty to a 90 day misdemeanor and a 2 year felony, I'm picking the misdemeanor every single time!

This was a great podcast. I spend 18 month in TDCJ. It was cool to hear what it was like for females in the same system. I really enjoyed her honesty about being so naïve. I was the same exact way. I always thought I would find a way out of it until it all went down.

Wow, I can really relate to her! I also had a DUI, didn’t get arrested because I had a wreck and got hurt but ended up arrested for failure to appear (wrote down the wrong date because they surely don’t give you any paperwork!) I didn’t drink in high school and did very well in college. I partied in college but kept it together and graduated with honors. No one would have ever expected that of me but it can happen to any of us! Never drink and drive folks, it’s a recipe for disaster!!! Glad she came out on the other side ❤ very inspirational and another great interview!! Thank you for interviewing more females!

I was in prison in Texas from 2008 to 2011 . It was so horrible. The guards really were horrible to the prisoners. I've witnessed so much! And I have many stories or abuse and even murder by the guards you wouldnt believe!

She didn't say the name of the state jail was in but I can assume (because she said Houston) she went to Plane State. We called it the dog pound. I pulled chain the day that Hurricane Ike hit. I didn't go thru classification for 2 weeks after my arrival. I ended up going to Henley Unit which was on the same property and I still thank GOD for getting away from Plane state. I got out February 9, 2008 and I haven't looked back since. I'm glad to hear that you're doing well, Ariel. It's not easy for a female felon on Texas.

The reason you don't get good time in state jail is because state jail is flat time. No parole no time taken off. The day you are sentenced you have your release date as well.

What I've noticed. Every single person who goes to jail knows how they can avoid it. Then they decide they aren't going to avoid it. So they experience it. Then they get to decide if next time they are going to avoid it. Avoiding it myself, it's kinda better to avoid it than experience it.

For anyone that has dealt with Texas probation and parole know for fact that parole is WAYYYY easier to complete than probation. At least felony probation. Texas doesn't f around.

So much of her story does not add up. She is leaving so much out. In Comal county you would never get a 40k bond just for one oxy (2010) or whatever kind of pill she had. If she had no priors and they gave her a 40k bond, they found much than one pill. By the time she was charged, the amount was probably reduced to just one pill, but when she was arrested, it was probably much more. That kind of bond is for possession and intent to distribute. She was definitely selling to at least her social circle. If her felony possession case was going to get dropped after her three years of probation, that means she had a pre-trial diversion agreement for dismissal, which is a very very good deal on a felony charge. And it is better deal is they were going to completely drop the DWI charge because even if the DWI charge would be dismissed after successful probation, the DWI charge is NEVER dropped from your Texas drivers license record, and after the very least she is going to pay about 5k in additional insurance premiums. Not to mention that if she were ever charged with DWI again in Texas, her drivers license would automatically be suspended immediately for 2 years, regardless if she beat the DWI charge in criminal court. Sounds like she does not even understand that the license hearing is completely independent of the criminal DWI charge. She passes off blame about not completing the felony probation on, "she (her first attorney) should have known that I wasn't going to take the probation seriously." So when she didn't complete her probation, she probably kept using and selling to her social circle and when her first attorney found out, her attorney dropped her as a client because the attorney knew she was too much of a risk. And that is when she had to switch attorneys to the male attorney. She skips over that whole part. When her second attorney asked her to ride with him to the court that day, he KNEW that she was going in front of the judge for her probation revocation hearing on her non-compliance of her second probation, and that she was almost certainly going to jail. So either her life was still so chaotic with her pill use that she didn't understand that it was her hearing day (probably he told her and she received paperwork in the mail and from her probation officer that her court coming up) OR, he thought that she was a bad risk client and he set up the probation revocation hearing early. He was pissed off at her as a client and he just wanted to be done with her. As she was probably still missing classes and piss tests and had signs that she was still dealing and using. She couldn't handle it and totally broke down when she went on the stand because she was still using and dealing and the prosecutor caught her in a bunch of lies when she couldn't explain her non-compliance with the probation. Long story short, she can't/won't take accountability for what happened leading up to her incarceration and she very very likely will end up getting popped again. Seen it happen a million times. Until you can take accountability for what really happened and be honest with yourself and others, you are going to repeat the whole process again because you want to keep doing whatever it was that got you to that point in the first place. which in her case is most likely using and small time dealing.

It is crazy that someone raised in a 'normal' family with 80-90 college credits wouldn't realize seriousness of not following parole to get her charge expunged, didn't realize it was her trial, that her attorney didn't prep her for trial, that attorney didin't involve her parents (even if she was an 'adult') when she didn't take the 5 weekends jail/that she didn't realize she could get 20 months...Not sure if attorney was incompetent or if she was just that out of it.

Cops can do whatever they want. I got pulled over once for going a few miles hour by cop that flipped a U late at night. Had only one tall boy which I drank right before driving and am a pretty big guy 210-220 lbs, no way was over limit. Cop asked if I was drinking, stupidly I was honest and told him had one beer. Did sobriety tests fine, then had me blow into breathalizer like 10 times. Cop was getting pissed cause was blowing under. He decided to take me in to take a test at the station, later figured out because he was hoping my bac would go up. At the station I got surrounded by about half dozen cops and they started bumping me and trying to intimidate me. At that point I was like screw this, I already took a breathalizer and told them didn't want to do it again. They were oh great, just sign right there that you are refusing. They did not explain that test on side of the road was preliminary and only test at the station counts. Got charged with DUI and refusal misdemeanor. They gave me 50k bond. The bail guy was like wtf did you do? He could not believe it was only for DUI. He would not post bail until getting police report. Even after my bail was posted they kept me in there for an extra day claiming it wasn't posted, they supposedly didn't have papers. Kept calling bail guy and he was man I was 15 ft outside your cell and they have everything. They kept me in there for an extra day just because. I didn't talk shit to them at all. Had no priors. Had only 1 speeding ticket as a 16 year old and no traffic infractions in 14 years. Rough learning experience, over $10k, license suspended for a year and tons of traffic school. So yeah, if misdemeanor DUI can end up with 50k bail, felony possession of controlled substance can get 40k depending on who writes you up.

Lynnwood California county jail was sued for non privacy from the years, idk 2011-18(?). (Texas doesn't pay the state jail inmates for the work, asfaras license plates etc, preformed). It was like $2000 + per female. They performed these body searches outside with generally a curtain or nothing

Ian, you should interview a woman who has done institutional time in Texas (1st, 2nd, or 3rd degree felony) to contrast with Ariel's experience. There are similarities but also many differences. Texas may not have the worst women's system in the US, but it arguably has the toughest, with the heat, forced labor, and frequent strip searches. Texas still has hoe squads for women (may be the only state that still does that) and at the Hobby unit, women returning to their unit from working on hoe squad are stripped outdoors in a group in a sort of "corral" with privacy screens.

Yeah I did time at hobby was on the hoe squad the only reason she doesn’t think there is a difference between state jail and prison is because she has never been to prison lol her story would be very different she would have definitely been in fights. And about the squat and cough thing she would have remembered the flash light they use to look up your woohoo in a line of women with ladies dirty hygiene items laying to the side. But she is telling her story how she remembers it but it’s always funny hearing a chick never been to prison say prison and jail are the same as a women who did over a decade in prison.

That’s wild, getting that punishment for a first time drinking and driving offense. She must have mouthed off something fierce. I got an aggravated DWI in 2001 in NM. Totaled my car and blew a .2. Punishment: about $300/400 court fees and fines. I had to get permission to go to college out of state, do a 12 hour drink and drug course, a 3 hour madd class and one year unsupervised probation. I lost my car but only lost my freedom for less then 12 hours.

I don’t buy her sweetheart naivety!! Anyone who grew up in TX knows to follow whatever court procedures especially Parole. How many times was her parole revoked two or three?! She had access to the internet to know what was happening between the DUI versus a felony conviction being on her permanent record. Don’t blame her attorney?! Oh that’s a good question I don’t remember my blood alcohol level etc

Ian, you prove to be more and more ignorant every episode. Not sure if you live under a rock or if you have the average knowledge of most people. If you refuse a breath test, you are obligated by law to take a blood sample if you are suspected of a DUI. Any state, any person, no where is different. And the minute you refuse a breath test, your drivers is automatically suspended for a minimum of 1 year. You may have been to prison before but gosh sometimes, you have no idea about anything.

Wow she is the same age of my daughter. Me and her mom have the same brother and sister there is six boys and seven sisters. Weekend jail is not as common any more. There were some jails that were so crowded that you would check in Friday evening by a certain time, you would get credit for that day and then they would release you early Saturday with credit for two days. Her experience sound similar to what I’ve seen with people who are handed diversion programs some sort of alternative sentencing and fail to complete it. The judge will throw the book at you.

Texas State is a university known for partying… it’s in between San Antonio and Austin up I35, they party 24/7 ! Dont know how anyone graduated from there but I can see why she, along with thousands of others, do not graduate. Texas is still great! Born & raised and have lived all over Texas 🤟

I did 2 years at Dawson State Jail before they closed it. This is exactly how I remember pulling chain to the diagnostics unit. Walking down main street in your XXXXL nightgown and boots. Yuck 🤢

@@LMD40 one of the specials at Denver County Jail I would describe a sinus infection on a shingle. I'm not even a picky eater and I couldn't even touch the stuff. Also it sounds like you were working in the kitchen which is always helpful as far as kitchen staff tends to eat better.

It surprises me that her facility didn't have a vegitarian option. Last I knew TDCJ offered "Meat free", "diet for health" options. Usually the state jail facilities are pretty rough because the inmates don't have much time to do so they don't care. I was interested to know what facility she was in. I was a little disappointed she didn't say.

That's crazy time for 1st offense. I got a DUI in California and i spent 6 hrs in jail, paid a $1500 fine 3 years probation informal, and had my driver's license suspended. I even had several violations for drinking, since i had a no drinking clause, and i just did city jail time (6 -8 hrs) but my probation was reinstated.

Man that sucks. 1 pill😂. I got a DUI many years ago and was a .079. I have an eye disease and have to wear a very specialized contact without which I cannot function and I have very dry eyes and for some dumb ass reason didn’t have my eye drops with me which really messed up my vision. The police and ambulance showed up at the same time. I wisely went with the ambulance and I had a friend bring all my eye stuff (drops, plungers to take them out, etc. ). I’ve since learned you NEVER DO THAT SOBRIETY TEST NC NO MATTER WHAT - even sober your gonna fail. I no longer drink but if I did I wouldn’t even drive hamster one drink. I had to spend 8 hrs in jail and they see so miserable bc they wouldn’t let me have my eye drops. The 1st nurse was nice and when I went in and asked her would let me use them. I had youth and cuteness on my side - this was many yrs ago. The 2nd nurse was a female and a bitch. She would scream at me whenever u asked. I was in SO much pain I thought I was gonna have permanent damage. It sucks what happened to you. Jail should be a last resort for real criminals .
